In order to thoroughly implement Xi Jinping's thought of ecological civilization, firmly establish the concept of green development, and comprehensively promote the ecological protection and high-quality development of the Dalat section of the Yellow River Basin. In accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the Water Law of the People's Republic of China, the Regulations on River Management, the Mineral Resources Law and the Flood Control Law and other laws and regulations, we hereby announce the following matters concerning the regulation of sand and gravel mining in Dalate Banner, Inner Mongolia:
I. Sand and gravel resources belong to the state. It must be examined and approved by the relevant state departments and obtain legal licenses before it can be exploited. Those who engage in river sand resources exploitation activities without obtaining relevant licenses according to law are all illegal exploitation.
2. From the date of promulgation of this circular, all illegal mining activities in Dalate Banner must be stopped immediately, and the work of dismantling equipment, leveling sites, demobilizing employees and restoring rivers should be completed immediately. Those who do not obey management, refuse to make corrections, or obstruct law enforcement will be severely punished in accordance with the law; those who constitute a crime will be investigated for criminal responsibility in accordance with the law.
3. No unit or individual shall provide power, water source, technology, geological data, mechanical equipment, site and other conditions to support illegal mining activities. Violators shall be severely punished according to law. All personnel involved in illegal mining and processing activities must immediately stop illegal mining and processing activities, otherwise they will be punished in accordance with relevant laws and regulations.
4. It is strictly forbidden for any unit or individual to purchase, store, trade or transport illegally exploited sand and gravel resources. Those who knowingly resell, purchase or sell sand and gravel illegally mined will be investigated for legal responsibility according to law.
5. It is strictly forbidden for state functionaries and cadres of the "two committees" of Gacha Village to participate in illegal sand and gravel mining, processing, hoarding and selling. Once found, they will be handed over to the Commission for Discipline Inspection and Supervision for strict investigation and punishment.
6. Enterprises that have obtained the qualification of river sand and gravel mining must complete the relevant procedures such as sand mining permit, temporary land use and environmental assessment before they can enter the site for sand mining. And in the sand mining operation, strictly regulate the sand mining behavior, not beyond the scope, depth, excessive mining, once found, serious investigation and punishment, and confiscation of illegal sand and gravel mining and illegal income. At the same time, in addition to flood control and emergency rescue, enterprises should stop all sand mining activities in strict accordance with the relevant regulations on the prohibition of mining in the main flood season from June 15 to September 15, otherwise they will be severely punished in accordance with the law.
7. All sectors of society and the broad masses of the people are welcome to actively provide clues to illegal sand mining in rivers. Once verified, the informants will be rewarded. Units receiving reports should promptly investigate and deal with them, and keep the informants strictly confidential.
