On October 24, the State Energy Administration issued the " Notice on Further Standardizing the Management of Power Business Licensing for Renewable Energy Power Generation Projects", which clarifies the scope of concurrent posts of relevant managers of renewable energy power generation projects, standardizes the registration of renewable energy power generation project licenses, and establishes the registration of renewable energy power generation project licenses. Adjust the renewable energy power generation project (unit) license extension policy, clarify the power business license management responsibilities of registered enterprises in different places, etc. According to the
notice, the photovoltaic power generation project is registered in the power business license with the AC side capacity (the sum of the rated output power of the inverter, unit MW). Those put into production in batches may be registered in batches. Before the issuance of this notice, the total nominal power (unit MWp) of photovoltaic modules registered in the power business license will not be changed.

In order to further standardize the management of power business licensing for renewable energy power generation projects and help promote the green, low-carbon and high-quality development of energy, the relevant matters are hereby notified as follows.
1. Exemption of power business licenses
for decentralized wind power projects On the basis of the existing license exemption policy, decentralized wind power projects are included in the scope of license exemption and are not required to obtain power business licenses. Prior to the issuance of this
Circular, the decentralized wind power project operation enterprises that have obtained the power business license shall apply to the local agency of the National Energy Administration (hereinafter referred to as the agency) for cancellation of the power business license.
2. When a renewable energy power generation project operating enterprise applies for a power business license, it shall clarify the scope
of the relevant management personnel of the renewable energy power generation project. The qualifications and work experience of the person in charge of production and operation, the person in charge of technology, the person in charge of safety and the person in charge of finance shall meet the requirements of the Regulations on the Administration of Electric Power Business Licenses. Among the above-mentioned personnel whose project is under the unified management of the professional operation and maintenance company or the internal affiliated enterprise of the enterprise (group), the person in charge of technology and the person in charge of finance can hold concurrent posts among projects in different provinces; the person in charge of production and operation can only hold concurrent posts among different projects in the same province, and shall not hold concurrent posts under other circumstances. When applying for a power business license, a renewable energy power generation project operation enterprise shall provide the employment documents and relevant work experience of the above-mentioned personnel. If the managers of renewable energy power generation project operation enterprises that
have obtained the power business license do not meet the above requirements, they shall make changes within one year after the issuance of this circular, and if they fail to make changes within the time limit, they shall be dealt with in accordance with the situation that the license conditions are not maintained.
3. Standardize the licensing registration
of renewable energy power generation projects. When applying for power business licenses for renewable energy power generation projects such as wind power and photovoltaic power generation, a single unit/unit (hereinafter referred to as the unit) or multiple units can be registered in the same column of "Unit Registration". If a single unit is registered, the commissioning date shall be the date when the unit is connected to the grid for power generation for the first time; if multiple units are registered, the commissioning date shall be the date when the last unit of the multiple units is connected to the grid. If the same batch of production units are registered separately due to different unit models, the production date shall be registered as the grid connection date of the last unit of the batch. The project operation enterprise shall be responsible for the authenticity of the production date filled in when applying for the power business license. For the enterprises that have obtained the power business license before the issuance of this Circular, if the production date of the generating units registered in the license is inconsistent with the above requirements, they shall apply to the license issuing authority for the change of registration items within one year after the issuance of this Circular, and provide the relevant materials that can prove the production date of the generating units; if the change is not made within the time limit, it shall be handled according to the inconsistency between the actual situation of the generating units operated by the enterprises and the license registration.
Photovoltaic power generation projects are registered in the power business license with AC side capacity (sum of rated output power of inverters, unit MW), and can be registered in batches if they are put into operation in batches. Before the issuance of this notice, the total nominal power (unit MWp) of photovoltaic modules registered in the power business license will not be changed.
4. Adjust the renewable energy power generation project (unit) license extension policy
. Wind turbines that have reached the design life shall carry out safety assessment in a timely manner in accordance with the relevant provisions of the Measures for the Administration of Upgrading and Decommissioning of Wind Farms (Guo Neng Fa Xin Neng Gui [2023] No.45). After the evaluation meets the conditions for safe operation and the evaluation results are reported to the local competent department of energy, the relevant operating enterprises shall apply for license renewal in accordance with Article 15 of the Measures for the Supervision and Administration of Electric Power Business Licenses; if the safety evaluation is not carried out or the evaluation results do not meet the requirements for safe operation, the electric power business license shall be cancelled (changed). Biomass and photothermal generating units that
have reached the design life shall be implemented in accordance with the policies and standards for the continuation of the license for coal-fired generating units.
According to the current management policy of hydropower industry, hydropower units are not included in the license renewal management for the time being. When applying for a power business license for a hydropower unit, the design life of the unit shall not be registered.
5. To clarify the responsibilities
of power business license management of enterprises registered in other places, if the location of renewable energy power generation projects is not in the same province as the registered place of operating enterprises, the application and change of power business license of the power generation projects shall be submitted to the local office of the project location. If the same enterprise operates multiple renewable energy power generation projects in different jurisdictions, but fails to register as a company, non-company enterprise legal person or branch in the market supervision and management department of the project location, the application for power business license and the change of licensing items shall be submitted by the project legal person to the local dispatched offices of each project location. An enterprise (identified by a unified social credit code) can only obtain one power business license for all projects within the jurisdiction of a dispatched office.
6. Strengthen the management
of licensing data and information of renewable energy power generation projects and establish a regular verification mechanism for licensing data and information. Licensed renewable energy power generation project operation enterprises shall check the relevant data and information of operating project licensing once a year in the light of their daily business. For the registration items and licensing items that have changed, they shall apply to the local offices for change formalities within 30 days, and supplement and improve other relevant data and information. For enterprises that have not logged in the system to improve their data information within two years, the dispatched agencies should focus on it, strengthen daily supervision, ensure the dynamic adjustment of licensed data information, and update it in the national renewable energy power generation project information management platform.
This Circular shall enter into force as of the date of issuance and shall be valid for five years.
