Recently, the Ministry of Ecology and Environment and other five departments revised and issued the National Hazardous Waste List (2025 edition) (hereinafter referred to as the List). This revision mainly focuses on the classification management of hazardous wastes after identification, accurate identification of hazardous wastes, and exemption management of hazardous wastes.
National Catalogue of Hazardous Wastes (2025)
Article 1 This Catalogue is formulated in accordance with the relevant provisions of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes. Article
2 Solid wastes (including liquid wastes) under any of the following circumstances shall be included in this List:
(1) having one or more hazardous characteristics of toxicity, corrosiveness, flammability, reactivity or infectivity;
(2) It is not excluded that it has hazardous characteristics, may cause harmful effects on the ecological environment or human health, and needs to be managed according to hazardous waste. Article
3 The hazardous wastes listed in the List of Exempt Management of Hazardous Wastes in the appendix of this List may be exempted from management in accordance with the provisions of the exemption contents when the listed exemption links meet the corresponding exemption conditions.
Article 4 The determination of the attributes of solid wastes after the mixing of hazardous wastes with other substances and the solid wastes after the utilization and disposal of hazardous wastes shall be carried out in accordance with the identification standards for hazardous wastes prescribed by the State. 5 The definitions of relevant terms in this Catalogue are as follows:
(1) Waste category refers to the classification of hazardous wastes on the basis of the categories defined in the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal and in combination with the actual situation of China.
(2) The term "industry source" refers to the industry that produces hazardous waste.
(3) Waste code refers to the unique code of hazardous waste, which is 8 digits. Among them, the first to third digits are the codes of hazardous waste generating industries (determined according to the Classification of National Economic Industries (GB/T 4754-2017)), the fourth to sixth digits are the sequence codes of hazardous wastes, and the seventh to eighth digits are the category codes of hazardous wastes.
(IV) Hazard characteristic, It refers to Toxicity (T), Corrosivity (C), Ignitability (I), Reactivity (R) and Infectivity (In) that have harmful effects on the ecological environment and human health.
Article 6 Solid wastes for which it is not clear whether they have hazardous characteristics shall be identified in accordance with the identification standards and methods for hazardous wastes prescribed by the State. Those
identified as having hazardous characteristics belong to hazardous wastes and shall be classified according to their main harmful components and hazardous characteristics in comparison with the existing waste codes in this list; If it is impossible to classify according to the existing waste code, the waste category to which it belongs shall be determined and classified and managed according to the code "900-000- × ×" (× × is the category code of hazardous waste). If it is
identified that it does not have hazardous characteristics, it is not a hazardous waste. Article
7 This directory shall be adjusted dynamically according to the actual situation. Article
8 This List shall come into force as of January 1, 2025. The National List of Hazardous Wastes (2021 Edition) (Decree No.15 of the Ministry of Ecology and Environment, the National Development and Reform Commission, the Ministry of Public Security, the Ministry of Transport and the National Health Commission) shall be abolished at the same time.
