Recently, the Ministry of Emergency Management issued the "Regulations on the Management of Safety Technical Training and Assessment for Special Operators of the Ministry of Emergency Management of the People's Republic of China (No.19)", which has been revised and adopted at the 31st ministerial meeting of the Ministry of Emergency Management on December 12, 2025, and is hereby promulgated for implementation as of June 1, 2026.

Article 2 These Provisions shall apply to the safety technology training, examination, certification, replacement and supervision and management of the special operation personnel of the production and business operation units. Where there are other provisions on the administration of special operation personnel in

relevant laws, administrative regulations, the State Council and the relevant departments of the State Council, such provisions shall prevail. Article

3 The term "special operations" as mentioned in these Provisions refers to operations that are prone to accidents and may cause significant harm to the safety and health of operators themselves and others, as well as to the safety of equipment and facilities. The scope of special operations shall be specified in the catalogue of special operations. The term "special operation personnel" as mentioned in

these Provisions refers to the employees directly engaged in special operations. Article

4 Special operation personnel must receive special safety technical training and pass the examination, and obtain the Special Operation Certificate of the People's Republic of China (hereinafter referred to as the Special Operation Certificate) before they can take up their posts. Article

5 The principles of unified management, graded implementation, separation of examination and training, and high efficiency and convenience for the people shall be applied to the safety technical training, examination, issuance and replacement of certificates for special operators. Article

6 Special operation personnel shall meet the following requirements:

(1) having reached the age of 18 and not exceeding the national legal retirement age;

(2) No organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, Parkinson's disease, psychosis, dementia or nervous system disease that affects limb movement, and no physical defect that hinders safe operation;

(3) Possessing necessary safety technical knowledge and skills;

(Four) other conditions stipulated by the corresponding special operations. In addition to meeting the requirements specified in the preceding paragraph, special operators of

coal mines, metal and non-metal mines, petroleum and natural gas, metallurgy, non-ferrous metals, fireworks and firecrackers shall have a junior high school education or above. Special operators of hazardous chemicals and special operators of underground mines who obtain evidence for the first time shall have high school education or equivalent to high school education or above. Article

7 The Ministry of Emergency Management shall coordinate, guide and supervise the safety technical training, assessment, certification and replacement of special operators throughout the country; The emergency management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall guide and supervise the safety technical training of special operators within their respective administrative areas, and shall be responsible for the examination, certification and replacement of special operators within their respective administrative areas.

The State Administration of Mine Safety shall guide and supervise the safety technical training, examination, issuance and replacement of certificates for special operators in coal mines and metal and non-metal mines throughout the country; The mine safety supervision departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall guide and supervise the safety technology training of special operators in coal mines and metal and non-metal mines within their respective administrative areas, and shall be responsible for the examination, certification and replacement of special operators in coal mines and metal and non-metal mines within their respective administrative areas. The emergency management departments and mine safety supervision departments of the people's governments of

provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the examination and certification authorities) may entrust the emergency management departments and mine safety supervision departments of the people's governments at the municipal level with districts to carry out the examination, certification and replacement of special operators. The emergency management departments and mine safety supervision departments of the local people's governments at or above the municipal level

with districts shall be responsible for supervising and managing the assessment of special operators within their respective administrative areas. The emergency management departments of the local people's governments at or above the county level and the mine safety supervision departments shall, in accordance with their duties, be responsible for supervising and inspecting the safety technical training and certification of special operators within their respective administrative areas. Article

8 Any unit or individual shall have the right to report or report to the emergency management department or the mine safety supervision department any violation of relevant laws, regulations and these Provisions in the work of safety technical training, examination, issuance and renewal of certificates for special operators. Chapter

II Training

Article 9 Special operators shall receive safety technical training corresponding to the special operations they are engaged in, including theoretical training and practical operation training. Graduates of

secondary vocational schools (including technical schools) and above who apply for special operation certificates corresponding to their majors may be exempted from safety technical training with the approval of the examination and certification authorities. Employees who

hold legal and valid vocational skill level certificates may be exempted from safety technical training if they apply for special operation certificates corresponding to their vocational skills. Article

10 For the safety technical training of special operators, the production and business operation units with the conditions for safety production training shall give priority to self-training, or may entrust institutions with the conditions for safety production training or conduct t raining through other means prescribed by the Ministry of Emergency Management. Production and business units that

do not have the conditions for safety production training shall entrust institutions that have the conditions for safety production training or conduct training through other means prescribed by the Ministry of Emergency Management. Where a

production and business operation entity entrusts other institutions or conducts safety technical training through other means prescribed by the Ministry of Emergency Management, the responsibility for ensuring safety technical training shall still be borne by the entity. Article

