August 15 is the fourth National Ecological Day. The Ecological Environment Code of the People's Republic of China, the second law named after the "Code" after the Civil Code, will come into effect on the 15th, marking that the construction of the rule of law in China's ecological environment has entered a new realm and further laying a solid foundation for the modernization of the harmonious coexistence of man and nature.
The compilation of the ecological environment code is a major political and legislative task deployed by the Party Central Committee with Comrade Xi Jinping as its core. The compilation of the ecological environment code is to form a code with Chinese characteristics, reflecting the characteristics of the times, reflecting the will of the people, and coordinating the system and norms, guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, especially the ecological civilization of Xi Jinping, through the systematic integration, compilation and sublimation of the existing legal system and norms of the ecological environment. On March 12
this year, the Fourth Session of the Fourteenth National People's Congress voted to adopt the Ecological Environment Code. With 5 volumes and 1242 articles, the Code is the "epitome" of more than 30 ecological and environmental laws, more than 100 administrative laws and regulations, and more than 1000 local laws and regulations. Each volume is as follows: general provisions, pollution prevention and control, ecological protection, green and low-carbon development, legal liability and Supplementary Provisions.
In order to fully and effectively implement the Ecological Environment Code, the State Council has cleaned up the administrative regulations involved, decided to amend some provisions of 12 administrative regulations and abolish 3 administrative regulations. The Supreme People's Court issued the first supporting judicial interpretation of the Code to solve the problem of the convergence and application of the old and new laws after the implementation of the Code. The Ministry of Ecology and Environment has systematically reviewed and revised relevant documents, and abolished 176 regulatory documents; accelerated the formulation and revision of standards, and strengthened benchmarks. This year, the Ministry of Ecology and Environment has issued a new version of 64 ecological and environmental standards, including the Ambient Air Quality Standards, and the first national marine ecological and environmental benchmarks. After the implementation of
the Eco-environmental Code, 10 laws, including the Environmental Protection Law, the Environmental Impact Assessment Law, the Marine Environmental Protection Law, the Air Pollution Prevention and Control Law, the Water Pollution Prevention and Control Law, the Soil Pollution Prevention and Control Law, the Solid Waste Pollution Prevention and Control Law, the Noise Pollution Prevention and Control Law, the Radioactive Pollution Prevention and Control Law and the Clean Production Promotion Law, were abolished.
