Recently, the General Administration of Market Supervision issued a circular to deploy a special action to enhance the anti-monopoly compliance capability of enterprises overseas. This special action focuses on key scenarios such as overseas investment, cross-border mergers and acquisitions, and export of products, strengthens compliance guidance, and strives to promote more comprehensive coverage of overseas anti-monopoly system publicity in about a year, significantly improve the compliance ability of enterprises, and gradually improve the comprehensive service support system. The special action mainly includes the following key tasks. We
will improve overseas compliance guidelines and build a diversified training system. Revise the Guidelines on Overseas Anti-monopoly Compliance of Enterprises, refine the anti-monopoly regulatory system of key jurisdictions and increase demonstration cases. Strengthen overseas anti-monopoly publicity and education through multiple channels, carry out multi-level and diversified compliance training and guidance, and enhance the compliance awareness and risk response ability of enterprise personnel.
Implement the main responsibility of enterprises and lay a solid foundation for anti-monopoly compliance. Encourage and guide enterprises to carry out overseas anti-monopoly risk self-examination and compliance capability assessment, formulate compliance capability improvement plans, promote enterprises to establish a working mechanism of high-level co-ordination, department-led and post implementation, and embed competition compliance into investment decision-making, contract management and other business processes.
Give full play to the role of trade associations and enhance the ability of legal services. We should guard against overseas anti-monopoly risks related to "internalization and externalization", guide industry associations to enhance their service support capabilities for overseas anti-monopoly compliance, promote industry self-discipline by means of compliance, conduct common risk investigation, and guide enterprises to participate in international competition fairly. We should make
good use of social professional forces and strengthen international exchanges in anti-monopoly.
