11 of the National Energy Administration of the National Development and Reform Commission is issued. In order to further promote the high-quality development of incremental distribution network, the Energy Bureau of the Autonomous Region drafted the Rules for the Implementation of Incremental Distribution Network Management (Draft for Opinions) and Several Measures for Promoting the High-quality Development of Incremental Distribution Network (Draft for Opinions), and solicited opinions from the public for the first time from March 8 to 22. According to the situation of soliciting opinions, after revision and improvement, it is now the second time to solicit opinions from the public. Article 2 The incremental distribution network mentioned in these Rules refers to local power grids such as 110 kilovolt and below voltage level power grids and 220 kilovolt and below voltage level industrial parks (economic development zones), and does not involve the construction of transmission grids above 220 kilovolts. As required, the planned 220 (330) kV voltage level local power grid with only distribution function under normal mode can be included in the scope of incremental distribution network. Article
3 Incremental distribution network is a part of the power grid system of the autonomous region, enjoying the rights of market transaction, power access, settlement, dispatching, measurement management, independent decision-making and participation in regional distribution network planning. Article
4 Incremental distribution network shall strictly comply with the requirements of laws and regulations such as the Energy Law of the People's Republic of China, the Electric Power Law of the People's Republic of China, the Regulations on Power Supply and Use, and the Rules for Power Supply Business, and provide reliable power to power users in the distribution area of incremental distribution business (hereinafter referred to as the distribution area). Power supply services shall not be refused or interrupted without legal or agreed reasons. Power grid enterprises at the autonomous region level should provide grid interconnection services to incremental distribution networks in a fair and non-discriminatory manner. Article
5 Incremental distribution networks and autonomous region-level power grids are interconnected and have equal market status. Article
6 The autonomous region-level power grid enterprises mentioned in these Rules refer to Inner Mongolia Electric Power (Group) Co., Ltd. and State Grid Inner Mongolia Eastern Electric Power Co., Ltd; The autonomous region-level power grid is invested and managed by Inner Mongolia Electric Power (Group) Co., Ltd. and State Grid Inner Mongolia Eastern Electric Power Co., Ltd. in Inner Mongolia Autonomous Region and has a clear power supply business area. Chapter
II Incremental Distribution Network Planning
Article 7 The competent energy department of the League City shall be responsible for organizing the compilation of incremental distribution network planning. The planning scope shall be divided according to the geographical scope determined by the overall planning of administrative regions or development zones and industrial parks, with clear boundaries, so as to maintain the integrity and continuity of the incremental distribution network as far as possible and meet the requirements for the division of distribution areas. Article
8 Incremental distribution network planning shall be fully linked up with the power grid planning of the autonomous region, so as to avoid duplication of construction, cross-supply, universal service and guaranteed power supply services. Article
9 Before the incremental distribution network planning is formally compiled, the competent energy department of the League City shall seek the opinions of the relevant departments of the League City, industrial parks (development zones), power supply companies of the League City and potential investors to determine the preliminary division of distribution areas. The competent energy department of the League City may collect necessary planning information from the League City Power Supply Company, and the League City Power Supply Company shall provide relevant information within 15 working days after receiving the request for submission. The planning information mainly includes the current situation of the local power system, the development plan of the power grid and the interval, load and power supply capacity of the relevant substations. Article
10 In the process of compiling the incremental distribution network planning, the competent energy department of the League City shall fully solicit the opinions of the power supply company of the League City, and may set up the identification link of duplicate construction according to actual needs; If the distribution network planning related to incremental distribution network planning really needs to be adjusted after demonstration, it shall be adjusted by the Energy Bureau of the Autonomous Region after fulfilling the procedures in accordance with the relevant requirements of power planning management. Article
11 After the compilation of the incremental distribution network planning is completed, the competent energy department of the League City shall entrust a qualified third-party advisory body to review the incremental distribution network planning. During the evaluation, the opinions of the people's government at the county level, the administrative committee of the industrial park (development zone), the relevant departments of the League city and the power supply company of the League city should be fully listened to. The third party advisory body shall ensure that the evaluation conclusion is objective and fair. Article
