Effective January 1, 2027! The Regulations on Emergency Handling and Investigation of Electric Power Safety Accidents are promulgated!

These Regulations are formulated in order to strengthen the emergency handling of electric power safety accidents, standardize the investigation and handling of electric power safety accidents, control, mitigate and eliminate the damage caused by electric power safety accidents, and ensure the safe and stable operation of the power system and the reliable supply of electric power.

On September 4, the State Council of the People's Republic of China issued Decree No.845. The Regulations on Emergency Handling and Investigation of Electric Power Safety Accidents, which were revised and adopted at the 94th executive meeting of the State Council on August 21, 2026, are hereby promulgated and shall come into force as of January 1, 2027.

" Article 2 The term "electric power safety accidents" as mentioned in the present Regulation refers to It refers to the accidents occurring in the process of power production or power grid operation that affect the safe and stable operation of the power system or the normal supply of electricity. Article

3 According to the degree to which electric power safety accidents (hereinafter referred to as accidents) affect the safe and stable operation of power systems or the normal supply of electric power, accidents are divided into especially serious accidents, major accidents, major accidents and general accidents. The criteria for the classification of accidents shall be set out in the schedule to these Regulations. If some items of the accident classification standards need to be adjusted, the competent energy department under the State Council shall put forward a plan and submit it it to the State Council for approval. In areas where power is supplied

by a single transmission line or substation, the criteria for classifying accidents resulting in load reduction of power grid or power outage of power supply users due to the failure of a single transmission line or substation shall be formulated separately by the competent energy department of the State Council and submitted to the State Council for approval. Article

4 The competent department of energy under the State Council shall strengthen the supervision and management of electric power safety, establish and improve various systems for emergency handling and investigation of accidents according to law, and organize or participate in the investigation and handling of accidents. The competent department of

energy under the State Council and other relevant departments under the State Council, local people's governments and their relevant departments shall organize, coordinate and participate in the emergency handling of accidents in accordance with the limits of authority and procedures prescribed by the State. Article

5 Electric power enterprises, power users and other subjects connected to the power grid (hereinafter referred to as other subjects connected to the grid) shall abide by the regulations on electric power safety management, obey unified dispatch, strictly implement relevant standards and technical spec ifications, implement accident preventive measure in the planning, construction and operation of the power system, and strengthen accident prevention. Prevent and avoid accidents.

Power dispatching agencies shall carry out power grid operation control in strict accordance with relevant laws, administrative regulations and the provisions of the competent energy department under the State Council. Important power users designated by the relevant departments of the local people's governments at or above the

county level shall, in accordance with the regulations of the competent energy department under the State Council, allocate their own emergency power sources and strengthen the management of safe use. Article

6 After an accident occurs, the relevant units and individuals shall report the accident in a timely and accurate manner in accordance with the provisions, carry out emergency disposal work, prevent the expansion of the accident and mitigate the damage caused by the accident. Power enterprises and other grid-connected entities shall resume power production, power grid operation and normal power supply as soon as possible.

The relevant people's governments and their relevant departments shall provide necessary support and guarantee for the emergency handling of accidents. Article

7 No unit or individual may obstruct or interfere with the reporting, emergency handling and investigation and handling of accidents according to law. Chapter

II Accident Report

Article 8 After an accident occurs, the relevant personnel at the scene of the accident shall immediately report to the on-duty personnel of the power plant, substation (converter) station, the on-duty personnel of the power dispatching organization or the on-site person in charge of the unit. Upon receipt of the report, the relevant personnel shall immediately report to the power dispatching institution at the next higher level and the person in charge of the unit. After receiving the report, the person in charge of the unit shall immediately report to the local dispatched office of the competent energy department under the State Council (hereinafter referred to as the dispatched energy regulatory agency) and the emergency management department of the people's government at or above the county level. If the accident of a thermal power plant affects the normal supply of heat, it shall also be reported to the heat supply management department; if the accident involves the dam safety of a hydropower plant (station), it shall also be reported to the competent water administration department or river basin management agency. Power dispatching agencies at or above the

provincial, autonomous regional and municipal levels shall immediately report to the competent energy department under the State Council or the dispatched energy regulatory agencies for accidents occurring within the scope of dispatching jurisdiction. The unit where the

accident occurred, the power dispatching institution and its relevant personnel shall not delay the report or underreport or make a false report on the accident. Article

9 After receiving the accident report, the dispatched energy regulatory agency shall immediately verify the relevant situation and report to the competent department of energy under the State Council; if the accident causes a power outage to the power supply users, it shall also notify the local people's government at or above the county level where the accident occurs.

