Ministry of Justice: Minimize the frequency of enterprise entry inspection

Information Office of the State Council will hold a regular briefing on the policies of the State Council at 3 p.m. on Tuesday, January 7, 2025, inviting Vice Minister of Justice Hu Weilie, Director of the Administrative Law Enforcement Coordination and Supervision Bureau of the Ministry of Justice Liu Bo, Fei Xianghong, spokesman of the Ministry of Justice and director of the Rule of Law Publicity Center, introduced the "Opinions of the General Office of the State Council on Strictly Regulating the Administrative Inspection of Enterprises" and answered questions from reporters.

Fei Xianghong said that at present, enterprises reflect more problems such as multiple inspections and repeated inspections, and the Opinions have made clear requirements to minimize the frequency of enterprise inspection, mainly from four aspects:

First, strictly control on-site inspection. If the requirements can be implemented through written verification, information sharing and intelligent supervision, on-site inspection shall not be carried out in enterprises. For example, about the basic information of the enterprise, whether it has obtained administrative permission or not, the administrative organ can obtain it through internal information sharing, so there is no need to go to the enterprise for inspection.

Second, reasonable selection of inspection methods. The Opinions require that administrative inspection should be carried out in a way that can be merged and United, and that no repeated or multiple inspections should be carried out. At present, some places have made useful attempts and explorations in improving the inspection methods. On the basis of summing up these good experiences and practices, the Opinion proposes to optimize the inspection methods such as "comprehensive inspection once". "Comprehensive inspection once" refers to the joint law enforcement inspection of the same supervisory object at the same time on the relevant administrative inspection matters involving cross-sectoral, cross-sectoral, cross-level and other law enforcement subjects. For example, in the inspection of the catering industry, law enforcement departments can check whether there is a catering service license, whether there are tableware disinfection facilities, environmental hygiene conditions and so on.

The third is to establish a hierarchical and classified inspection system. According to the different degree of standardization of enterprise's own management, the requirements for inspection frequency should also be different, and "one size fits all" should not be adopted. For example, the current practice in some places is that enterprises with relatively standardized operation and high credit rating do not need frequent inspection, while those with non-standard management and high risk rating need to strengthen management, and the frequency of inspection should be higher. The Opinions require the relevant competent departments of the State Council to establish a hierarchical and classified inspection system in this field by the end of June this year.

Fourth, publish the upper limit of annual inspection frequency. At present, the inspection of enterprises by the competent departments in some fields is too frequent, and some exceed the reasonable limit, which leads to the enterprises being tired of coping with it, and the normal production and operation are affected. In response to this phenomenon reflected by the society, the Opinion requires that the competent authorities should publish the annual frequency limit of administrative inspection of the same enterprise by the same administrative organ before the end of June this year. The purpose is to minimize the frequency of inspection through such rigid requirements, effectively reduce some unnecessary inspections and reduce the burden of enterprises.
