In order to deepen the reform of trade associations and chambers of commerce and promote the healthy development of trade associations and chambers of commerce, with the consent of the Party Central Committee and the State Council, the following opinions are put forward.
First, the overall requirement
is to adhere to Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as a guide, thoroughly implement the spirit of the 20th and 20th Plenary sessions of the Party, adhere to and strengthen the Party's overall leadership, adhere to the people-centered approach, adhere to the general tone of steady progress, fully, accurately and comprehensively implement the new development concept, and strive to build a well-off society in an all-round way. Strengthen the leadership of Party building, pay attention to both active cultivation and development and strict supervision and management, improve the management system and operation mechanism of trade associations and chambers of commerce in line with the high-level socialist market economic system, improve the comprehensive management system combining government supervision, social supervision and self-discipline and autonomy, and optimize the structure and layout of trade associations and chambers of commerce. Promote the transformation and development of trade associations and chambers of commerce in accordance with the requirements of marketization, specialization and standardization, and give full play to the positive role of trade associations and chambers of commerce in serving economic and social development.
2. Adhering to and strengthening the Party's overall leadership
(1) Straightening out the management system of Party building. We should speed up the construction of a pattern of Party building work that combines different departments, links up the upper and lower levels, and effectively coordinates with each other, establish and improve the working mechanism of "managing the industry as well as the Party building", and implement the responsibility of all departments to jointly manage the work. We will further straighten out the affiliation of Party organizations of trade associations and chambers of commerce, and establish and improve a comprehensive coverage and smooth operation of the Party organization system. The Party building work of trade associations and chambers of commerce with competent business units shall be led and managed by the Party organizations of the competent business units and shall be guided by the social work departments of the Party committees.
(2) Strengthen the political and organizational functions of Party organizations. Improve the quality of Party organizations and Party work coverage, and improve the mechanism for Party organizations to play their roles. We will carry out actions to improve the quality of Party building in trade associations and chambers of commerce, promote the standardization and standardization of Party branches, and consolidate the foundation of Party building in an all-round way. Party organizations of trade associations and chambers of commerce shall perform their duties in strict accordance with the Party Constitution and relevant Party regulations, implement the decisions and arrangements of the Central Committee of the Communist Party of China, strengthen the political responsibility of leading development, and serve the practitioners in the industry and the field well. They shall strictly implement the responsibility system for ideological work and effectively prevent and resolve risks in the ideological field.
(3) Strengthen the standardization of the new term and the construction of the team of responsible persons. Strictly regulate the re-election in accordance with the rules and regulations, promote the effective participation of Party organizations of trade associations and chambers of commerce in decision-making on major matters such as important personnel arrangements, establish and improve the mechanism of supervision and reminder of the timely re-election of the Council and the age of the responsible person, standardize and refine the process of re-election, strengthen the rectification of the chaos of re-election, and intensify the rectification and punishment of the irregularities of re-election. Social work departments of Party committees should highlight political standards, strengthen political checks, and do a good job in examining and verifying candidates for responsible persons. Establish and improve the system of nomination, examination, publicity, supervision and withdrawal of the heads of trade associations and chambers of commerce. Promote the implementation of "two-way entry and cross-appointment" between Party members and management personnel and members of the Party organization team. Establish and improve the system of regular reporting and accountability of principal responsible persons. Strictly standardize the establishment of honorary positions of responsible persons. Strengthen the supervision and management of the person in charge, and timely adjust the person in charge who is not qualified, incompetent or incompetent.
(4) Continue to strengthen supervision and discipline. Party organizations of trade associations and chambers of commerce should earnestly fulfill the main responsibility of strictly administering the Party in an all-round way, and the built-in discipline inspection organizations should earnestly fulfill their supervisory responsibilities, and improve the working mechanism of discipline inspection in light of the actual situation. We will strengthen the standardization, legalization and regularization of discipline inspection work, establish and improve the system for handling problem clues, and seriously investigate and punish violations of the spirit of the Eight Provisions of the Central Committee. We will improve the anti-corruption system of trade associations and chambers of commerce, deepen the rectification of unhealthy tendencies and corruption, and promote the integration of not daring to corrupt, not being able to corrupt and not wanting to corrupt.
3. Improving the management system and operation mechanism
of trade associations and chambers of commerce (5) Consolidating and expanding the achievements of decoupling reform. Establish and improve the management system of unified leadership of Party committees, overall coordination of social work departments of Party committees, registration management organs, industry management departments, competent business units and relevant functional departments. Standardize the scope and conditions for different levels of trade associations and chambers of commerce to absorb members. Explore the simple cancellation procedure of trade associations and chambers of commerce, and improve the withdrawal system.