For particularly serious accidents and major accidents, the competent energy department under the State Council shall immediately report to the State Council after receiving the accident report, and notify the emergency management department under the State Council and other relevant departments. The

tenth accident report shall include the following contents:

(1) the time, place (area) of the accident, the unit where the accident occurred and the brief course of the accident;

(2) The known damage of power equipment and facilities, the number of power generation equipment out of service, the value of power grid load reduction or power generation equipment output reduction, and the scope of power outage;

(3) The preliminary judgment of the cause of the accident; Measures taken after the occurrence of the

accident, the operation mode of the power grid, the operation status of the power generating equipment, and the control of the accident;

and Other situations that shall be reported.

The accident report can first report the known situation, and then report the details. If a new situation occurs after the accident report, it shall make up the report in time. Article

11 After an accident occurs, relevant units and personnel shall properly protect the scene of the accident and relevant materials such as work logs, work tickets and operation tickets, and timely preserve relevant information such as fault recording maps, power dispatching data, operation data of power generation equipment and operation data of power transmission and transformation equipment, so as to ensure the safety of the accident. After the establishment of the accident investigation team, the relevant materials and information shall be handed over to the accident investigation team. If it is necessary to change the scene of an accident or move power equipment

due to emergency measures such as rescuing personnel or restoring power production, power grid operation and power supply, it shall mark and draw a sketch of the scene, properly preserve important traces and material evidence, and make a written record.

No unit or individual may intentionally destroy the scene of the accident or forge, conceal or destroy relevant evidence. Chapter

III Emergency Disposal

of Accidents Article 12 Electric power enterprises shall, in accordance with the relevant provisions of the State, formulate their own emergency rescue plans for accidents and organize regular drills. Emergency rescue plans for accidents shall be submitted to the dispatched energy regulatory agencies for the record and copied to the emergency management departments of the local people's governments at or above the county level. The competent department of

energy under the State Council and the dispatched energy regulatory agencies shall guide power enterprises to strengthen the construction of emergency rescue system for accidents and ensure the input of materials and equipment. Article

13 After an accident occurs, the relevant power enterprises, power users and other grid-connected entities shall immediately take corresponding emergency measures to control the scope of the accident and prevent the systematic collapse and collapse of the power grid; If an accident endangers the safety of people and equipment, the relevant operating personnel on duty may immediately take emergency measures such as shutting down power generation equipment and power transmission and transformation equipment in accordance with relevant regulations. If the

accident causes damage to power equipment and facilities, the relevant power enterprises and other grid-connected entities shall immediately organize emergency repairs. Article

14 According to the specific circumstances of the accident, the power dispatching organization may issue power dispatching orders such as opening or shutting down power generation equipment, adjusting the active and reactive power output of power generation equipment, adjusting the operation mode of the power grid, and adjusting the dispatching plan, which shall be implemented by power enterprises, power users and other grid-connected entities. If the

accident may cause damage to the stability of the power system and large-scale blackouts of the power grid, the power dispatching organization shall have the right to decide to take necessary measures such as load limitation, disconnection of the power grid and disconnection of power generation equipment. If

an accident causes all the power systems in a certain area to stop operation, the power dispatching organization shall immediately determine the plan for restoring power supply, and if necessary, start the power generation equipment with independent start-up and isolated network operation capabilities in the system, or dispatch external power sources to restore the operation of the power system as soon as possible. Article

15 To restore power grid operation and power supply, priority shall be given to ensuring the restoration of auxiliary power sources, important transmission and transformation equipment and main power grids of important power plants, and to restoring power supply to important power users, important cities and key areas. Article

16 The competent department of energy under the State Council shall, in accordance with the Emergency Response Law of the People's Republic of China and the General contingency plan for National Emergencies, organize the preparation of a national contingency plan for large-scale blackouts and submit it it to the State Council for approval.