12 The Energy Bureau of the Autonomous Region shall incorporate the incremental distribution network planning into the relevant power grid planning of the Autonomous Region in accordance with the procedures. Article
13 If the state has approved but has not yet determined the owner of the project and has not obtained the power business license (power supply category) within two years from the date of the state's approval, it is necessary to carry out the incremental distribution network planning relying on the original incremental distribution business pilot. It is necessary to apply for withdrawal from the national incremental distribution business pilot before carrying out incremental distribution network planning. Chapter
III Division
of Distribution Areas Article 14 The Energy Bureau of the Autonomous Region shall organize the competent energy departments of the League and municipalities to prepare plans for the division of distribution areas, and solicit opinions and suggestions from the people's governments of the League and municipalities, power grid enterprises at the autonomous region level and potential investors. If it is difficult to determine the distribution area, the competent energy department of the League City shall entrust a qualified third-party professional organization to carry out the evaluation and demonstration. Article
15 The division of distribution areas shall adhere to the basic principles of fairness and justice, safety and reliability, economic rationality, clear boundaries, integrity and continuity, and clear responsibilities, and fully link up with the incremental distribution network planning to ensure the safe and stable development of the power grid. The distribution area shall avoid overlapping with the distribution area of power grid stock assets as far as possible, and the stock power load shall not be divided into the distribution area in principle. Article
16 Incremental distribution networks with the main objective of satisfying the nearby absorption of renewable energy may be divided into distribution areas according to the scope of renewable energy supply and power load. No incremental distribution network shall be planned and constructed relying on coal-fired self-owned power plants, and no back-pressure cogeneration units shall be planned and constructed in the distribution network. Article
17 The competent department of energy of the League City shall compile the Plan for the Division of Distribution Areas for Incremental Distribution Business, which shall include but not limited to the planning, coverage and ownership of property rights of the incremental distribution network, the geographical scope of the distribution area, the division boundary and the demarcation point of property rights, and attach the geographical plan of the distribution area, the distribution map of the power grid and other explanatory documents. Report to the Energy Bureau of the Autonomous Region after fulfilling the procedures. Article
18 The Energy Bureau of the Autonomous Region shall examine the Distribution Area Division Scheme for Incremental Distribution Business and publicize the distribution area after fulfilling the procedures for a period of not less than 30 days. After the end of the publicity period, the competent energy department of the League City may organize the optimization of project owners. Article
19 The Energy Bureau of the Autonomous Region shall, within 30 days after receiving the report on the optimization results of the project owners submitted by the competent energy departments of the League cities, issue opinions on the division of distribution areas to the project owners and the original power grid operation enterprises in the region, and copy them to the dispatched agencies of the State Energy Administration. Article
20 If the owner of an incremental distribution network project or the original power grid operation enterprise has any objection to the division of distribution areas, it may submit an application for objection to the Energy Bureau of the Autonomous Region within 30 days after the Energy Bureau of the Autonomous Region has issued a formal division opinion. After receiving the application for objection, the Energy Bureau of the Autonomous Region shall coordinate with the dispatched agencies of the State Energy Administration and issue disposal opinions within 60 days. During the period of objection disposal, the competent energy department of the League city (banner county) shall not examine and approve the distribution network project in the disputed area, and the relevant stakeholders in the division of the distribution area shall not construct the distribution network in the disputed area. Chapter
IV Disposal
of Stock Assets Article 21 In the process of dividing distribution areas, if it is really impossible to avoid the stock assets of power grid enterprises and other investors, the Energy Bureau of the Autonomous Region shall guide the competent energy departments of the League cities to dispose of them in the following ways on the basis of consultation with the property rights units. And serve as that basis for divide the power distribution area.
