The Opinion points out that enterprises should adhere to voluntary declaration of performance classification according to the actual situation, adhere to fairness and openness, open the whole process of performance classification management, accept social supervision, and encourage the participation of industry associations and technical institutions; We will adhere to differentiated management, implement differentiated incentive and regulatory policies based on performance classification, and stimulate the internal motivation of enterprises to improve their performance level. According to the advanced level of performance indicators, the performance is divided into "A/B/C/D" in principle. A means that all indicators have reached the advanced level of the industry, B means that the relevant indicators have reached the good level of the industry, C means that the relevant indicators have reached the medium level of the industry, and D means that the relevant indicators meet the basic requirements of laws, regulations and relevant standards. For some simple industries such as equipment, technology and governance, the performance is divided into "A/B/C level", which means that the relevant indicators meet the basic requirements of laws, regulations and relevant standards. The performance rating is based on the "short board principle", and the lowest level of each index is used to determine the performance rating of the enterprise; when the enterprise is involved in multiple key industries, the rating is based on the industry, and the lowest level of the industry involved is used as the overall performance rating of the enterprise.
In order to encourage enterprises to innovate continuously and play a leading role, the Ministry of Ecology and Environment selects A-level enterprises for A-level enterprises. A + enterprises refer to the internationally leading innovative and breakthrough equipment or technology that can operate continuously and stably for more than two years, which has remarkable effect on pollution reduction and carbon reduction, and is obviously more advanced than other A-level enterprises in the same industry. In order to vigorously promote the construction of beautiful blue sky and further strengthen and standardize the management of atmospheric environmental performance classification (hereinafter referred to as performance classification) in key industries, these Guiding Opinions are formulated.
First,
under the guidance of Xi Jinping's thought of ecological civilization, we should thoroughly implement the spirit of the 20th and 20th Plenary sessions of the CPC, fully, accurately and comprehensively implement the new development concept, and implement the deployment requirements of the National Conference on Eco-environmental Protection. Establish and improve the performance classification management mechanism implemented by the state as a whole, provincial organizations and municipalities, and improve the "1 + 1 + 1 + N" performance classification management system, namely, a guiding opinion, a management platform, a general technical principles and technical guidelines for N key industries, strictly carry out performance classification, vigorously promote differentiated management, encourage the advanced and spur the backward. 2. Improve the technology and management system
(1) Scientifically divide the performance level
according to the advanced level of performance indicators, in principle, the performance is divided into "A/B/C/D level", a level means that all indicators have reached the advanced level of the industry. Grade B means that the relevant indicators reach the good level of the industry, Grade C means that the relevant indicators reach the medium level of the industry, and Grade D means that the relevant indicators meet the basic requirements of laws, regulations and relevant standards. (2) Optimize technical indicators
according to the principle of full coverage of source, process and end management, and rationally set up performance grading indicators to promote green development of enterprises. It mainly includes equipment level, technology level, clean energy level, pollution control technology, air pollutant emission level (emission limit), unorganized emission control level, monitoring level, environmental management level, transportation mode, transportation management level, etc.
(3) To improve the technical documents
, the Ministry of Ecology and Environment will further formulate and revise the technical documents of performance grading, including the general principles of performance grading technology and technical guidelines for key industries. Among them, the general technical principles mainly specify the overall technical requirements for performance classification, and the technical guidelines for key industries stipulate the performance classification indicators and their verification methods for various industries. The ecological environment department at the provincial level may, according to the characteristics of local industrial pollution, the governance level of relevant industries, the management capacity and other specific conditions, formulate local performance grading indicators that are stricter than those of the state for the industries for which the state has formulated performance grading indicators, and formulate local performance grading indicators for the industries for which the state has not formulated performance grading indicators. The technical documents of performance grading indicators formulated by provincial ecological environment departments shall be submitted to the Ministry of Ecology and Environment for the record.
(4) Optimizing the management mechanism
, the Ministry of Ecology and Environment coordinates and guides the national performance classification work, and constantly improves the management and technical system. The ecological environment department at the provincial level is responsible for organizing and carrying out the performance classification in the administrative region, and assessing the enterprises at A and B levels; on the basis of consensus, the relevant departments at the provincial level can strengthen the division of labor and cooperation, and jointly promote the performance classification. The ecological environment departments at the municipal level with districts and at the county level directly under the provincial administration shall carry out the grading work, organize the declaration of enterprises in their respective administrative regions, carry out the preliminary examination of A-level and B-level enterprises, and evaluate the enterprises at or below C-level. To implement dynamic management of performance grading, enterprises can declare or apply for change of performance grading according to their needs, and relevant departments can update the performance grading of enterprises in time according to the evaluation results.
(5) To build a unified work platform
for the Ministry of Ecology and Environment to build a unified national performance grading work platform (hereinafter referred to as the work platform), which integrates the functions of enterprise declaration, audit and evaluation, publicity of the results of rating and downgrading, and inquiry of performance grades, and is open to enterprises, ecological environment departments at all levels and the public. Realize "one-stop" management service.
3. Strengthen follow-up supervision
(6) Establish and improve the regular evaluation and review mechanism
. The Ministry of Ecology and Environment carries out performance classification management and regular evaluation of technical system, and updates management policies and technical documents in a timely manner. On the basis of research, demonstration and pilot projects, ecological environment departments and trade associations at all levels can recommend innovative technologies. After evaluation, the advanced and applicable technologies can be included in the performance grading index according to the procedure. The ecological environment department at the provincial level shall conduct regular review of the A-level enterprises in the administrative region, at least once every five years from the date of assessment, and determine the frequency of review of the B-level and below enterprises according to the actual situation. The review contents include the conformity of performance grading indicators and the overall performance in the review cycle.