Local people's governments shall organize the formulation of contingency plan for large-scale blackouts in their respective administrative areas in accordance with laws, administrative regulations and national contingency plan for large-scale blackouts.The contingency plan of

large-scale blackouts shall make specific provisions on the emergency organization and command system and responsibilities, various measures for emergency disposal, and emergency support such as personnel, funds, materials, technology and communications. Article

17 Where an accident causes a large-scale blackout, the competent energy department under the State Council and other relevant departments under the State Council, the relevant local people's governments and their relevant departments, power enterprises and other grid-connected entities shall, in accordance with the provisions of the contingency plan for large-scale blackouts, initiate an emergency response, establish an emergency command organ and establish an emergency command organ. Power grid operation and power supply should be restored as soon as possible to prevent the occurrence of various secondary disasters. Article

18 If an accident causes a large-scale blackout, the local people's government and relevant departments shall immediately organize the following emergency response work:

(1) Strengthen the security of key units related to the national economy and people's livelihood, national security and public security in the blackout area, prevent acts that undermine social order and maintain social stability;

(2) Timely eliminate all kinds of dangerous situations caused by power failure;

(3) If the accident causes heavy casualties or requires emergency transfer or resettlement of trapped persons, timely organize and implement rescue, transfer and resettlement work;

(4) Strengthen the command and guidance of road traffic in blackout areas, and do a good job in railway, civil aviation transportation and communication support;

(5) Organize the emergency production and transfer of emergency materials to ensure the supply of materials needed for the restoration of power grid operation and the basic means of livelihood of residents. Article

19 If an accident causes the interruption of power supply to an important power user, the important power user shall promptly start the emergency power supply for itself in accordance with the relevant technical requirements; if it is ineffective to start the emergency power supply for itself, the power grid enterprise shall provide the necessary support and guarantee. If

an accident causes a power outage in places where people gather, such as subways, airports, high-rise buildings, shopping malls, cinemas and stadiums, emergency lighting shall be promptly used to organize orderly evacuation of personnel. Article

20 The emergency command organ, the competent energy department under the State Council or the dispatched energy regulatory agency shall, in accordance with the relevant provisions, uniformly, accurately and timely release information on the scope of the impact of the accident, the progress of the disposal work and the expected time for the restoration of power supply. Chapter

IV Investigation and Handling

of Accidents Article 21 The State Council or the department authorized by the State Council shall organize an accident investigation team to investigate a particularly serious accident.

Major accidents shall be investigated by an accident investigation team organized by the competent department of energy under the State Council.

Major accidents and general accidents shall be investigated by the accident investigation team organized by the dispatched energy regulatory agency. If the competent department of energy under the State Council deems it necessary, it may organize an accident investigation team to investigate a major accident. For general accidents that

do not cause power outages to power supply users, the dispatched energy regulatory agencies may also entrust the accident-occurring units to investigate and deal with them. Article

22 According to the specific circumstances of the accident, the accident investigation team shall be composed of people from the relevant people's governments, their energy and emergency management departments, other departments responsible for the supervision and management of production safety, and fire rescue agencies, and shall invite public security organs, people's procuratorates and other units to send people to participate. The accident investigation team shall promptly inform the supervisory organ of the accident and invite the supervisory organ to intervene in the accident investigation.

According to the needs of accident investigation, the accident investigation team may employ relevant experts to assist in the investigation. The head of the

accident investigation team shall be designated by the organ that organizes the accident investigation team. Article

23 An accident investigation team shall carry out an accident investigation in accordance with the relevant provisions of the State, and submit an accident investigation report to the organ organizing the accident investigation team within the following time limits:

(1) The time limit for the investigation of a particularly serious accident or a major accident is 60 days; Under special circumstances, it may be extended appropriately with the approval of the organ organizing the accident investigation team, but the extension period shall not exceed 60 days.

