Recently, the General Office of the Shanxi Provincial People's Government issued the Measures for Curbing underreport and Production Safety Accidents in Mining Enterprises in Shanxi Province, requiring mining enterprises to report accidents in a timely, accurate and complete manner in accordance with the law and regulations, and no unit or individual shall underreport. Units and individuals who have been verified to have participated in or cooperated with underreport accidents in mining enterprises shall be dealt with by relevant departments in accordance with the law and regulations. Any unit or individual has the right to report underreport accidents to the mine safety supervision and supervision department. The informant shall objectively and truthfully reflect the specific circumstances of the underreport accident (including the name of the enterprise, the time and place of the accident, the number of deaths, the identity information and contact information of the deceased, etc.), and shall be responsible for the authenticity of the content of the report. After receiving the information of underreport accidents reported by mining enterprises, the mine safety supervision and supervision department shall promptly hand over or submit it it to the people's government at or above the county level directly responsible for safety supervision for organization and verification. Reports of suspected underreport accidents that
have been accepted shall be handled by the local people's governments at or above the county level directly responsible for safety supervision in accordance with the following provisions: For real-name reports, immediate verification shall be organized. If an anonymous report meets the basic conditions for verification and has the name, time, place, number of deaths, identity information and contact information of the accident unit, the verification shall be organized immediately. For those who report through the Internet, newspapers and other news media, they should contact the informants through the reporting channels in time, verify the specific contents and organize the verification immediately. If the reported matters are verified to be true, the informants shall be rewarded in accordance with the relevant provisions of the Detailed Rules for the Implementation of Rewards for Reporting Safety Production in Mines (Trial Implementation). If the reported matters are not true after verification, they shall be clarified in an appropriate way within a certain range, and the legitimate rights and interests of the informants shall be protected according to law. Underreport accidents of mining enterprises
that have been verified to be true shall be handled by the relevant units according to law: the mining enterprises involved and their legal representatives, principal responsible persons, actual controllers and other relevant personnel shall be included in the joint punishment targets for dishonesty in the field of safety production, and coal mine underreport accidents shall be executed by the mine safety supervision organization. Underreport accidents in non-coal mines shall be carried out by local safety supervision departments. A fine of not less than 1 million yuan but not more than 5 million yuan shall be imposed on the mining enterprise in which the accident occurred; a fine of 60% to 100% of the annual income of the previous year shall be imposed on the principal responsible person, the directly responsible person in charge, and other directly responsible persons. The coal mine underreport accident shall be punished by the mine safety supervision organization, and the non-coal mine underreport accident shall be punished by the local safety supervision department. If the act constitutes a violation of public security administration, the public security organ shall impose a public security administration penalty according to law; if the act constitutes a crime, the offender shall be investigated for criminal responsibility according to law, and he shall not be the principal person in charge of any production and business operation entity within five years from the date of the completion of the execution of the penalty or the punishment; Those who are responsible for major or especially major production safety accidents shall not be the principal person in charge of the production and operation units in the industry for life. Those who are responsible for underreport accidents belong to state functionaries shall be dealt with by relevant departments in accordance with the law and regulations.
