BIS said trade data showed that since the release of the 232 tariff clause on August 6, the weekly imports of polysilicon by some importers have soared sharply from the historical average, and there are obvious signs of hoarding. In order to prevent enterprises from stocking up on a large scale before the landing of the new regulations and affecting the landing effect of tariff and price limit policies, the US government urgently introduced control measures.
The Ministry of Commerce of the United States will continue to monitor its import data, comprehensively compare its multiple sets of historical indicators (cumulative and weekly average import volume after August 6, weekly average import volume from January to August in 2026, and weekly average import volume for the whole year in 2025), and check whether the company uses related entities that are not engaged in polysilicon import or newly registered importers to import.
Once the importer's import scale is determined to be significantly higher than historical average , the U.S. Ministry of Commerce will notify the U.S. Customs and Border Protection (CBP) in writing. The enterprise is prohibited from going through the import and entry formalities for polysilicon products before December 4. However, a restricted importer may submit materials to apply for an exemption from the import ban.
For new importers registered after August 6 (inclusive), due to the lack of calculable historical data, the import quota of these companies will be imposed before the exemption approval of the Ministry of Commerce of the United States. The maximum import volume per week shall be no more than 12 kg of polysilicon, no more than 7 kg of silicon wafers, and 2000 photovoltaic cells. At the same time, the new policy makes it clear that it is prohibited to circumvent the quota by registering multiple importers to split orders; customs brokers (intermediaries) will face fines, license revocation and other law enforcement penalties if they assist importers to circumvent the control of hoarding. Applications for exemption may be submitted to the Ministry of Commerce of the United States for
new record importers and stock record importers who have been banned from importing. The application documents need to disclose the equity of the enterprise, the actual controller, the use of imported goods, commercial rationality, and make a written commitment not to hoard goods. The U.S. Ministry of Commerce will complete the case review within 14 days of receiving the application. If enterprises can prove that imports have real commercial needs, they will have the opportunity to lift import restrictions and conduct business according to the standards of stock importers.