11 Institutions engaged in safety technical training for special operators (hereinafter referred to as training institutions) shall report in writing the conditions for safety production training to the emergency management departments of the people's governments at or above the municipal level or the mine safety supervision departments of the districts where they are located, and promise that the contents of the reports are true and that the safety training conditions are not required. Safety technical training for special operators shall be carried out within the scope of reporting operation categories or operation projects. If the training place or training project of a

training institution changes, it shall report to the emergency management department of the people's government at or above the municipal level or the mine safety supervision department of the district where the training institution is located in a timely manner. The emergency management departments and mine safety supervision departments of the local people's governments at or above the municipal level

with districts shall publicize the basic information of the training institutions. Article

12 Training institutions shall formulate corresponding training plans and teaching arrangements, and conduct safety technical training for special operators in accordance with the training program for special operators formulated by relevant departments such as the Ministry of Emergency Management and the State Administration of Mine Safety. Article

13 Training institutions shall establish and improve training files, record the training situation truthfully, and standardize the management of safety technology training files. The archives shall be kept for no less than 6 years. Article

14 Training institutions shall ensure the quality of training, consciously accept supervision and assume responsibility according to law. Article

15 During the period when a production and business operation entity arranges its employees to conduct safety technical training for special operators, it shall pay wages according to law and guarantee relevant treatment. Chapter

III Examination and Certification

Article 16 The examination of special operation personnel includes safety technology examination and qualification examination. The examination and certification authority shall be responsible for the safety technology examination, and may entrust the examination institution to carry out the examination; the examination and certification authority shall be responsible for the qualification examination. The

safety technology examination shall implement the national unified examination standards and use the national unified examination question bank and examination system.

The examination and certification authority shall build or entrust relevant units to set up examination points that meet the requirements, and rationally distribute the number of examination points in accordance with the actual situation, so as to provide necessary places and corresponding conditions for the safety technology examination. Article

17 The examination and license-issuing organ shall publicize the matters, basis, conditions, procedures, time limit and catalogue of application materials for handling special operation certificates, so as to facilitate public access.

The examination and certification authority or the examination institution entrusted by it shall publicize the examination fee standards, the catalogue of materials required for the application for examination, and standardize the management of examination files. The archives shall be kept for no less than 6 years.

The examination point should establish a corresponding management system, publicize the examination process, examination rules, examination room discipline, examination matters needing attention and other information, record and videotape the whole process of the examination, and retain the complete data of the examination system. Examination institutions and examination points

undertaking safety technology examination tasks shall not engage in training activities related to the examination tasks they undertake.Article

18 Personnel applying for the examination of safety technology for special operations shall apply to the examination and certification authority or the examination institution entrusted by it by themselves or by entrusting others, and submit the examination registration form, photocopy of identity card, certificate of training hours, personal health commitment and material authenticity commitment. If there are requirements for academic qualifications, copies of academic certificates or other academic certification materials shall also be provided. Those who can be exempted from safety technology training shall submit certificates of academic qualifications, vocational skill level certificates and other materials.

The examination and certification authority or the examination institution entrusted by it shall examine the contents of the materials submitted by the applicant and inform the applicant of the results of the examination within five working days. Article

19 The examination and certification authority or the examination institution entrusted by it shall regularly formulate and issue a safety technology examination plan and organize the examination within 60 days after receiving the application. The

twentieth safety technology examination includes two parts: theoretical examination and practical operation examination. Those who pass both the theoretical examination and the practical operation examination shall be deemed to have passed the safety technology examination. Only after passing the

theoretical examination can applicant participate in the practical operation examination; the practical operation examination shall not exceed five times, and the applicant who still fails to pass the examination shall participate in the theoretical examination again. Those who fail to pass

each theoretical examination or practical operation examination may make up the examination free of charge in accordance with the relevant provisions.

The applicant shall complete the safety technology examination within three years from the date of passing the examination application, and shall not exceed the upper age limit of special operators. Article

21 The examination and certification authority or the examination institution entrusted by it shall publish the examination results within 10 working days after the completion of the examination. Article

22 Special operators who meet the requirements of Article 6 of these Provisions and pass the examination shall apply for special operation certificates by themselves or by entrusting others to the examination and certification authorities in the place where the examination is held, and submit the certificate application form. Where a

special operator applies for a special operation certificate, the examination and certification authority shall accept the application according to law, and within 20 working days from the date of acceptance, examine the identity information of the applicant, the certificate of training hours and the qualified materials for the examination. Those who meet the requirements shall be issued a special operation certificate, and the certificate information shall be uploaded to the national unified certificate inquiry platform for the convenience of the employer and the public to inquire; those who do not meet the requirements shall state the reasons in writing. The

twenty-third special operation certificate is valid for 6 years and is valid throughout the country. The format and standard of the

special operation certificate shall be unified by the Emergency Management Department, and the entity certificate and the electronic certificate shall have the same effect. Article

