In order to further implement the strictest cultivated land protection system, strictly abide by the bottom line of resource security, severely crack down on natural resources violations, and give full play to the warning and educational role of typical cases, Chenzhou Natural Resources and Planning Bureau recently reported nine typical cases of natural resources violations.
01 Basic information of the cross-border mining case
of a graphite mine in Jinjiang Town, Linwu County: In 2020, a graphite mine in Jinjiang Town, Linwu County exploited graphite resources beyond the scope approved by the mining license without approval.
Result: On June 27, 2021, the Natural Resources and Planning Bureau of Chenzhou City placed the mine's cross-border mining on file for investigation, and on August 2, 2021, the case and relevant information were transferred to the Chenzhou Public Security Bureau for criminal responsibility. On September 30, 2022, the People's Court of Suxian District sentenced the company to illegal mining in the first instance and imposed a fine of 600,000 yuan; Luo, the chairman of the company, was sentenced to five years in prison and a fine of 200,000 yuan; Tang, the director of the mine, was sentenced to four years in prison and a fine of 100,000 yuan; Luo, the deputy director of the mine, was sentenced to three years and six months in prison and a fine of 100,000 yuan.
02 Basic information of the unlicensed mining case
of Zhang, a villager in Qiaoshi Township, Guiyang County: In 2020, Zhang, a villager in Qiaoshi Township, Guiyang County, mined mountain sand in Laoya Group, Huishan Village, Qiaoshi Township, Guiyang County without obtaining a mining license.
Result: On February 26, 2021, the Natural Resources Bureau of Guiyang County investigated Zhang's illegal mining behavior, and transferred Zhang's illegal mining case and related information to the Public Security Bureau of Guiyang County for criminal responsibility. On July 5, 2022, the People's Court of Guiyang County sentenced Zhang to one year's imprisonment according to law.
03 Basic information of the unlicensed mining case
involving four people including Liu in Yangtianhu Yao Nationality Township, Beihu District: In April 2023, four people including Liu, a villager in Caikoushui Village, Yangtianhu Yao Nationality Township, Beihu District, mined about 10,000 cubic meters of mountain sand in Caikoushui Village without a license in the name of building roads without obtaining a mining license.
Result: In July 2023, the Natural Resources Bureau of Beihu District investigated the illegal mining activities of Liu and other four people, and transferred the illegal mining cases and related information of Liu and other four people to the Beihu Branch of Chenzhou Public Security Bureau for criminal responsibility. Now Liu and other four people have all been criminally detained.
04 Basic information of the case
of two villagers including Zeng occupying basic farmland and dumping dregs in Xiaojiang Town, Guidong County: In March 2023, two villagers including Zeng occupying 5.9 mu of basic farmland in Jiangbei Group, Jiangshan Village, Xiaojiang Town, Guidong County without authorization.
Result: In April 2023, the Natural Resources Bureau of Guidong County investigated the illegal occupation of basic farmland and dumping of dregs by Zeng and other two people, and transferred the case of destroying basic farmland by Zeng and other two people and related information to the Forest Public Security Bureau of Guidong County for criminal responsibility. The Forest Public Security Bureau of Guidong County formally accepted the case on April 23, 2023, and is currently investigating it.
05 Basic information of the case
of six people including Lu occupying basic farmland to breed bullfrogs in Tuqiao Town, Rucheng County: In June 2022, six people including Lu, a villager in Jiafu Village, Tuqiao Town, Rucheng County, illegally occupied 49.21 mu of permanent basic farmland in Dongao Village and Qinglong Village, Tuqiao Town without approval. Build facilities such as sunshade nets and purse seines to breed bullfrogs.
Result: On March 17, 2023, the Natural Resources Bureau of Rucheng County investigated and dealt with the illegal occupation of basic farmland by Lumou and other six people to breed bullfrogs, and ordered them to remove sunshade nets, purse seines and other facilities by themselves to restore the land to its original state. In June 2023, the parties concerned dismantled all the facilities such as sunshade nets and purse seines, restored the damaged permanent basic farmland, and planted rice.
06 Basic information of the case
of Wang occupying basic farmland to plant osmanthus trees in Yongxing County: In December 2022, Wang, a villager in Maqiao Village, Berlin Town, Yongxing County, illegally occupied 0.9 mu of basic farmland to plant osmanthus trees in front of his house without approval.
Result: In April 2023, the Natural Resources Bureau of Yongxing County investigated and dealt with Wang's illegal occupation of basic farmland to plant osmanthus trees, and ordered him to rectify himself and restore the land to its original state. In April 2023, Wang Mou removed the osmanthus trees by himself and restored the farmland to its original state.
07 Basic information of the case
of Wenmou, a villager in Jinping Town, Jiahe County, occupying basic farmland to dig ponds for fish farming: In December 2022, Wenmou, a villager in Wenjia Village, Jinping Town, Jiahe County, occupied 4.419 mu of basic farmland in Wenjia Village to dig ponds for fish farming without approval.
Result: In December 2022, the Natural Resources Bureau of Jiahe County investigated and dealt with Wenmou's illegal occupation of basic farmland to dig ponds for fish farming, and ordered him to rectify immediately and restore the illegally occupied permanent basic farmland. of illegal occupation of basic farmland by a mining company
in Yizhang County: In December 2022, a mining company in Yizhang County, Chenzhou City, without approval, occupied 1.47 mu of basic farmland in Luojiaotang Village, Bali Town, Yizhang County to build prefabricated houses, roads and temporary storage yards.
Result: In June 2023, the Natural Resources Bureau of Yizhang County investigated and dealt with the illegal occupation of basic farmland by the company, and ordered it to demolish the prefabricated houses and hardened cement flats built by itself and restore the farmland to its original state. In July 2023, the company demolished the movable board houses, temporary storage yards and roads by itself, restored the original state of cultivated land and put it in place.
09 Basic information of the case
of illegal occupation of forest land by a wood industry company in Lingguan Town, Anren County: In October 2022, a wood industry company in Anren County occupied 1.2 mu of forest land in Guanqiao Village, Lingguan Town, Anren County without approval to build a steel structure shed for processing and stacking wood.
Result: In June 2023, the Natural Resources Bureau of Anren County investigated and dealt with the illegal land occupation of the wood company, and ordered it to demolish the steel structure shed built by itself and restore the land to its original state. In July 2023, the wood company demolished the steel shed by itself and restored the green in place.
The circular stressed that the above nine cases of land and mineral violations in the field of natural resources, which violated the relevant laws and regulations such as the Land Management Law and the Mineral Resources Law, were common types of violations in the field of natural resources and had profound warning and educational significance. Local departments in charge of natural resources should take the case as a lesson, resolutely implement the requirements of "long teeth" and "strict" law enforcement of natural resources, adhere to the red line of cultivated land protection with the strictest cultivated land protection system, strictly adhere to the bottom line of resource security with the strictest ecological environment protection system, and seriously investigate and punish the illegal acts of natural resources according to law with a "zero tolerance" attitude. For cases that meet the criteria for the transfer of criminal cases, we will resolutely transfer them to public security organs for criminal responsibility, effectively enhance the deterrence of illegal and criminal acts in natural resources, and firmly adhere to the red line of cultivated land protection and the bottom line of resource security.