(7) Explore the establishment of a classified management system. Strengthen the classified supervision of trade associations and chambers of commerce, allocate supervision resources scientifically according to the classification situation, and implement differentiated management. For trade associations and chambers of commerce authorized by laws and regulations or entrusted by Party and government organs to manage public affairs, which are mandatory or monopolistic, and have more daily problems and higher risk of violation, we should strengthen supervision and increase the proportion and frequency of spot checks. Establish and improve the reporting system for major matters, and strengthen the supervision of key matters such as fees, assets and finance, foreign exchanges and cooperation, ideology and important business activities of trade associations and chambers of commerce. Improve the evaluation system of trade associations and chambers of commerce.
(8) Compacting the management and service responsibilities of departments. If it is clear that the industry management departments of directly registered and decoupled trade associations and chambers of commerce involve multiple departments, the main industry management departments shall be determined. Industry management departments should strengthen their working contacts with relevant trade associations and chambers of commerce through exchanges and discussions, visits and investigations, and listening to opinions, and implement their responsibilities of business guidance, industry supervision and Party building according to their functions. Relevant departments around the country should sort out the management and service matters related to trade associations and chambers of commerce, focus on the problems arising after decoupling, and study and put forward improvement measures. Trade associations and chambers of commerce that have not been decoupled will continue to be strengthened by the competent business units.
(Nine) establish and improve the social supervision mechanism. Establish an information disclosure system for trade associations and chambers of commerce, and encourage and support the news media, the people and members to supervise trade associations and chambers of commerce. Explore the establishment of a professional and socialized third-party supervision mechanism. (10) Promoting the ability of autonomy according to law. We will strengthen the construction of joint and comprehensive trade associations and chambers of commerce, and give full play to the exemplary and leading role of national trade associations and chambers of commerce. Establish and improve the system of the general meeting, the Council (standing Council) and the board of supervisors (supervisors) of the members (member representatives) of trade associations and chambers of commerce, and improve the internal management system under the leadership of the articles of association. We should implement democratic elections, democratic consultation, democratic decision-making, democratic management and democratic supervision. Standardize the establishment and strict management of offices and branches (representatives). Standardize the charging behavior of trade associations and chambers of commerce, as well as foreign exchanges and cooperation.
(11) Comprehensively strengthen the financial management of assets. Establish and improve the financial management system of trade associations and chambers of commerce, strictly implement accounting laws and regulations, and ensure the authenticity, integrity and accuracy of accounting information. Trade associations and chambers of commerce should implement the main responsibility of asset management and clarify the scope of major asset matters. Standardize the internal decision-making and management of trade associations and chambers of commerce, and guide asset management activities to be carried out around the main business. We will strengthen the comprehensive supervision of the assets of trade associations and chambers of commerce, and improve the asset management model with clear ownership, standardized and orderly, open and transparent, and strict supervision.
(12) Strictly manage the establishment of enterprises by trade associations and chambers of commerce. Trade associations and chambers of commerce shall, in accordance with the principles of legality, necessity, standardization and effectiveness, strictly control the establishment of enterprises; they shall not establish enterprises that directly compete with their members, shall not establish enterprises beyond their own purposes and business scope, and shall not make use of the established enterprises to carry out acts that hinder the market order; The established enterprise is generally not allowed to set up a new enterprise or conduct external business in the name of the trade association or chamber of commerce, and the profits obtained shall be used for the undertakings in line with the purpose of the trade association or chamber of commerce; the persons in charge of the trade association or chamber of commerce and its branches (representatives) and the relatives of the above-mentioned persons in charge shall not hold a post in the established enterprise or receive remuneration or various kinds of subsidies. To formulate management measures for the establishment of enterprises by trade associations and chambers of commerce, strictly establish procedures, improve regulatory measures and strengthen risk control.
4. Adjusting and optimizing the structure and layout
of trade associations and chambers of commerce (13) Optimizing the structure and layout. According to the principle of synergy and efficiency, we should optimize and integrate trade associations and chambers of commerce with overlapping business, too small scale of institutions, too detailed division of fields and weak functions. In accordance with the law, we should speed up the withdrawal of trade associations and chambers of commerce whose operation is out of order, whose order is disrupted, whose industries are shrinking, and whose purposes and tasks have been completed. We should focus on cultivating and giving priority to the development of trade associations and chambers of commerce that are in line with the major national strategies and regional development positioning, meet the needs of industrial transformation and upgrading, and serve the development of new quality productive forces; We will actively support the establishment of trade associations and chambers of commerce in strategic emerging industries, future industries, green low-carbon industries and other fields in accordance with the law.
