of Jiuquan Ecological Environment Bureau, Yumen Hongteng Commodity Concrete Co., Ltd. has violated Article 72, paragraph 1, of the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, which States that the storage of coal, coal gangue, cinder, coal ash, cement, lime, gypsum, sand and other dust-prone materials should be sealed. If it cannot be sealed, it shall set up a tight enclosure not lower than height of the stack, and take effective covering measures to prevent and control dust pollution. The regulations constitute an illegal act in violation of the air pollution management system.
According to Article 117, paragraph 1, of the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, "Whoever, in violation of the provisions of this Law, commits one of the following acts shall be ordered to make corrections by the competent departments of ecological environment of the people's governments at or above the county level in accordance with their duties, and shall be fined not less than 10000 yuan but not more than 100000 yuan."; Those who refuse to make corrections shall be ordered to stop work or suspend business for rectification: (1) Unsealed coal, coal gangue, coal cinder, coal ash, cement, lime, gypsum, sand and other dust-prone materials shall be fined 73,000 yuan.
The illegal fact is that the company is located on the north side of Dongzhen Provincial Highway 215 and the west side of Dongqing Road in Yumen City, Jiuquan City, with an annual construction project of 250000 cubic meters of commercial concrete and open-air storage of raw materials (sand and gravel). The law enforcement officers consulted the environmental assessment and acceptance data of the enterprise, and approved the construction of a sand and stone stacking shed in the environmental assessment, but the enterprise did not store the sand and stone in the warehouse as required.
Yumen Hongteng Commodity Concrete Co., Ltd. has committed illegal acts in violation of the Air Pollution Prevention and Control Law.
