Notice of the State Administration of Market Supervision and Administration and the National Standardization Administration on Conducting Fair Competition Review in the Drafting of National Standards

In order to implement the Regulations on Fair Competition Review and the Measures for the Implementation of the Regulations on Fair Competition Review, The work of fair competition review in the drafting of national standards is hereby notified as follows:

1. Implementing the responsibility of review. In the process of revising national standards, the drafting unit shall strictly implement the responsibility of fair competition review. Compulsory national standards and recommendatory national standards drafted by the relevant administrative departments of the State Council shall be examined by the relevant administrative departments of the State Council for fair competition. The recommended national standards drafted by the National Professional Standardization Technical Committee shall be examined by the National Professional Standardization Technical Committee for fair competition.

2. To clarify the contents of the review. After the draft of the national standard has been formed for consultation, a fair competition review shall be carried out, and the specific contents of the draft of the national standard for consultation that may affect the market shall be explained one by one according to the criteria for the review of whether to restrict or disguise the restriction of market access and withdrawal, whether to restrict the free flow of commodity elements, whether to affect the cost of production and operation, and whether to affect the production and operation behavior. And analyze whether there is any violation of the regulations, and fill in the Fair Competition Review Form (see annex). The conclusion of fair competition review shall be separately explained in the compilation of national standards.

3. Submission and examination. From the date of issuance of this Circular, when the national standards are submitted for approval, the Fair Competition Examination Form shall be submitted at the same time. The administrative department for standardization under the State Council shall examine and verify the materials for approval of national standards and the Fair Competition Examination Form, and return them to the drafting unit for supplementary fair competition examination without fair competition examination.