(Fourteen) rationally regulate the scale. Strengthen the integration of national trade associations and chambers of commerce. For local trade associations and chambers of commerce, macro-control and guidance should be strengthened according to the economic and social development and changes in industrial structure. For trade associations and chambers of commerce at the municipal and county levels, the withdrawal procedures shall be simplified according to law, and the overall scale shall be controlled through orderly competition. In accordance with the principle of pilot first and steady progress, we should try first in the areas where national trade associations and chambers of commerce are concentrated and in some places, and steadily push forward after accumulating experience.
5. Actively play the role
of trade associations and chambers of commerce (15) Standardize the development of the industry. Industry associations and chambers of commerce should establish and improve the industry self-discipline management system and self-discipline restraint mechanism, consciously resist "involution" competition, formulate and organize the implementation of industry professional ethics, carry out industry credit evaluation according to law, improve the level of industry honesty construction, and better maintain the order of industry development. Members who violate the rules of self-discipline shall be punished by means of notification, suspension or cancellation of membership. Actively play the role of trade associations and chambers of commerce in resolving contradictions between letters and visits, and explore the establishment of professional mediation organizations in trade associations and chambers of commerce.
(16) Expanding service functions. Trade associations and chambers of commerce should guide members and practitioners to learn and implement the Party's theory, line, principles and policies, promote the implementation of national development strategies and special plans for related industries, and promote high-quality development of the industry. Provide information consultation, publicity and training, market expansion, rights and interests protection and other services in accordance with the law, and timely reflect the reasonable demands of members and industries. Deeply carry out investigation and research, carry out industry statistics according to law, and strengthen economic operation monitoring and forecasting and risk early warning.To study, formulate and implement high-quality group standards, promote the construction of advanced standards system in the industry, actively participate in the research and formulation of industry laws, regulations, policies and plans, and better promote the popularization and application of new technologies and products. Build a brand public service platform to help the development of advanced industrial clusters. Actively participate in the overall revitalization of the countryside, social governance, voluntary service, charity, food safety, emergency rescue and other work.
(17) Participate in international exchanges and cooperation. Trade associations and chambers of commerce, especially national trade associations and chambers of commerce, should actively participate in relevant international exchanges and cooperation, as well as the formulation of international standards and rules, and promote domestic standards, certification and accreditation, and international mutual recognition. Participate in or promote the establishment of an international economic and trade dialogue mechanism, and serve to build an international supply and procurement docking platform. To guide and promote industry enterprises to actively participate in the construction of "the Belt and Road" and global industrial division of labor and cooperation.
6. Optimizing the development environment
of trade associations and chambers of commerce (18) Optimizing support policies. Relevant departments around the country are encouraged to formulate and implement policies and measures to support the transformation and development of trade associations and chambers of commerce in light of actual conditions. Implement relevant preferential tax policies. Financial institutions are encouraged to provide financial support to qualified trade associations and chambers of commerce in accordance with the principle of marketization and legalization. Social forces are encouraged to support the development of trade associations and chambers of commerce. Establish and improve the training and evaluation system of employees and smooth career development channels. Strengthen the training of talents of trade associations and chambers of commerce. The functions and matters suitable to be undertaken by trade associations and chambers of commerce shall be transferred or entrusted to qualified trade associations and chambers of commerce by relevant departments in accordance with the law and procedures. Establish institutionalized channels for collecting people's suggestions from trade associations and chambers of commerce. Share relevant information and data with qualified trade associations and chambers of commerce according to law.
7. To strengthen the organization and implementation
, all relevant departments in all regions should, under the centralized and unified leadership of the Party Central Committee, establish the idea of "a chess game" and implement the present opinions in light of the actual situation. Party committees and governments at all levels should strengthen organizational leadership and promptly study and solve major problems. Social work departments of Party committees at all levels should strengthen overall coordination, supervise and implement, and promote the effectiveness of relevant policies and measures. Strengthen publicity and guidance to create a good atmosphere to support the development of trade associations and chambers of commerce. Major matters shall be reported to the Party Central Committee and the State Council in a timely manner in accordance with the procedures.
