Luo Moyong, the site manager of Huabao Building Material Commercial Concrete Station, arranged Li Moucai, the forklift driver, to inspect and repair the potholes on the external road of the commercial concrete station. The deceased was located in front of the right rear tire of the vehicle, lying on his back in a straight line, with the right half of his body tilted, the left half of his body pressed against the bottom of the tire, the upper half of his body exposed outside the body outline, his head facing the right rear wheel, his right hand against the waist and abdomen, and his left hand straight at 90 degrees with his body.

On December 16, 2024, Qu Mousheng of Xinjiang Baifusheng Agriculture and Animal Husbandry Development Co., Ltd. purchased the above-mentioned forklift from Li Mou of the second-hand car market in Urumqi. In April 2025, it was lent to Xinjiang Huabao Building Materials Co., Ltd. for loading and unloading sand and stone materials. During the use period, Huabao Building Materials did not regularly maintain the forklift. At the time of the accident, the reversing buzzer, left reversing mirror, reflective sign and license plate of the forklift were damaged and missing.
(V) Casualties and direct economic losses
One person died in the accident. The deceased: Tian Mouqiang, male, 63 years old, Han nationality, was a worker of Huabao Building Materials Commercial Mixed Station.
The accident caused a direct economic loss of 1.2 million yuan.

(II) Emergency Treatment
at the Accident Site:" Li Mouping, who was walking from the commercial concrete station, found Tian Mouqiang lying at the bottom of the forklift and shouted to Li Moucai, the driver of the forklift. Li Moucai stopped immediately after hearing the shouting. At 10:26, Li Mouping rushed to the forklift and moved the injured Tian Mouqiang out of the front of the right rear wheel of the forklift with Li Moucai. At 10:27, Li Moucai dialed 120 emergency telephone; 29, Li Moucai reported the accident to Luo Moyong of Huabao Building Materials, and Luo Moyong immediately drove to the accident site; 50, Li Mou, a handyman in the animal husbandry park of Tori County, drove a light truck and took the initiative to help. He and Li Mou-cai and Li Mou-ping carried the injured Tian Mou-qiang to the light truck and rushed to the People's Hospital of Tori County. They met Luo Mou-yong who came after driving about 1 kilometer, and then transferred the injured Tian Mou-qiang to Luo Mou-yong's car; At about 11:00, when the driver reached the intersection of S221 and G335, he joined the 120 ambulance and transferred the injured Tian Mouqiang to the ambulance; at about 11:10, he arrived at the People's Hospital of Tuoli County for rescue; at about 11:33, he was declared dead after the hospital rescue failed.

accident, the field workers immediately organized the rescue and immediately dialed 120 emergency calls to send Tian Mouqiang to the People's Hospital of Tori County for rescue. At 11:33, he was declared dead after the hospital rescue was ineffective. Huabao Building Materials contacted the family of the deceased at the first time, and a group of four family members arrived in Tori County on May 12. On May 16, Huabao Building Materials signed the Death Compensation Agreement with the family of the deceased to compensate the family of the deceased for various expenses such as work-related death allowance, funeral allowance and pension for supporting relatives, totaling 1.2 million yuan; On the afternoon of May 16, the family members of the deceased were cremated at Kuitun Funeral Parlour, and the aftermath of the accident was completed.

After the accident, the on-site personnel of Huabao Building Materials rescued the injured at the first time and dialed 120 emergency calls to send the injured to the hospital. After evaluation, the emergency disposal work was effective and orderly, no secondary accidents occurred in the rescue process, no social instability incidents were caused, and the emergency disposal work was timely and effective.

4. Suggestions

His actions are suspected of violating the provisions of Article 233 of the Criminal Law of the People's Republic of China, and it is suggested that the judicial organs investigate his criminal responsibility according to law.

on administrative penalties for those responsible for the accident 2. As the main responsible person for Huabao Building Materials, he has not conscientiously fulfilled his duty of safety in production, has not organized the formulation and implementation of safety in production rules and regulations and operating rules of his unit, has not organized the formulation and implementation of safety in production education and training plans, and has not organized the formulation and implementation of safety in production. Failure to effectively supervise and inspect the work of safety production on the spot, to eliminate the hidden dangers of production safety accidents in time, and to bear the main leadership responsibility for the occurrence of accidents. In violation of the provisions of Article 21 (2) (3) (5) of the Production Safety Law of the People's Republic of China, according to the provisions of Article 95 (1) of the Production Safety Law of the People's Republic of China, it is recommended to impose a fine of 40% of the annual income of the previous year, amounting to thirty-seven thousand eight hundred and thirty-seven yuan only (¥ 37837 yuan).

Failure to formulate and implement safety production rules and regulations and operating rules according to the actual situation of the enterprise, failure to organize employees to carry out "three-level" training and education, failure to supervise and inspect the safety production work of the unit, failure to eliminate the hidden dangers of production safety accidents in time, and bear the main leadership responsibility for the occurrence of accidents. In violation of the provisions of Article 21 (2) (3) (5) of the Production Safety Law of the People's Republic of China, according to the provisions of Article 95 (1) of the Production Safety Law of the People's Republic of China, it is suggested to impose a fine of 40% of the annual income of the previous year, totaling nineteen thousand eight hundred and twenty yuan only (¥ 19820 yuan).