24 Where a special operation certificate is lost or the information recorded therein is changed or damaged, an application shall be submitted to the original examination and issuance authority, which shall handle the matter after examination and verification by the original examination and issuance authority. Article

25 Personnel who have obtained construction special operation certificates and special equipment operator certificates issued by housing urban and rural construction departments and market supervision departments according to law shall apply for corresponding special operation certificates issued by emergency management departments, and specific measures shall be formulated separately. Chapter

IV Replacement of Certificates

Article 26 When the validity period of the special operation certificate held by the special operation personnel expires and it is necessary to continue to engage in special operations, a new certificate shall be obtained. Article

27 Where a special operator applies for the renewal of his certificate, he shall complete the corresponding theoretical training and examination of special operation safety technology within six months before the expiration of the validity period of the special operation certificate, and within 60 days before the expiration of the validity period of the special operation certificate, he or he shall entrust another person to submit an application for the renewal of the certificate to the examination and certification authority.

The examination and certification authority shall examine the identity information of the applicant, the certificate of training hours, and the qualified materials for the examination. Article

28 If a special operator is unable to renew his certificate within the prescribed time due to special reasons such as military service, work and study abroad, he may apply to the examination and issuance authority for an extension of the certificate within the validity period of the special operatio n certificate, and submit the identity certificate of the holder and relevant supporting materials. The extension period shall not exceed 2 years from the date of expiration of the special operation certificate. Special operations shall not be carried out during the extension period. Article

29 If the special operation personnel fail to renew or postpone the renewal of the certificate in accordance with these Provisions, the special operation certificate shall be invalid upon the expiration of the validity period. If it is necessary to continue to engage in special operations, the certificate shall be replaced if it has been invalid for less than one year; if it has been invalid for more than one year, it shall be handled as the first certificate. No special operation is allowed during the period when the certificate is invalid. Article

30 Where an application for replacement of a certificate is made, the examination and issuance authority shall accept it according to law and complete the examination within 20 working days from the date of acceptance. If the conditions are met, the special operation certificate shall be renewed and the certificate information shall be uploaded to the national unified certificate inquiry platform; if the conditions are not met, the reasons shall be stated in writing. The initial receipt date of the

renewed special operation certificate shall remain unchanged, and the starting time of the validity period shall be calculated according to the deadline of the validity period of the original certificate. Chapter

V Supervision and Administration

Article 31 The relevant staff members of the examination and license-issuing organs, examination institutions and examination points shall be loyal to their duties, adhere to principles, be honest and self-disciplined, carry out the examination, license-issuing and replacement of special operators in accordance with the provisions of laws, regulations and rules, and accept the supervision of the society. Article

32 When supervising and inspecting the safety technical training of special operators carried out by training institutions within their respective administrative areas, the emergency management departments of the local people's governments at or above the county level and the mine safety supervision departments shall focus on the conditions for training, the implementation of the training management system, the control of the training process and the establishment of training files. Article

33 The emergency management departments and mine safety supervision departments of the local people's governments at or above the municipal level with districts shall supervise and administer the conditions required for the examination institutions and examination points to undertake the safety and technical examinations for special operators within their respective administrative areas, the implementation of the examination responsibilities and the establishment of examination files. Article

34 Where a special operator obtains a special operation certificate by deception, bribery, cheating or other improper means, the examination and certification authority shall revoke the special operation certificate. The special operation personnel shall not apply for the special operation certificate again within 3 years from the date of revocation of the special operation certificate. Article

35 In case of any of the following circumstances, the examination and license-issuing organ shall cancel the special operation certificate:

(1) Those who are dead or whose physical conditions can no longer meet the requirements of these Provisions and can no longer continue to engage in special operations;

(2) Those who apply for cancellation;

(3) The special operation permit is revoked or withdrawn according to law;

(4) The special operation permit expires and is not renewed or the renewal is not passed.

The special operation personnel who cancel the special operation certificate shall be announced to the public in a timely manner. Article

36 a production and business operation entity shall strictly manage its special operation personnel, verify the authenticity and validity of their special operation certificates, establish and improve the management files of special operation personnel, and do a good job in organizing training, application and replacement of certificates. Article

37 No unit or individual may forge, alter or buy or sell a special operation certificate, or buy, sell or use a forged or altered special operation certificate.

