Chapter I General Provisions

3 The supervision of ecological environment protection shall follow the following principles:

II Organizational Leadership and Institutional Responsibilities

Article 4 Under the centralized and unified leadership of the Party Central Committee, the supervision system of ecological environment protection at the central and provincial, autonomous regional and municipal levels shall be implemented.

provinces, autonomous regions and municipalities directly under the Central Government is an extension and supplement of the supervision of ecological environment protection of the central government, which carries out supervision on the Party committees and governments at the municipal level, relevant departments of provincial governments and relevant provincial enterprises in their respective administrative regions. Article

5 The Central Leading Group for Supervision of Eco-environmental Protection shall be established to work under the leadership of the Political Bureau of the Central Committee and its Standing Committee. Article

6 The Leading Group of the Central Eco-environmental Protection Supervision shall be responsible for coordinating, guiding and supervising the work of the Central Eco-environmental Protection Supervision. The main responsibilities are:

(1) To study and implement Xi Jinping's thought of ecological civilization, to implement the decisions and arrangements of the Party Central Committee and the State Council on comprehensively promoting the construction of a beautiful China, strengthening the construction of ecological civilization and the protection of the ecological environment, and to study and deploy the central supervision of ecological environment protection;

7 The Office of the Leading Group of the Central Eco-environmental Protection Supervision is located in the Ministry of Ecology and Environment, which is responsible for the daily work of the Leading Group and the organization and implementation of the Central Eco-environmental Protection Supervision. Article

8 The Central Supervision Group for Eco-environmental Protection shall be established in accordance with the work arrangement of the Central Supervision Group for Eco-environmental Protection and with the approval of the Party Central Committee and the State Council.

The Central Eco-environmental Protection Supervision Group shall have a group leader and a deputy group leader, and the specific candidates shall be determined and authorized according to each supervision task. Among them, the group leader shall be a leading cadre at the provincial or ministerial level who is currently in office or has recently retired from a leading post. Establish a team leader candidate pool, which is managed by the Central Organization Department and the Office of the Leading Group of the Central Eco-environmental Protection Supervision. 9 The duties of the Central Supervision Group for Eco-environmental Protection are as follows:

(1) To carry out supervision under the leadership of the Central Leading Group for Eco-environmental Protection Supervision in accordance with the deployment requirements of the Party Central Committee and the State Council;

(2) To report to the Central Leading Group of Eco-environmental Protection Supervision on the situation of supervision, and put forward opinions and suggestions;

(3) To organize the formation of a list of typical cases, clues to the investigation of responsibility for ecological environmental damage, and files, and to draft and form a supervision report;

(4) Feedback the supervision opinions to the objects under supervision, and participate in promoting the rectification and application of the results of supervision;

(5) Educate, manage and supervise the cadres of the supervision group;

(6) Handle other matters assigned by the Central Leading Group of Eco-environmental Protection Supervision. Article

10 The relevant departments of the central and state organs shall support the central supervision of ecological environment protection and assist in relevant work. Article

11 The Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government shall organize the supervision of ecological environment protection in their respective administrative regions, strengthen overall coordination, and urge relevant departments and units to carry out relevant work. Article

12 According to the work arrangement of ecological environment protection supervision in provinces, autonomous regions and municipalities directly under the Central Government, provincial ecological environment protection supervision groups shall be established with the approval of the Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government. Chapter

III Objects and Contents

of Supervision Article 13 The objects of the central supervision of ecological environment protection include:

(1) Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government;

(2) The Ministry of Ecological Environment and the relevant departments of the State Council responsible for the protection of the ecological environment;

(3) The relevant central enterprises engaged in production and operation activities that have a greater impact on the ecological environment;

15 The objects of supervision of ecological environment protection in provinces, autonomous regions and municipalities directly under the Central Government are the municipal Party committees and governments in their respective administrative regions, the competent departments of ecological environment at the provincial level, the relevant departments of provincial governments and the relevant provincial enterprises. The main contents of the supervision include:

(1) the study and implementation of Xi Jinping's ecological civilization thought and the implementation of the decisions and arrangements

of the Party Central Committee and the State Council on the construction of ecological civilization and the protection of the ecological environment; (2) the rectification of the feedback problems from the central and provincial ecological environment protection inspectors;

IV Working Procedures and Methods

Article 16 The supervision of ecological environment protection by the central government and provinces, autonomous regions and municipalities directly under the Central Government shall take the form of routine supervision, "looking back", special supervision and warning films on ecological environment. 18 In the preparatory stage of supervision, we shall organize and carry out a centralized arrangement of problem clues according to the needs of our work, and inform the relevant departments and units about the situation of the supervised objects and the problem clues. Article

