Ecological environmental protection and safe production are related to the safety of people's lives and property, and strict standards and requirements must be adhered to. In recent years, laws and regulations in the field of ecological environment protection and safety in production have been constantly improved, and ecological environment departments and emergency management departments in various regions have insisted on performing their duties in accordance with the law, providing a strong guarantee for high-quality economic and social development. At the same time, in the special action of standardizing the administrative law enforcement of enterprises involved, some enterprises reflect that the law enforcement personnel of some grass-roots ecological environment departments and emergency management departments have different requirements for "opening or closing windows in factories" in the law enforcement supervision of enterprises. To this end, the Ministry of Justice, the Ministry of Ecological Environment and the Ministry of Emergency Management jointly investigated and studied, and formed the following opinions.
1. Accurately understand and apply statutory regulatory requirements. From the perspective of ecological environment protection, for workplaces involving pollutant discharge, exhaust funnels and vents shall be set up in accordance with regulations while taking measures to close or seal and collect and treat pollutants; if it is impossible to close or seal, measures such as cleaning raw materials and local collection and treatment of waste gas can be taken, and law enforcement personnel shall not simply require enterprises to "close windows". From the point of view of safety production, for closed or closed workplaces, when the discharge of dangerous substances exceeds the safety threshold, ventilation measures such as fan interlocking should be taken, and law enforcement officers should not simply require enterprises to "open windows". Ecological environment departments and emergency management departments in different regions should further clarify the specific meaning of law enforcement standards, strengthen the training of law enforcement personnel, guide law enforcement personnel to accurately grasp law enforcement requirements and avoid mechanical law enforcement according to the characteristics of enterprises in different industries.
2. Establish and improve the joint law enforcement mechanism. Ecological environment departments and emergency management departments in all regions shall strictly implement the requirements of the Notice of the Ministry of Emergency Management of the Ministry of Ecology and Environment of the Office of the Security Committee of the State Council on Further Strengthening the Work Safety of Environmental Protection Equipment and Facilities, establish and improve the coordination and linkage mechanism, jointly formulate inspection plans and carry out joint law enforcement. Coordinated governance should be strengthened, and timely consultation should be conducted to solve the inconsistency of regulatory requirements.
3. Strengthen guidance services for enterprises. Ecological environment departments and emergency management departments in all regions should coordinate the relationship between production and operation, safety production and ecological environment protection, further enhance service awareness, guide and urge enterprises to strictly implement relevant laws, regulations and standards, standardize the installation and use of relevant facilities, take into account environmental protection and safety requirements, and timely help enterprises to solve existing difficulties and problems. Judicial administrative departments in all regions should strengthen overall coordination, urge relevant departments to do a good job in implementing the work, strictly standardize fair and civilized law enforcement, and earnestly safeguard the legitimate rights and interests of enterprises.