The special operation personnel shall not lease or lend the special operation certificate, nor illegally use the special operation certificate of others. No

production and business operation entity may arrange any person who uses a forged or altered special operation certificate or who uses another person's special operation certificate to carry out any special operation. Chapter

VI Legal Liability

Article 38 The relevant staff members of the examination and license-issuing organs, examination institutions and examination points who abuse their powers, neglect their duties or engage in malpractices for personal gain in the examination, license-issuing and license-changing work of special operators shall be punished in accordance with the relevant provisions. Article

39 If a production and business operation entity fails to establish and improve the management archives of special operation personnel, it shall be ordered to make corrections within a time limit and shall be fined not more than 20,000 yuan; if it fails to make corrections within the time limit, it shall be fined not less than 20,000 yuan but not more than 50,000 yuan.Article

40 Where a production and business operation entity employs special operators who have not obtained special operation certificates, it shall be ordered to make corrections within a time limit and shall be fined not more than 100000 yuan in accordance with the provisions of the Safety Production Law of the People's Republic of China; Those who fail to make corrections within the time limit shall be ordered to stop production and business for rectification, and shall be fined not less than 100000 yuan but not more than 200000 yuan, and the persons directly in charge and other persons directly responsible shall be fined not less than 20000 yuan but not more than 50000 yuan. Where

a production and business operation entity fails to strictly check the authenticity and validity of the special operation certificates of its special operation personnel, and arranges for the use of forged or altered special operation certificates or the use of other people's special operation certificates to carry out special operations, it shall be punished in accordance with the provisions of the preceding paragraph. Article

41 Where a training institution fails to establish the safety technology training archives for special operation personnel or the management of the training archives is not standardized, it shall be ordered to make corrections within a time limit and shall be fined not more than 20,000 yuan; if it fails to make corrections within the time limit, it shall be fined not less than 20,000 yuan but not more than 50,000 yuan. Article

42 If a training institution has one of the following situations of low quality of education and teaching or confusion in management, resulting in serious consequences, it shall be ordered to suspend the enrollment of safety technology training for special operators and rectify it within a time limit in accordance with the provisions of the Vocational Education Law of the People's Republic of China; Those who fail to rectify within the time limit or fail to meet the requirements after rectification shall be ordered to stop the safety technical training for special operators:

(1) Those who do not have the conditions for safety production training to carry out safety technical training for special operators;

(2) Failing to conduct safety technology training for special operation personnel in accordance with the unified training program, resulting in serious lack of training content;

(3) Providing false certificates of safety technology training hours for special operation personnel to help cheat the examination qualification. Article

43 Under any of the following circumstances, an examination site shall cease the entrusted examination business and shall not undertake the examination task any more:

(1) failing to meet the requirements of the third paragraph of Article 16 of these Provisions;

(2) obtaining the opportunity to undertake the examination task by improper means;

(3) Engaging in training activities related to the examination tasks undertaken;

(4) Stealing or disclosing examination questions and answers;

(5) Conniving at or organizing cheating in examinations or ganging up with others to cheat;

(Six) intentionally deleting, intentionally losing, forging or tampering with the data of the examination system. If the

examination site fails to record and videotape the whole process of the examination, it shall be ordered to make corrections within a time limit and stop the examination business for 3 to 6 months; if it fails to make corrections within the time limit, it shall stop the entrusted examination business and shall not undertake the examination work any more. Article

44 If an examinee commits any of the following acts, the examinee shall be disqualified from the examination, and the examination results that have been passed shall be invalid, and the examination and certification authority shall suspend the examination for one year:

(1) providing false materials to apply for the examination;

(Two) bribery and cheating in the course of examination. Article

45 If a special operator obtains a special operation certificate by deception, bribery, cheating or other improper means, he shall be fined not less than 5000 yuan but not more than 20000 yuan, in addition to revoking the relevant certificate. Article

46 Special operators responsible for accidents in accident-occurring units shall suspend or revoke their special operation certificates in accordance with the Regulations on Reporting and Investigating and Handling Production Safety Accidents. Article

47 Those who violate these Provisions and constitute violations of public security administration shall be handed over to the public security organs for handling according to law; those who constitute crimes shall be investigated for criminal responsibility according to law. Chapter

VII Supplementary Provisions

Article 48 The emergency management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the mine safety supervision departments may, in light of the actual conditions of their respective regions, formulate detailed rules for implementation and report them to the Emergency Management Department and the State Administration of Mine Safety for the record. Article

49 These Provisions shall come into force as of June 1, 2026. The former State Administration of Work Safety promulgated on May 24, 2010, and the Regulations on the Management of Safety Technical Training and Assessment for Special Operators, which were first amended on August 29, 2013 and second amended on May 29, 2015, were abolished at the same time.