(7) To strengthen the daily supervision
, the ecological environment departments at all levels should strengthen the tracking management of the rated enterprises and establish and improve the spot check mechanism for the advanced enterprises with performance grades. The Ministry of Ecology and Environment focuses on spot checks for A-level and above enterprises, and the provincial and municipal ecological environment departments focus on spot checks for A-level and B-level enterprises, and reasonably determine the proportion and frequency of spot checks according to the actual work.
(8) To strengthen the work of social supervision
and performance grading, social supervision should be fully accepted, and any unit or individual can inquire about the information of enterprise performance grading through the working platform. If it is found that the actual situation of the rated enterprise does not meet the requirements of the corresponding performance grading indicators, it may report to the corresponding performance grading department or its superior department. The ecological environment departments at all levels shall verify the reported information in a timely manner and keep it strictly confidential.
(9) To improve the management
of demotion, if it is found in the periodic review, daily supervision and verification of reports that enterprises do not meet the requirements of performance grading indicators or that there are malicious environmental violations in the prevention and control of air pollution, which are subject to administrative penalties and cause serious consequences, the administrative penalty shall be imposed on the enterprises. The performance rating department shall require rectification or demotion according to the severity of the circumstances. If the downgrade is made, the downgrade situation should be made public to the public through the working platform in time.
4. Implementing differentiated management
(10) Strengthening differentiated management
of environmental protection During the period of emergency response to heavily polluted weather, enterprises should implement differentiated management and control based on performance level. Enterprises at level A and above can take emission reduction measures independently, while enterprises at level B can take less emergency emission reduction measures. Enterprises with low performance level shall strictly take emergency emission reduction measures in accordance with the law and regulations. Priority will be given to qualified advanced enterprises with performance levels to be included in the positive list of ecological environment supervision and law enforcement, and no on-site law enforcement inspection will be carried out except for the "physical examination" assistance specified in the clear clues to illegal problems or the positive list cycle. We will encourage enterprises with advanced performance levels to give priority to free trading of surplus emission rights in the market, and encourage local governments to give priority to repurchasing and storing them if it is difficult to transfer them. New, renovated and expanded projects conforming to laws and regulations in key areas of air pollution prevention and control and priority protection units of ecological environment shall be given priority to supporting projects whose performance can reach A-level. For performance upgrading projects (hereinafter referred to as upgrading projects) that do not add new land, mainly update equipment and do not increase pollutant emissions, we support speeding up the pre-approval procedures within the scope permitted by laws and policies to ensure the rapid landing of projects.
(11) Strengthen fiscal, financial and price policy support
, encourage local governments to introduce incentive policies, support upgrading projects or reward enterprises that have completed upgrading. Promote the investment and construction of public or special facilities such as charging piles for electric heavy trucks (power exchange stations) and hydrogen refueling stations for hydrogen heavy trucks related to the upgrading project. Explore the differentiated electricity price policy for key industries and enterprises based on performance level and energy consumption. Encourage the regulation of production capacity and output based on performance level, and the index of production capacity and output is inclined to the advanced enterprises of performance level. Financial institutions are encouraged to take corporate performance rating as an important reference factor in credit management, and implement differentiated incentives in terms of loan approval and quota calculation; financial products and service innovation are strengthened, and support for upgrading projects is increased. To implement the policy of environmental protection tax reduction and exemption, enterprises with advanced performance levels whose concentration of atmospheric pollutants is lower than national and local pollutant emission standards shall enjoy environmental protection tax reduction and exemption according to law. Promote green procurement of enterprises, and encourage priority procurement and use of products of enterprises with advanced performance levels.
5. Relevant requirements
(12) To strengthen the organization and implementation
of ecological environment departments at all levels, we should strengthen overall coordination, form joint efforts with development and reform, industry and telecommunications, finance, transportation, commerce, finance, taxation, energy and other departments, promote the implementation of differentiated policies based on performance classification, and promote the implementation of differentiated policies based on performance classification. The implementation of performance upgrading actions will significantly improve the performance grading structure of key industries, significantly increase the proportion of A-level enterprises, and accelerate the implementation of green low-carbon transformation.
(13) To strengthen the implementation of
responsibility, the ecological environment departments at all levels should conscientiously perform their management duties, strictly adhere to the performance grading standards, and ensure that the performance grading is effective. Those who neglect their duties and violate the relevant provisions of integrity and discipline in their work shall be held accountable in accordance with the law and regulations. Enterprises participating in performance grading should implement the main responsibility, ensure the authenticity, accuracy and completeness of the declaration materials, establish and improve the internal management mechanism, ensure long-term stability to meet the requirements of performance grading indicators, and consciously accept supervision without fraud.
(14) To do a good job in publicity and guidance
, ecological environment departments at all levels should give full play to the advantages of newspapers, radio, television, government websites, double micro and short videos, promote the concept of green and low carbon, and strengthen the promotion of experience. Comprehensive use of experience exchange, on-site observation, special training and other forms to actively guide and promote the development of performance grading. At the same time, we should pay close attention to public opinion and respond to social concerns in a timely manner. If the performance grading documents previously issued by the Ministry of
Ecology and Environment are inconsistent with this opinion, this opinion shall prevail.
