重磅!湖北省住建厅发布水泥/混凝土/砂石等材料价格上涨风险管控

近日,湖北省建设厅发布关于建设工程材料价格风险管控的指导意见,意见主要针对建筑材料价格波动异常,引发合同履约困难,结算纠纷频繁。为稳定建筑市场秩序而制定。

  各市、州、直管市、神农架林区住建局,各有关建设、设计、施工、造价咨询等单位:

  近年来,我省钢材、水泥、预拌混凝土、砂石等主要建筑材料价格波动异常,引发合同履约困难,结算纠纷频繁。为稳定建筑市场秩序,降低建筑材料价格异常波动带来的风险,维护发承包双方的合法权益,现提出如下指导意见:

  一、发承包双方应增强风险防范意识,尤其是建筑材料价格风险。在编制投资估算和设计概算时,应充分考虑建筑材料价格风险因素。在招投标和施工合同签订中,发承包双方应按风险共担原则,明确约定主要材料的范围、风险幅度和调整方法,对主要材料价格不得采用无限风险、所有风险等类似表述。

  二、对于招投标的工程,招标文件中要按照有关规定明确风险幅度。招标控制价的风险幅度应与招标文件的约定一致,公布招标控制价时,要同时公布招标控制价的风险幅度。在工程价款调整和工程结算时,确定主要材料价格变化幅度,要扣除公布的招标控制价风险幅度。

  三、施工合同中,主要材料价格约定的风险幅度按《建设工程工程量清单计价规范(GB50500-2013)》规定,宜控制在5%以内。风险幅度以内的由承包人承担或受益,风险幅度以外的由发包人承担或受益。

  四、施工合同中约定了主要材料的范围、风险幅度和调整方法的,按合同的约定执行。施工合同中没有约定主要材料的范围、风险幅度和调整方法的,参照国家及建设行政管理部门的相关规定执行。

  五、施工合同中约定不调整材料价格或约定承包人承担无限材料价格风险的,合同履行期间,当主要材料价格的涨跌幅过大,继续履行合同对合同一方显失公平的,发承包双方应本着实事求是和公平公正的原则,协商签订主要材料价格调整的补充协议。

  六、材料价格的涨跌幅计算一般是以投标截止期前一个月省级或当地建设工程造价管理机构发布的材料市场信息价格为基础,与施工期省级或当地建设工程造价管理机构发布的材料市场信息价格或发承包双方认定价格计算涨跌幅。

  七、因非承包人的原因造成工期延误的,延误期间发生的材料价格涨跌的,上涨时,按上涨的价格调整合同价款;下跌时,不调整合同价款。因承包人的原因造成工期延误的,延误期间发生的材料价格涨跌的,上涨时,不调整合同价款;下跌时,按下跌的价格调整合同价款。

  八、各级建设主管部门要高度重视建筑材料价格异常波动带来的风险,合理配备工程造价管理人员,保障经费投入。要督促所属工程造价管理机构密切关注材料市场价格的波动变化,及时发布预警信息,加强对主要材料市场价格的趋势监测和动态管理。从今年7月开始,各市州工程造价管理机构应按月发布材料市场信息价格,并上报省标准定额管理总站。