19 During the period when the routine inspectors are stationed, the inspection team shall carry out its work mainly in the following ways:

(1) Listen to the work reports and relevant special reports of the objects under inspection;

(2) Have individual talks with the main responsible comrades of the Party and government and other relevant responsible comrades of the objects under inspection;

(3) To accept the people's complaints and reports on the protection of the ecological environment;

(4) To read and copy relevant documents, archives and other materials;

(5) To visit and inquire the relevant localities, departments, units and individuals;

(6) holding symposiums and attending the relevant meetings of the supervised objects;

(7) conducting open and secret investigations in the relevant localities, departments and units of the supervised objects;

(8) To investigate and collect evidence according to the clues of problems, and to instruct the relevant localities, departments, units and individuals to make written explanations on the relevant problems;

(9) To conduct spot checks and return visits on the rectification of the problems reported by the people;

(10) In view of the prominent problems found by the inspectors, the relevant leading cadres of the Party and government may be interviewed or interviewed according to the circumstances;

(11) Other necessary ways of supervision.

20 During the period of routine supervision, typical cases of prominent ecological and environmental problems found by the inspectors shall be formed and published publicly after being submitted for approval in accordance with the procedures. Article

21 After the completion of the stationing of the inspectors, the inspection team shall form an inspection report, truthfully report the important situations and problems found by the inspectors, and put forward opinions and suggestions; a special report may be formed on the prominent problems existing in the handling of the relevant important instructions, the major situations found by the inspectors, and the comprehensive situation of the river basin inspectors. The supervisory group shall make a draft of the problems reflected in the supervisory report and the special report.

The inspection team shall set up an independent audit team to conduct an independent audit of the inspection report.

The supervision report shall exchange opinions with the supervised object in an appropriate way and be submitted for approval in accordance with the procedures. The report of the Central Eco-environmental Protection Supervision shall be submitted to the Party Central Committee and the State Council for approval after being studied and discussed by the Office of the Leading Group of the Central Eco-environmental Protection Supervision. Article

22 After the approval of the inspection report, the inspection team shall give timely feedback to the inspected objects, point out the problems found by the inspectors and put forward suggestions for rectification. After the

inspectors "look back", special inspectors and ecological environment warning films are submitted for approval according to the procedures, the relevant information and problems are fed back to the supervised objects. Article

23 In the supervision work, the relevant departments shall be consulted on the policies and regulations involved and their application according to the needs of the work. Relevant departments should put forward clear and clear opinions in accordance with the law, in a timely and objective manner. Article

24 The supervised objects shall do a good job in investigating and dealing with the ecological environment problems reported by the people's letters and visits during the period of supervision, as well as other problems handed over by the supervisory group, and establish and improve a long-term mechanism for problem rectification and supervision and guarantee, so as to ensure that the relevant problems are investigated and solved in place. Article

25 The specific work arrangements of supervision, the situation of border supervision and reform, the typical cases of prominent problems, the main contents of supervision reports, the main contents of supervision and rectification plans, the main contents of supervision and rectification, and the relevant situation of supervision and accountability shall be made public in accordance with relevant requirements, respond to social concerns and accept the supervision of the people. Chapter

V Supervision and Rectification

Article 26 The object of supervision is the main body responsible for supervision and rectification, and the main responsible comrades are the first responsible persons for supervision and rectification. Article

27 After receiving the feedback from the inspectors, the inspected objects shall organize the preparation of the rectification plan for the inspectors, and clarify the main body, objectives, time limit, key measures and acceptance units for the implementation of the rectification one by one.

The supervision and rectification plan shall be submitted to the Party Central Committee, the State Council or the Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government for approval within the prescribed time limit.

The twenty-eighth supervised objects should do a good job of rectification and implementation in accordance with the requirements of the supervision and rectification plan. For the long-term rectification task, it should be carried out in an orderly manner according to the stage objectives and time nodes; for the rectification task left over by history, it should effectively provention and control the ecological and social risks and advance steadily.

The supervised object shall check and accept the completed supervision and rectification tasks.Article

29 The supervised objects shall report the situation of supervision and rectification to the Party Central Committee, the State Council or the Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government as required. After all the tasks of supervision and rectification are completed, the overall situation of rectification shall be reported to the Party Central Committee, the State Council or the Party committees and governments of provinces, autonomous regions and municipalities directly under the Central Government. The work of the central ecological environment protection supervision and rectification shall be copied to the leading group of the central ecological environment protection supervision.