(2) The investigation period for major accidents and ordinary accidents shall be 45 days; under special circumstances, it may be extended appropriately with the approval of the organ organizing the accident investigation team, but the extended period shall not exceed 45 days. The time limit for

accident investigation shall be calculated from the date of the accident. Article

24 An accident investigation report shall include the following contents:

(1) The basic information of the unit involved in the accident and the process of accident occurrence and handling;

(2) The direct economic losses caused by the accident and the impact of the accident on the operation of the power grid and the normal supply of electricity;

(3) The cause and nature of the accident;

(4) The emergency handling of the accident and the restoration of power production and the operation of power grids;

(5) determination of responsibility for the accident, suggestions on the handling of the unit responsible for the accident, a suggested list of public officials who should be held accountable, and suggestions on the handling of other responsible persons;

and (6) measures for accident prevention and rectification. The

accident investigation report shall be attached with relevant evidence materials and technical analysis reports. The members of the accident investigation team shall sign the accident investigation report. Article

25 When the accident investigation report is submitted to the organ that organizes the accident investigation team for approval, the accident investigation work shall be completed. For a general accident entrusted to the accident occurrence unit for investigation, the accident investigation report shall be submitted to the dispatched energy regulatory authority for approval. The accident investigation report shall be released to the public in a timely manner according to law.

The relevant organs shall punish the units responsible for the accident and the persons responsible for the accident according to law, and impose sanctions on the public officials responsible for the accident. The unit responsible for the

accident shall deal with the personnel responsible for the accident in the unit and report the results to the organ organizing the accident investigation team in time. Article

26 Units responsible for accidents and relevant personnel shall earnestly draw lessons from accidents, implement accident prevention and rectification measures, and prevent accidents from happening again. The competent energy department

under the State Council or the dispatched energy regulatory agency shall, within one year after the approval of the accident investigation report, organize an assessment of the implementation of the accident prevention and rectification measures, and make the assessment results public to the public in a timely manner. Chapter

V Legal Liability

Article 27 If the principal responsible person of the unit where an accident occurs commits any of the following acts, the competent department of energy under the State Council or the dispatched energy regulatory agency shall impose a fine of 60% to 100% of his annual income in the previous year; if he is a public official, he shall be punished according to law; If a crime is constituted, criminal liability shall be investigated according to law:

(1) failing to immediately organize the handling of the accident;

(2) delaying the reporting of the accident;

or (3) leaving his post without permission during the investigation and handling of the accident. Article

28 If an accident-occurring unit and its relevant personnel commit any of the following acts, the competent energy department under the State Council or the dispatched energy regulatory agency shall impose a fine of not less than 1 million yuan but not more than 5 million yuan on the accident-occurring unit; A fine of 60% to 100% of the annual income of the previous year shall be imposed on the principal responsible person, the directly responsible person in charge and other directly responsible persons, and if they are public officials, they shall be punished according to law; if they constitute a violation of public security administration, they shall be punished by the public security organ according to law; If a crime is constituted, criminal liability shall be investigated according to law:

(1) making a false report or underreport of an accident;

(2) forging or intentionally destroying the scene of an accident;

(3) transferring or concealing funds or property, or destroying relevant evidence or materials;

(4) Refusing to be investigated or refusing to provide relevant information and materials;

(5) Giving false testimony or instigating others to give false testimony during the investigation of an accident;

or (6) Going into hiding after an accident.Article

29 The competent department of energy under the State Council or the dispatched energy regulatory agency shall impose a fine on the unit responsible for the accident in accordance with the following provisions:

(1) If a general accident occurs, a fine of not less than 300,000 yuan but not more than 1 million yuan shall be imposed;

(2) If a major accident occurs, a fine of not less than 1 million yuan but not more than 2 million yuan shall be imposed;

(3) If a major accident occurs, a fine of not less than 2 million yuan but not more than 10 million yuan shall be imposed;

(4) If a particularly serious accident occurs, a fine of not less than 10 million yuan but not more than 20 million yuan shall be imposed. If the circumstances of the

accident are particularly serious and the impact is particularly bad, the competent energy department under the State Council or the dispatched energy regulatory agency may impose a fine on the unit responsible for the accident in accordance with the amount of the fine mentioned in the preceding paragraph, which shall be not less than two times but not more than five times. Article

