The quality and safety level of industrial products sold online has been greatly improved.
2. Key governance
points (1) Key products. Products used by the elderly, children, the disabled and other key groups; electronic appliances, gas appliances and accessories, food-related products, sanitary products, agricultural assets (including pesticides, fertilizers, veterinary drugs, feed, agricultural film, agricultural machinery, etc.), fire products, building insulation materials and other products closely related to the safety of people's lives and property; Products with more consumer complaints and higher social concern, such as textiles and clothing; products with higher unqualified rate of supervision and spot check; products with defects to be recalled.
(2) Key network trading operators. Large-scale comprehensive online trading platform, professional product online trading platform, live e-commerce platform, social e-commerce platform, online trading platform for self-operated business, and online trading operators who sell goods through self-built websites or other network services.
(3) Key issues. Sell products that are prohibited or restricted to be sold on the Internet; sell products that do not meet the requirements of administrative licensing or compulsory product certification and other management requirements, and do not meet the requirements of compulsory national standards; forge or falsely use certification certificates, administrative licensing certificates, inspection and testing reports; adulterate, adulterate, pass fake products off as genuine ones, pass inferior products off as high-quality ones, and sell "three noes" products; Sales of defective products that have been recalled.
3. Tasks
(1) Strengthen the source audit of key product information. We will actively promote the opening of public data such as administrative licensing and compulsory product certification related to industrial products, establish and improve the online verification mechanism, and provide support for the online trading platform to carry out identity verification, information verification, credit system construction and governance within the platform. To urge the network trading platform to implement administrative licensing, compulsory product certification and other management requirements for products, strengthen the business qualification audit and product information verification, timely intercept the information of unlicensed products, and investigate and clean up the problem businesses and products with incomplete, expired and invalid licenses, beyond the scope of licensing or certification.
(2) Compacting the main responsibility of quality and safety. Supervise the network trading platform to establish a product quality management system, and incorporate the product quality and safety status into the compliance risk control list; We will encourage the use of big data, artificial intelligence and other technical means to carry out routine inspections, establish a price information base for key products, timely investigate products whose prices are significantly lower than reasonable range, and increase the frequency of inspections and spot checks for key products with abnormal prices and concentrated complaints; for high-risk businesses with quality violations, we will take timely measures such as removing goods from shelves, closing stores and sealing numbers according to law. Regularly organize and carry out guidance and training on product quality and safety compliance, and strengthen the publicity of key product policies and regulations and quality and safety knowledge.
(3) Carry out network dynamic investigation and monitoring. Focus on key products and key issues, adopt "technical defense + civil air defense", "online monitoring + offline verification" and other ways to carry out rolling investigation and monitoring, urge and guide the network trading platform to immediately remove the problem products found from the shelves, inform the local industry authorities of the problem clues to trace the source, implement source control, and ensure that the problem is solved. And follow up the inspection in the field of use according to the flow of products. For online trading platforms with prominent problems of counterfeit and inferior products, internal quality control should be strengthened by means of interviews, reminders and reminders, and rectification within a time limit, which constitute violations of the law, and shall be punished according to law. Strengthen the rectification of false and misleading product quality and anti-counterfeiting traceability information published on the Internet.
(4) Strengthen quality and safety supervision and inspection. Strengthen the supervision and inspection of the product quality control of the network trading platform, urge the operators in the platform to implement the main responsibility of the quality and safety of the industrial product sales units, disclose the product quality information comprehensively, truthfully and accurately, and establish the purchase and sale account. Supervise and urge delivery enterprises to implement the safety management system of delivery articles and prevent counterfeit and inferior products from entering the delivery channels.
(5) Publicly publish the results of supervision and spot checks. We will comprehensively increase the proportion of spot checks on the quality of products sold online, expand the coverage, publish the results of spot checks in a timely manner, and seriously deal with the unqualified products and production and sales units found in accordance with the law and regulations. Establish a ranking and notification mechanism for the results of quality supervision and spot checks of online sales products, publicly publish the list and ranking of online trading platforms with high failure rate of supervision and spot checks, and timely inform the industry authorities of the results of spot checks, and implement key supervision over products and online trading platforms with high failure rate of supervision and spot checks.
(Six) crack down on violations of laws and regulations. For the clues of problems found in supervision and inspection, supervision and spot check, platform self-examination and monitoring and investigation, we should strengthen online and offline integrated supervision and law enforcement and two-way verification and disposal to form a closed-loop law enforcement. We should strengthen the connection of execution and resolutely transfer suspected crimes to judicial organs. We will intensify our efforts to crack down on counterfeit and inferior commodities in import and export links, improve the early warning and rapid response supervision mechanism for the quality and safety risks of import and export commodities, and continue to carry out the special action of "golden key" inspection. Investigate and handle a number of typical cases of network sales violations, and force the network trading platform and operators within the platform to implement quality and safety responsibilities.
(7) Establish the main information base of live marketing and the monitoring information system of live e-commerce. Strengthen data docking and submission, and establish the main information base of live marketing. Organize and carry out monitoring of high-risk live marketing activities, distribute the illegal and irregular clues found in the monitoring to the local market supervision department, and urge and guide the local to deal with them in time and in accordance with the law.
(8) Promote the traceability and anti-counterfeiting of key products sold online. Focusing on online sales products involving safety, the pilot project of code assignment and verification was organized to explore the mechanism of code assignment at the source of production, code identification at the platform and code identification by consumers. Promote the network trading platform to participate in the verification of code assignment, strengthen the audit of product entry, consciously sell the products of code assignment, and promote the solution of the problems of "wrong goods" and counterfeit and inferior products by identifying the authenticity and tracing the source of the "code".
(Nine) improve the law enforcement cooperation mechanism. We will promote the establishment of a cross-sectoral and cross-regional cooperation mechanism for the supervision of the quality and safety of products sold online, so as to form a joint force to crack down on counterfeit and inferior criminal networks and industrial chains. Encourage Beijing, Shanghai, Zhejiang and other large online trading platforms, as well as the Beijing-Tianjin-Hebei, Yangtze River Delta, Pearl River Delta and other geographically adjacent areas to establish a regional law enforcement coordination linkage mechanism, clarify the requirements of illegal clues, evidence transfer, information sharing, entrusted investigation, cooperation and implementation, timely research and judgment, early warning, disposal and elimination of all kinds of online product quality and safety risks.
(Ten) establish and improve the system of laws and regulations. To formulate and promulgate the Implementation Measures for Quality Supervision and Spot Inspection of Online Sales Products, refine the spot inspection methods of online sales products, and clarify the requirements of sampling procedures and sample confirmation. To formulate and promulgate the Measures for the Supervision and Management of Live E-commerce, clarify the behavior norms and legal responsibilities of live e-commerce platforms, operators of live broadcasting rooms, service agencies of live marketing personnel and live marketing personnel, and strictly regulate the operation of live e-commerce.
(11) Actively promote social co-governance. Strengthen the publicity of network integrity management concept and network consumption safety knowledge, and create a good atmosphere for the whole society to pay attention to and participate in the quality and safety supervision of online products. Open channels for complaints and reports, and encourage the public to report illegal and irregular clues of online products. Give full play to the role of industry associations and consumer organizations, encourage the introduction of industry service standards and self-discipline conventions, encourage the development of online product quality improvement actions, and guide online trading operators to operate in compliance with regulations.
