Recently, the Ministry of Ecology and Environment announced the twenty-fourth batch of typical cases of ecological environment law enforcement (reporting and rewarding areas). There are four typical cases published in
this batch, two of which can be used for reference by the cement industry, namely, the implementation of rewards for the masses reporting dust pollution cases in Nanchang, Jiangxi and the implementation of rewards for the masses reporting excessive noise cases in a company in Baoji, Shaanxi.
1. Rewards
for reporting dust pollution cases in Nanchang, Jiangxi Province 1. Background
of the system In April 2021, the Department of Ecology and Environment of Jiangxi Province and the Department of Finance of Jiangxi Province jointly issued the Measures for Rewarding the Reporting of Ecological Environment Violations in Jiangxi Province. After the ecological environment department makes a decision on administrative punishment according to the law after verifying the ecological environment violation according to the reporting clues, it shall give the informant a reward not higher than 4% of the current punishment amount according to the relevant provisions of the Measures; if it is a major reporting matter, the reward shall be determined according to 200% of the reward standard in the preceding paragraph. In August 2021, the Nanchang Ecological Environment Bureau issued the Measures for Rewarding the Reporting of Ecological Environment Violations in Nanchang to further implement the relevant system.
2. Basic facts of the case
On January 12, 2024, some people reported that raw materials produced by a company were piled up in the open air. On January 16, 2024, the law enforcement officers of Nanchang Ecological Environment Bureau conducted on-site verification of the reporting clues, and found that some of the production materials of a company were directly stacked in the open air, some of the materials were not fully covered, and there was dust pollution.
3. Investigation and reward
of the above-mentioned acts of the company violated Article 48 of the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, "Enterprises such as iron and steel, building materials, non-ferrous metals, petroleum, chemical industry, pharmaceuticals and mineral exploitation should strengthen fine management, take measures such as centralized collection and treatment, and take measures such as collection and treatment." Strictly control the emission of dust and gaseous pollutants. Industrial production enterprises shall take measures such as sealing, enclosure, covering, cleaning and sprinkling to reduce the emission of dust and gaseous pollutants from the storage, transmission, loading and unloading of internal materials. In accordance with Article 108, paragraph 5, of the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, the Nanchang Bureau of Ecology and Environment shall order the competent department of ecological environment of the people's government at or above the county level to make corrections and impose a fine of not less than 20000 yuan but not more than 200000 yuan for any of the following acts in violation of the provisions of this Law; Those who refuse to make corrections shall be ordered to stop production for rectification: (5) Enterprises engaged in iron and steel, building materials, non-ferrous metals, petroleum, chemical industry, pharmacy and mineral exploitation shall be fined 30,000 yuan for failing to take measures such as centralized collection and treatment, sealing, enclosure, covering, cleaning and sprinkling to control and reduce the emission of dust and gaseous pollutants. In December
2024, the Nanchang Ecological Environment Bureau awarded 400 yuan to the informant in accordance with the Measures for Rewarding the Reporting of Ecological Environment Violations in Nanchang.
2. Baoji, Shaanxi Province, rewarded
the people who reported the case of noise exceeding the standard of a company. 1. Background
of the system In March 2021, the Shaanxi Provincial Department of Ecology and Environment and the Shaanxi Provincial Finance Department jointly issued the Measures for the Implementation of Rewards for Reporting Illegal Acts of Ecological Environment in Shaanxi Province. In September 2022, the Bureau of Ecology and Environment of Baoji City and the Finance Bureau of Baoji City jointly formulated the Measures for the Implementation of Rewards for Reporting Ecological and Environmental Violations in Baoji City, which graded the reward standards according to the degree of harm, the amount of punishment and whether the cases were handed over to the judicial organs, and awarded the informants 200 to 10,000 yuan.
2. On June 26,
2025, the Bureau of Ecology and Environment of Baoji City commissioned a third-party testing company to monitor the noise at the factory boundary of a company in the daytime after receiving complaints from the masses. The monitoring results show that the noise measurement value at the east side of the plant boundary is 68 dB (A), and the noise measurement value at the south side of the plant boundary is 67 dB (A), both of which exceed the Class 3 standard limit in Table 1 of the Emission Standard for Environmental Noise at Boundary of Industrial Enterprises.
3. Investigation and reward
The above actions of the company violate Article 22 of the Law of the People's Republic of China on the Prevention and Control of Noise Pollution, which stipulates that "the emission of noise and vibration shall comply with the requirements of noise emission standards, relevant environmental vibration control standards and relevant laws, regulations and rules". In accordance with Article 75 of the Law of the People's Republic of China on the Prevention and Control of Noise Pollution, the Bureau of Ecology and Environment of Baoji City shall, in violation of the provisions of this Law, discharge industrial noise without a discharge permit or in excess of the noise emission standards, order the competent department of ecology and environment to correct or restrict production or stop production for rectification, and impose a fine of not less than 20000 yuan but not more than 200000 yuan; If the circumstances are serious, the company shall be ordered to suspend business or close down with the approval of the people's government with the power of approval and the benchmark of the discretion of administrative penalties for ecological environment in Shaanxi Province (2023 edition), and the company shall be fined 30000 yuan. In July
2025, according to the Measures for the Implementation of Rewards for Reporting Illegal Eco-environmental Acts in Baoji City, the Eco-environmental Center of Baoji High-tech Industrial Development Zone awarded the informant 300 yuan.
The above two cases provide clear inspiration for cement enterprises: enterprises need to take the initiative to investigate environmental risk points, focus on checking key links such as material storage areas and high-noise equipment (such as crushers and mills), and implement targeted measures such as enclosure covering, equipment sound insulation and on-line monitoring in advance. Effectively reduce the risk of violations.