Failure to formulate enterprise safety production rules and regulations, operating rules, organize employees to carry out safety production education and training, timely investigation and rectification of hidden dangers of production safety accidents, timely stop of employees'" three violations ", inadequate daily safety management of employees, and bear important leadership responsibility for accidents. In violation of the provisions of Article 25 (1) (2) (5) (6) of the Safety Production Law of the People's Republic of China, and in accordance with the provisions of Article 96 of the Safety Production Law of the People's Republic of China and Article 20 (1) of the Provisions on Fines and Penalties for Production Safety Accidents, it is suggested that 30% of the annual income of the previous year be imposed. In violation of the provisions of Articles 28, 36, 41 and 44 of the Safety Production Law of the People's Republic of China, according to the provisions of Article 114 (1) of the Safety Production Law of the People's Republic of China and Article 14 (2) of the Provisions on Fines and Penalties for Production Accidents. 5. The main lessons
of the accident (1) The lack of
enterprise safety management system is that the safety management personnel of Huabao Building Materials have not obtained the safety qualification certificate, the safety management ability is seriously inadequate, the knowledge and requirements of safety production are lack of basic knowledge, and the safety responsibilities of themselves are not clear. As a result, the safety management of enterprises is out of control. Secondly, the lack of safety production rules and regulations, the lack of core systems such as loader safety operation rules, safety risk analysis and judgment, and hidden danger investigation and management make the production operation lack of clear norms and emergency guidelines. Third, the emergency response system for accidents has not been established, the information transmission is not smooth after the accident, and the main responsible person of the enterprise has not timely reported the production safety accident to the local department responsible for the supervision and management of production safety.
(2) The intrinsic safety level of the enterprise is relatively low
. First, Huabao Building Materials has not organized three-level safety education and training, the safety awareness of the operators is weak, the forklift drivers lack the awareness of safe operation, the staff's own safety awareness is not strong, and they lack the basic awareness and coping ability of the operation risk. Secondly, Huabao Building Materials has not strictly checked the qualifications of the operators, and has not found the problem that the forklift driver's operation certificate is not valid, and the personnel qualification management is in a vacuum. Third, the equipment safety management is at a low level, the forklift reversing buzzer, left reversing mirror, reflective signs, license plates and other safety facilities have not been investigated and rectified, the forklift has not been regularly overhauled, and the equipment maintenance mechanism has failed.
(3) The supervision and inspection of the industry departments are not in place
. First, the competent industry departments fail to examine the safety qualification certificates of the principal responsible persons and safety management personnel of the enterprises, and fail to timely discover and urge the principal responsible persons and safety management personnel of the enterprises to take up their posts with certificates. Secondly, special safety inspections have not been carried out for construction machinery vehicles in key places such as commercial concrete stations, and risks such as poor reversing vision and lack of alarm devices during forklift operation have not been identified and controlled in advance. Thirdly, enterprises are not effectively urged to implement the main responsibility of safety production, neglect the outstanding problems in safety education and training, equipment safety management and system construction, and fail to go deep into the operation site of enterprises in daily supervision, which leads to the long-standing problems of lack of equipment safety facilities and undocumented operation of personnel.
6. Accident rectification and preventive measures
(1) Improve the safety management system and consolidate the main responsibility of enterprises for safety production.
Firstly, the principal responsible persons and safety production managers of enterprises are required to obtain corresponding safety qualification certificates within a time limit, strengthen the study of safety production laws and regulations and management knowledge, and enhance safety management ability. The second is to immediately formulate and improve the rules and regulations of safety operation rules, risk assessment and hidden danger investigation and management of construction machinery vehicles, clarify the safety responsibilities and operation procedures of each post, and ensure that production and operation activities have rules to follow. Thirdly, we should improve the emergency management and accident reporting mechanism, formulate scientific and reasonable emergency rescue plans for production safety accidents, organize regular emergency drills, test the feasibility and effectiveness of the plans, and improve the ability of enterprises to deal with unexpected accidents.
(2) Strengthen safety management and improve the level of operation safety.
Firstly, enterprises should carry out three-level safety education and training in an all-round way, establish and improve training files, ensure that all employees are familiar with the safety operation rules of their posts, understand the safety risks of on-site operations, and master safety prevention skills and emergency disposal methods. The second is to strictly implement the certification system for special operators, immediately check the qualifications of forklift drivers and other special operators, strictly prohibit undocumented personnel from working, and strengthen the daily safety assessment and management of operators. The third is to establish a regular overhaul and maintenance system for equipment, formulate a detailed overhaul plan, clarify the contents and cycle of overhaul, carry out a comprehensive safety inspection of all production equipment, focusing on the safety facilities of special equipment such as forklifts, and timely repair or replace the missing parts such as reversing buzzers, reversing mirrors and reflective signs, so as to ensure that the equipment is always in safe operation.
(3) Strengthen daily safety inspection and implement the supervision responsibility of industry departments.
Firstly, we should strengthen the inspection of the qualifications of personnel in key positions in enterprises, regularly check the holding of safety qualification certificates of the principal responsible persons and safety management personnel in enterprises, and seriously investigate and punish the acts of taking up posts without certificates according to law. Secondly, we should further strengthen the supervision and inspection of the implementation of the main responsibility of enterprise safety production, adopt "four not two straight" and other ways to go deep into the production site of enterprises, focus on the inspection of enterprise safety education and training, equipment safety management, system implementation and other problems, establish a hidden danger investigation and management account, implement closed-loop management, and ensure that hidden dangers are rectified in time. Thirdly, we should strengthen the publicity and education of production safety, widely publicize laws, regulations and knowledge of production safety by organizing training courses, distributing publicity materials and conducting emergency drills, so as to improve the safety awareness and legal concept of enterprises and employees.
(4) It is suggested that special renovation and risk provention and control of construction machinery vehicles be carried out throughout the county. In view of the construction machinery vehicles in key places such as commercial concrete stations and construction sites, special rectification actions were carried out to comprehensively investigate the potential safety hazards of construction machinery vehicles, focusing on the problems of lack of safety facilities, unlicensed operation of personnel and illegal operation, and severely cracking down on all kinds of illegal and irregular acts.