30 If the principal responsible person of the unit responsible for an accident fails to perform his duties of safe production management according to law, resulting in an accident, the competent energy department under the State Council or the dispatched energy regulatory agency shall impose a fine in accordance with the following provisions; if he is a public official, he shall be punished according to law; If a crime is constituted, criminal liability shall be investigated according to law:

(1) if an ordinary accident occurs, a fine of 40% of the annual income of the previous year shall be imposed;

(2) if a major accident occurs, a fine of 60% of the annual income of the previous year shall be imposed;

(3) If a major accident occurs, a fine of 80% of the annual income of the previous year shall be imposed;

(4) If a particularly serious accident occurs, a fine of 100% of the annual income of the previous year shall be imposed. If other persons in charge of the unit responsible for the

accident and the safety production management personnel fail to perform their duties of safety production management according to law, resulting in an accident, the competent energy department under the State Council or the dispatched energy regulatory agency shall impose a fine of 20% to 50% of their annual income in the previous year. Article

31 If the principal person in charge of the unit where the accident occurred is subject to dismissal or more sanctions or criminal penalties in accordance with the provisions of these Regulations, he shall not be the principal person in charge of any production and business operation unit within five years from the date of the sanction or the date of the completion of the execution of the penalty. Article

32 If the competent energy department under the State Council or the dispatched energy regulatory agency, the relevant local people's government and other departments responsible for the supervision and administration of production safety commit any of the following acts, the responsible leaders and the persons directly responsible shall be punished according to law; The leading persons who are held responsible and the persons who are directly responsible constitute a crime, and shall be investigated for criminal responsibility according to law:

(1) failing to organize the handling of the accident immediately;

(2) delaying the reporting of the accident or making a underreport or making a false report of the accident;

(3) obstructing or interfering in the investigation of the accident;

(Four) committing perjury or instigating others to commit perjury in the investigation of accidents. Article

33 If a power dispatching institution commits any of the following acts, the responsible leaders and the persons directly responsible shall be punished according to law; if the responsible leaders and the persons directly responsible constitute a crime, they shall be investigated for criminal responsibility according to law:

(1) Failing to handle the accident in time, thus causing the accident to expand;

(2) Failing to take timely measures to restore power supply;

(3) Delaying reporting, underreport or making a false report of the accident;

(4) Failing to cooperate with the investigation of the accident, refusing to provide relevant information and materials, giving false evidence or instigating others to give false evidence, and destroying relevant evidence and materials. Article

34 Any person participating in the investigation of an accident who commits any of the following acts shall be punished according to law; if a crime is constituted, he shall be investigated for criminal responsibility according to law:

(1) not being responsible for the investigation of the accident, resulting in major omissions in the investigation of the accident;

(Two) shielding or protecting the person responsible for the accident or taking the opportunity to retaliate. Chapter

VI Supplementary Provisions

Article 35 Where an accident specified in these Regulations occurs and causes casualties or direct economic losses at the same time, the accident level determined in accordance with these Regulations is different from that determined in accordance with the Regulations on the Reporting and Investigation of Production Safety Accidents. If the accident level is higher, the accident shall be investigated and handled in accordance with the provisions of these Regulations; if the accident causes casualties and constitutes a major accident or a particularly major accident as stipulated in the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents, the accident shall be investigated and handled in accordance with the provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents. If an accident occurs in the course of

power production or power grid operation that damages power generation equipment or transmission and transformation equipment and causes direct economic losses, it does not affect the safe and stable operation of the power system and the normal supply of power. The competent department of energy under the State Council or the dispatched energy regulatory agency shall, in accordance with the provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents, form an accident investigation team to investigate and handle major accidents, major accidents and general accidents. Article

36 Where there are no provisions on accident reporting and investigation and handling in these Regulations, the provisions of relevant laws and administrative regulations such as the Regulations on the Reporting and Investigation and Handling of Production Safety Accidents shall apply. Article

37 The emergency handling and investigation of nuclear accidents in nuclear power plants shall be carried out in accordance with the Regulations on Emergency Management of Nuclear Accidents in Nuclear Power Plants. Article

38 These Regulations shall come into force as of January 1, 2027.
