According to the German media JUVE Patent, the European Patent Office recently revoked an authorized patent of Jingao Science and Technology. This patent is EP4092759, which is one of the patents involved in the European patent infringement dispute between Jingao Technology and Zhengtai Xinneng.
According to the report, the objection department of the European Patent Office has declared the EP4092759 patent invalid on the grounds that "the new content is beyond the scope of the original application". According to JUVE Patent, JA Technology plans to appeal against the ruling .
At this time, the validity of Jingao Technology EP4092759 patent was revoked, which may affect the hearing of the patent infringement case held in November.
Earlier, in July 2024, Jingao Technologies sued Zhengtai and its European subsidiaries to the European Union Unified Patent Court (UPC) for patent infringement. It is understood that the patents involved are EP2787541 and EP4092759 .
Among them, patent EP2787541 is TOPCon battery patent technology and EP4092759 is component patent technology, both of which originally belonged to LG Company of Korea. According to
the data, the EP2787541 patent infringement case has been scheduled to hold an oral hearing in the European Patent Court on October 28, while the European Patent Court's hearing on the EP4092759 patent infringement case will be held on November 19.
In response to the above two cases, Zhengtai and its subsidiaries filed counterclaims for patent invalidity and simultaneously initiated objection proceedings in the European Patent Office.
In addition to patent EP4092759, the validity of another patent, EP2787541, which Jingao Technology sued Zhengtai for infringement, has also been questioned. In May
2023, Carbon, a French company, filed an objection with the European Patent Office, questioning the validity of Jingao Technology's EP2787541 patent. Subsequently , Zhengtai Xinneng joined the objection procedure. Finally , in October 2024, after an oral hearing by the objection department of the European Patent Office, the patent of Jingao Technology was maintained valid .