The thirtieth supervision and rectification work should set up accounts and implement inventory management. VI Application

of Supervision Results Article 31 Establishes a mechanism for transferring clues to the investigation of responsibility for ecological environmental damage by the central supervision of ecological environmental protection. If the inspectors find suspected violations of discipline and law, they shall be transferred to the disciplinary inspection and supervision organs or judicial organs for handling in accordance with the relevant provisions. Article

34 Provinces, autonomous regions and municipalities directly under the Central Government shall, in light of the actual situation, strengthen the application of the results of supervision, and investigate the responsibility for the important ecological environment problems and their dereliction of duty found in the supervision and rectification according to the rules and regulations. VII Team Building and Disciplinary Responsibility

Article 35 The leading group of the central supervision of ecological environment protection and the leading mechanism of the supervision of ecological environment protection in provinces, autonomous regions and municipalities directly under the Central Government shall strengthen the overall planning for the construction of the contingent of supervisory cadres, establish and improve relevant systems and mechanisms in light of the characteristics of the supervision work, and strengthen the supervision. the inspectors are stationed, the provisions of democratic centralism, requests for reports on major matters, avoidance and confidentiality shall be strictly enforced. The inspection team shall not interfere with the normal work of the supervised object, shall not deal with the specific problems of the supervised object, and shall not make requests to the supervised object that have nothing to do with the supervision work. 38 During the period when the supervisory group is stationed, it shall establish a temporary Party branch in accordance with the relevant provisions, implement the requirements of strictly administering the Party in an all-round way, implement the "one post, two responsibilities", consciously accept supervision from all sides, and carry out the supervisory work in accordance with the rules and regulations.

Any unit or individual has the right to report and accuse the violation of rules and regulations by the supervisory group and its members. Article

39 If the relevant departments and units fail to assist and support the supervision of ecological environment protection in accordance with the relevant provisions, resulting in serious consequences, the relevant responsible persons shall be investigated for their responsibilities in accordance with the relevant provisions. 40 If a member of the supervisory group has one of the following circumstances, he shall, depending on the seriousness of the circumstances, be given critical education, ordered to inspect, admonished and encouraged, organized to deal with or punished by Party discipline and government affairs in accordance with the rules and regulations; If a crime is constituted, criminal liability shall be investigated according to law:

(1) failing to carry out supervision in accordance with work requirements, resulting in the failure to discover important ecological and environmental problems that should be discovered;

(2) failing to report the situation of supervision truthfully, concealing, distorting or fabricating facts;

(3) Disclosing undisclosed information such as state secrets, work secrets and business secrets related to the supervision work;

(4) Exceeding the authority or failing to carry out the supervision work in accordance with the prescribed procedures, resulting in adverse consequences;

(5) Taking advantage of the work of supervision to seek personal gains or seek illegitimate interests for others;

(6) Other acts in violation of the discipline of supervision. Article

41 The supervised objects shall consciously accept the supervision of ecological environment protection and actively cooperate with the supervision work. If the supervised object has one of the following circumstances, depending on the seriousness of the circumstances, the leading group of the Party and government, the relevant departments (units), the main responsible comrades of the enterprise or other relevant responsible personnel shall be given critical education, ordered to inspect, admonished and encouraged, organized or punished by Party discipline and government affairs in accordance with the rules and regulations; If a crime is constituted, criminal liability shall be investigated according to law:

(1) Deliberately providing false information, concealing, distorting or fabricating facts;

(2) Refusing or intentionally failing to provide relevant documents and materials to the supervision group as required;

(3) Instigating or forcing relevant units or personnel to interfere with or obstruct the work of supervision;

(4) Refusing to cooperate with on-site inspection or investigation and evidence collection;

(5) Organizing and leading the supervision to rectify ineffectively, failing to implement the requirements of supervision and rectification, perfunctory response and false rectification;

(6) Threatening, attacking, retaliating against, or framing the cadres and masses who have reported the situation;

(7) Adopting a "one-size-fits-all" approach to deal with the inspectors, such as stopping work, stopping production, and stopping business, and so on, because of inaction in peacetime;

(8) Other situations that interfere with the work of inspectors. Chapter

8 Supplementary Provisions

Article 42 Local Party committees and governments at or below the prefectural and municipal levels shall, in accordance with regulations and laws, strengthen supervision over the work of ecological environmental protection of Party committees and governments at lower levels and their relevant departments.Article

43 The Office of the Central Leading Group for Supervision of Eco-environmental Protection shall be responsible for the interpretation of these Regulations. Article

44 These Regulations shall go into effect as of the date of promulgation. The Regulations on the Supervision of Central Eco-environmental Protection issued by the General Office of the Central Committee and the General Office of the State Council on June 6, 2019 shall be abolished at the same time.