(1) The property right unit of the stock distribution network assets shares the owner enterprise of the incremental distribution network project by means of assets shareholding;
(2) The property right unit of the stock distribution network assets transfers the ownership of the stock distribution network assets to the owner enterprise of the incremental distribution network project by means of sale and property right replacement;
(3) The property owner of the existing distribution network assets leases the existing distribution network assets to the owner enterprise of the incremental distribution network project by means of leasing;
(4) The property owner of the existing distribution network assets clarifies the right to operate the distribution network assets in accordance with other laws and regulations. Article
22 From the first day of public announcement of the distribution area to the official issuance of the distribution area division opinions, no new distribution network project shall be approved or constructed in the distribution area; if there is a distribution network project that has been started, it shall be implemented in accordance with Article 20 of these Rules. Article
23 Before the period of public announcement of the division of distribution areas, distribution network projects that have been approved or filed in the distribution areas but have not started construction within the validity period of relevant documents belong to the scope of incremental distribution business, and the examination and approval departments of energy projects in the League City shall guide the original power supply enterprises to go through the formalities of project cancellation in a timely manner. To guide the owner units of incremental distribution network projects to re-handle the approval documents of distribution network projects; the distribution network projects that have been started but have less than 10% of the actual investment within the validity period of the approval (filing) documents may be included in the incremental distribution network, or may be handled with reference to Article 21 of these Rules after the coordination of the competent energy departments of the League cities.Chapter
V Owners
of Incremental Distribution Network Projects Article 24 The competent energy departments of the League City shall be responsible for formulating the preferred methods for owners of incremental distribution network projects, and shall, in accordance with the relevant provisions of the Law of the People's Republic of China on Tendering and Bidding and its Implementation Regulations, Through market-oriented methods such as bidding, the owner of the project is determined openly, fairly and impartially, and the requirements of investment ability and credit evaluation are put forward. The competent energy department of the League City shall report the optimization results to the Energy Bureau of the Autonomous Region within 60 days after the end of the publicity period for the division of distribution areas. Article
25 Enterprises participating in the optimization shall issue commitments on investment and construction in accordance with the requirements of the optimization method, clarify the content, duration and scope of power supply of the project construction, and bear the corresponding conse quences of violating the commitments. Article
26 Within 60 days after the end of the publicity period for the division of distribution areas, if the competent energy department of the League City fails to submit the preferred results of the project owners to the Energy Bureau of the Autonomous Region, the Energy Bureau of the Autonomous Region will publicize and cancel the results of the division of distribution areas. If the competent energy department of Ruomeng City applies for the incremental distribution network project again, the results of the distribution area division shall not be used as the basis for the incremental distribution network planning. Article
27 Incremental distribution network enterprises shall strictly implement the relevant provisions of the Company Law of the People's Republic of China, design a reasonable corporate governance structure, and have the ability and qualification to independently participate in power market transactions and implement relevant laws and regulations. Chapter
VI Incremental Distribution Network Access to New Energy and Regulation Resources
Article 28 Distribution facilities (except new energy access projects) of incremental distribution network shall be constructed in the distribution area.
The twenty-ninth autonomous regions encourage the construction of incremental distribution networks that mainly absorb new energy nearby. Only after the incremental distribution network has the power supply capacity in accordance with the relevant requirements of the state and the actual power supply operation, can it be constructed or connected to new energy sources. Article
30 The power consuming enterprises within the power distribution area may, in accordance with the requirements of the relevant rules of the autonomous region, declare market-oriented new energy projects in the form of integration of source, network, load and storage, and green power supply in industrial parks; they may construct distributed new energy projects of "full self-use", and the corresponding scale shall not be included in the scale management of distributed new energy in the autonomous region and the League cities; Incremental distribution network should be connected to distributed new energy sources built by power consumption enterprises in a fair and non-discriminatory manner. Article
31 Incremental distribution networks shall be encouraged to access centralized new energy sources, and shall not transmit electricity to other power grids in accordance with the principle of "self-peak shaving and self-absorption". Article
32 The utilization rate of all kinds of new energy connected to the incremental distribution network shall not be included in the statistical scope of the utilization rate of new energy in the autonomous region-level power grid. Article
