One billion claims reversed overnight? After being ruled invalid, Jiangsu photovoltaic enterprises "backhand" sued the State Intellectual Property Office!

The source of

this lawsuit is a high premium acquisition. In September 2025, Dike took a 60% stake in Zhejiang Sote for 696 million yuan, including the two core patents involved in the case.

completion of the patent acquisition, Zhejiang Suote, a subsidiary of Dike, filed several patent infringement lawsuits in a short period of six months, with a cumulative claim amount of about 1 billion yuan .

First, in November 2025, Zhejiang Suote sued Guangda Electronics in Zhejiang Higher People's Court for infringement of invention patents, claiming 200 million yuan; By April 2026, Zhejiang Suote added two more patents (four in total) and raised the claim amount to 400 million yuan . In

January 2026, Zhejiang Suote sued Jiangsu Riyu Photovoltaic New Materials Co., Ltd. and Suzhou Jingyin New Materials Technology Co., Ltd. for the same reason, claiming 200 million yuan ; In April, Zhejiang Kaiying New Materials Co., Ltd. was sued for 200 million yuan . The

So far, with these two patents alone, the total claim of Dike shares is about 1 billion yuan .

At that time, industry analysts said that Dike shares launched this wave of intensive patent litigation, or the "blood return" self-help under the pressure of the main business profits. According to the 2025 financial report, the net profit loss of Dike during the reporting period was 276 million yuan , down 176.8% from the same period last year . Even in the first half of 2026, the company achieved a net profit of 37.0662 million yuan , but still fell 46.90% year-on-year, nearly halving.

From this point of view, Dike shares may have hoped to win patent rights and ease the pressure of the company's operation. But just two months after the prosecution of Kaiying New Materials, the incident ushered in a key reversal . On June 2

, 2026, Dike announced that the two core invention patents held by Sun Pastor were declared invalid by the State Intellectual Property Office . The reason is that "the scope of the claim is too broad".

Then on July 3, the Zhejiang Provincial Higher People's Court rejected the previous lawsuit against Guangda Electronics by Zhejiang Sote because the State Intellectual Property Office declared the above patent invalid. At that time, Dike shares expected that the remaining three cases would be rejected by the courts for the same reasons. When

the house leaks, it rains all night. On August 21, Suzhou Jingyin and Suzhou Solid Technetium sued Dike for "maliciously filing intellectual property litigation damage liability disputes" and claimed 200 million yuan .

So far, due to the invalidation of two core invention patents, many lawsuits (or will) of Dike shares have been lost, which not only failed to help the company "return blood", but may "lose blood" .

In this regard, Dike filed a lawsuit against the State Intellectual Property Office, and the request for administrative litigation was very clear: First, the judgment revoked the decision of the State Intellectual Property Office to review the request for invalidation of No.660062 and No.660129; The second is to order the State Intellectual Property Office to make a new examination decision on the two patent invalidation requests; the third is to order the defendant to bear all the litigation costs of the case.
