4 Applicant: Bankruptcy Administrator of Huaiyang Yongsheng Cement Co., Ltd. On September 28, 2026, the bankruptcy administrator of the respondent, Yongsheng Cement Co., Ltd. of Huaiyang County, filed an application to the Court, requesting to declare bankruptcy and terminate the bankruptcy liquidation procedure because Yongsheng Cement Co., Ltd. of Huaiyang County has no property available for distribution, can not pay off the debts due, and obviously lacks the ability to pay off.

The Court found that Hu Haiyang could not pay off the debts to Yongsheng Cement Co., Ltd. of Huaiyang County. Due to debt maturity and obvious lack of solvency, the court submitted an application for transferring the execution case to the court for bankruptcy review. The court transferred the relevant materials of the case to the Intermediate People's Court of Zhoukou City, Henan Province for examination. After examination, the Intermediate People's Court of Zhoukou City, Henan Province issued a civil ruling (2026) Yu 16 Po Shen No.22 on May 22, 2026. The ruling accepted Hu Haiyang's application for bankruptcy of Yongsheng Cement Co., Ltd. in Huaiyang County, and issued a civil ruling (2026) Yu 16 Po Shen No.22 on June 2, 2026, designating the Huaiyang District People's Court of Zhoukou City to hear the case. On June 8, 2026, the People's Court of Huaiyang District of Zhoukou City issued a decision (2026) Yu 1603 No.4, appointing Henan Mutian Law Firm as the administrator of the bankruptcy liquidation case of Yongsheng Cement Co., Ltd. in Huaiyang County.

The Court holds that after the acceptance of the bankruptcy application, if the debtor has no property to distribute after investigation by the administrator, the people's court shall declare bankruptcy and decide to terminate the bankruptcy liquidation procedure in accordance with the administrator's application. Since the Court accepted the bankruptcy liquidation case, creditors have not raised objections to the debtor's bankruptcy liquidation, nor have they applied for bankruptcy reorganization or reconciliation. Due to the company's failure to provide account books and important documents, the debtor could not be fully liquidated. After investigation by the administrator, the debtor had no property to distribute, so the court was requested to declare bankruptcy and decide to terminate the bankruptcy liquidation procedure. In accordance with the provisions of Article 43, Article 107 and Article 120 of the Enterprise Bankruptcy Law of the People's Republic of China, the ruling is as follows:

1. Huaiyang County Yongsheng Cement Co., Ltd. is declared bankrupt;

2. The bankruptcy proceedings of Huaiyang County Yongsheng Cement Co., Ltd. are terminated;

This ruling shall take effect as of this date.
