It is reported that in the first half of 2025, First Solar also launched a "patent war" against Jingke Energy and Atlas for infringement of the patented technology.Subsequently, JinkoSolar and Atlas counterattacked and proposed to the U.S. Patent Trial and Appeal Board (PTAB) to initiate IPR proceedings (multi-party review proceedings, similar to patent invalidation proceedings).
However, after several months, the IPR applications of JinkoSolar and Atlas were finally rejected on the grounds that "the Director of the United States Patent and Trademark Office (USPTO) exercised his discretion in accordance with relevant regulations and decided not to initiate IPR."
It is reported that at the end of 2025, Jingke Energy and Mundra Solar PV Limited submitted EPR procedure (unilateral retrial procedure) to USPTO for First Solar patented technology.
The 337 survey is large in scale and rare in the photovoltaic industry in recent years. If the company wins the investigation, the defendant may not only face compensation, but also be limited in the U.S. market, and most importantly, the result of the victory may have a demonstration effect on other international markets, and First Solar may take similar actions in other countries.
