Accident course: Tragedy

accident: The
direct cause of the accident was the superposition of various factors: Yang had a weak sense of safety, went to work after drinking, left his post without authorization, and violated the safety work system in the factory, which was the direct cause of the accident. It was because of his violation that he put himself in danger, which eventually led to the tragedy.
Indirect causes: The accident is not accidental, and there are many indirect causes behind it. Zhao Mojun, the site safety administrator of Binkai Cement Co., Ltd., was absent from the site during his work, failed to discover and stop the behavior of employees who went to work after drinking and left their posts without authorization, and the safety management was not in place; At the same time, the temporary ladder of dust removal platform in the plant has hidden dangers of production safety accidents, but it has not been found and eliminated in time, there are serious deficiencies in safety performance, and the safety education and training of employees are not in place. Zhao Mojun's behavior violated the provisions of Article 25, paragraph 1 (2) (5) (6), of the Safety Production Law of the People's Republic of China, and was the main cause of the accident. of Binkai Cement Co., Ltd., was not on duty during the inspection and maintenance work in the factory, and failed to detect and stop the situation that the on-site safety management personnel were not on the spot, the employees went to work after drinking and left their posts without authorization, and there were also problems of inadequate safety management and safety education and training. Moreover, the potential safety hazard of the temporary ladder of the dust removal platform of the dust remover in the plant has not been eliminated in time, and its behavior also violates the relevant provisions of Article 25, paragraph 1, of the Safety Production Law of the People's Republic of China, which is one of the indirect causes of the accident.

It violated the provisions of Article 21 (2) (3) (5) of the Safety Production Law of the People's Republic of China and was also the indirect cause of the accident. The
accident report mentioned that the accident unit, Binkai Cement Co., Ltd. of Baode County, was located in Nuanquan Village, Yimen Town, Baode County, Xinzhou City, Shanxi Province. On November 1, 2023, it submitted a suspension report to Baode Branch of Xinzhou Environmental Protection Bureau, and formally suspended production on November 1, 2023, without submitting a suspension report to the industry management department, relevant regulatory departments and local towns. Starting from March 8, 2024, continuous meetings were held to start the work of resumption of work and production, arrange for the deployment of maintenance and repair matters of various departments, and no application for resumption of work and production was submitted to the industry management departments, relevant regulatory departments and local towns.

According to the relevant laws and regulations, it is suggested that Baode County Emergency Management Bureau impose a fine of 500000 yuan on Baode County Binkai Cement Co., Ltd.

According to Article 96 of the Production Safety Law of the People's Republic of China and Article 20 (1) of the Regulations on Fines and Penalties for Production Safety Accidents, it is suggested that the Emergency Management Bureau of Baode County impose a fine of 20% of its annual income in the previous year.
