According to the clues handed over by the provincial department, our Bureau investigated your unit on June 5 and June 6, 2025, and found that your unit had carried out the following acts:
on March 25, March 31 and April 27, 2025, when comparing and testing the waste gas on-line monitoring equipment of Wuwei Leida Cement Co., Ltd. The comparison was not carried out according to the specifications, and the original data such as smoke, smoke parameters and sampling time were tampered with and forged by modifying the memory card data of the testing equipment, and the test reports numbered SJ2025-HJJ023 (comparison) and SJ2025-HJJ023 (4) (comparison) were issued.
The above facts are proved by the following evidences:
1. One copy of the business license, eight copies of the resident identity card, and seven copies of the Power of Attorney to prove the business qualification of the market entity of your unit. One copy of the business license, two copies of the resident identity card, one copy of the Power of Attorney and one copy of the technical service contract of Wuwei Leida Cement Co., Ltd. prove the business qualification of the market entity of the unit, the identity of Tang Xiaoshuai, the legal representative of the unit, and Zhou Rongrong of the unit, and the identity of the unit. It proves that the unit has confirmed Zhou Rongrong's agency authority, entrustment matters and entrustment period, and that your unit is responsible for the environmental monitoring and environmental comparison monitoring of Wuwei Leida Cement Co., Ltd. in 2025.
3. One record of on-site inspection (investigation) on June 5, 2025 (Wuwei Leida Cement Co., Ltd.) and one record of investigation and inquiry (Zhou Rongrong). 7. Two records of investigation and inquiry on June 5, 2025 (Sun Pei, Shen Xueli) and three records of investigation and inquiry on June 6, 2025 (Chen Fang, Chen Ningning, Zhai Wei). In the process of issuing the test reports with the certificate numbers of SJ2025-HJJ023 (comparison) and SJ2025-HJJ023 (4) (comparison), the laboratory inspector, the report preparer, the report reviewer and the authorized signatory did not verify the authenticity of the original data of the report.
8. One record of investigation and inquiry on June 6, 2025 (Fang Sixin), proving that Fang Sixin is the highest manager of your unit and bears the main management responsibility, and proving that your unit has not received the environmental testing fee of Wuwei Leida Cement Co., Ltd.
9. Two live video screenshots and seven live videos on June 5, 2025 prove that when your unit carried out comparative testing on March 25, March 31 and April 27, 2025, the live video surveillance showed that the sampling personnel of your unit did not carry out comparative testing according to the specifications. The sampling time and the time of entering and leaving the factory are inconsistent with the records in the test report, which proves that the testing equipment used by your unit for sampling is the ZR-3260 automatic smoke and dust comprehensive tester of Qingdao Zhongrui Intelligent Instrument Co., Ltd., and the electronic original records in the memory card of the equipment have some inconsistencies between the creation time, modification time and the sampling time of the original records.
10. One copy of the Schedule of Qualification Certificate of Inspection and Testing Institutions, one copy of the procedure document and one copy of the quality manual, proving that your unit can issue data and results with certification function to the society, as well as the internal organization and management structure.
11. One test report and one original record numbered SJ2025-HJJ023 (comparison) and SJ2025-HJJ023 (4) (comparison), certifying the test report and original record issued by your unit to Wuwei Leida Cement Co., Ltd.
12. One copy of the Confirmation of the Party's Address for Service, which proves that your unit has confirmed the basic information of the addressee, the matters to be informed, the address for service and the method of service.
13. Two copies of law enforcement certificate, proving the identity and qualification of Huang Xinyi and Qin Ruyue, the law enforcement officers of our Bureau.
The above acts violate the provisions of Article 12, paragraph 2, of the Regulations on Environmental Protection of Anhui Province.
In accordance with the provisions of Article 28, paragraph 1, of the Administrative Punishment Law of the People's Republic of China and Article 52, paragraph 1, item 2, of the Regulations on Environmental Protection of Anhui Province, our Bureau orders your unit to correct the above-mentioned acts immediately (within 1 day from the date of receipt of this decision), strictly abide by the technical specifications for environmental monitoring, and shall not tamper with or forge monitoring data.
If you are not satisfied with this decision, you may apply to the Wuhu Municipal People's Government for administrative reconsideration within 60 days from the date of receipt of this decision, or you may file an administrative lawsuit with the People's Court of Jiujiang District of Wuhu City within 6 months from the date of receipt of this decision.
