The deceased Wang Mouzheng, male, 53 years old, from Zhoukou City, Henan Province, suffered a direct economic loss of about 880000 yuan (excluding insurance compensation). The course of

the accident is as follows:

At 16:30 on July 13, Zhao Mojun, the team leader of Kuntai Company, organized and arranged three workers to carry concrete vibrators and other working tools for pouring, and planned to use concrete hoppers to lift concrete to the staircase at the roof of the first floor of the building involved for pouring. Commanders Zhang Mou and Deng Mou commanded at the first floor roof and the ground respectively.

At 17:30, the operation team began to pour the stair steps. The lifting and pouring of the first truck of concrete was completed at 18:30. At about

1900, the second truck of concrete arrived at the scene, and Wang joined the pouring team to start pouring the four walls of the stairwell. 58, in the process of lifting the fifth bucket of concrete (each bucket of concrete to 20-30 cm away from the hopper mouth), when the hopper was lifted to about 2 meters above the wall formwork, the bearing wire rope of the hopper suddenly broke, and the hopper fell and hit Wang Mouzheng squatting on the wall formwork, causing his helmet to fall off and fall on the top of the staircase wall formwork. The hopper then falls and overturns into the stairwell (see Figure 1). The direct causes of the

accident were analyzed as follows:

1. Zhang, the commander, still directed the tower crane to carry out the lifting operation when there were workers staying under the lifting object (hopper).

2. Wang Mou, a worker, lacked safety awareness and took the risk of staying in the dangerous area under the lifting object without keeping enough safe distance. Still command the tower crane to carry out lifting operation.

3. The material and bearing capacity of the steel wire rope of the hopper do not meet the safety requirements, lack of maintenance such as oiling, and the steel wire is corroded and embrittled. After long-term and repeated lifting operations, there is a risk of fracture. When the instantaneous impact load is greater than limit bearing weight of the wire rope involved, the wire rope will break.

According to the investigation of the accident, the investigation team put forward the following opinions on the determination and investigation of the responsibility of the accident unit and the relevant personnel:

(1) Wang Mouzheng, a worker involved in the accident who died in the accident and was exempted from the investigation of the responsible person, lacked safety awareness, took the risk of staying in the dangerous area under the lifting object, and did not keep enough safe distance. He should be directly responsible for the accident, and in view of his death, it is suggested that he be exempted from accountability .

(2) It is suggested that Zhang Mou , the commander of Kuntai Company, who is transferred to the judicial organ for handling, still direct the tower crane to carry out the lifting operation when there are workers staying under the lifting object (hopper). Zhang's behavior is suspected of violating the crime of major liability accident stipulated in Article 134 of the Criminal Law of the People's Republic of China, and should be directly responsible for the accident. It is suggested that Baoan Branch of Shenzhen Public Security Bureau should deal with it according to law.

(3) Suggestions

on administrative penalties for the responsible personnel 1. Hu Mouguo, the project manager of Kuntai Company, failed to perform his duties of safety production management and failed to supervise and inspect the safety production work of the unit. Failure to discover and eliminate the hidden dangers of production safety accidents in which the wire ropes involved do not meet the safety requirements and workers operate in violation of regulations. His behavior violated the provisions of Article 21 (5) of the Safety Production Law of the People's Republic of China, and he should be responsible for the management of the accident. It is suggested that the Emergency Management Bureau of Baoan District of Shenzhen should deal with it according to law.

2. Chen Mouan, the safety officer of Kuntai Company, did not perform the duties of safety production management personnel in place, and did not carefully check the safety production situation of the unit. Before the concrete pouring operation, the steel wire rope involved was inspected, but no hidden danger of production safety accident was found that the steel wire rope involved was rusted and did not meet the safety requirements. His behavior violated the provisions of Article 25 (1) (5) of the Safety Production Law of the People's Republic of China, and he should be responsible for the management of the accident. It is suggested that the Emergency Management Bureau of Baoan District of Shenzhen should deal with it according to law.

3. Jiang Mouqiang, the project manager of China Railway Construction Engineering South China Company, failed to perform his duties of safety production management, failed to supervise and inspect the safety production work of the unit, and failed to discover and eliminate the hidden dangers of production safety accidents at the operation site in time. His behavior violated the provisions of Article 21 (5) of the Safety Production Law of the People's Republic of China, and he should be responsible for the management of the accident. It is suggested that the Emergency Management Bureau of Baoan District of Shenzhen should deal with it according to law.

(4) Suggestions

on administrative penalties for relevant responsible units 1. The site safety management of Kuntai Company is not in place, the safety regulations and regulations are not complied with during the construction process, and the operators operate in violation of regulations; Failure to maintain the steel wire rope involved in the hopper, failure to take technical and management measures to timely detect and eliminate the hidden dangers of production safety accidents in which the steel wire rope involved does not meet the safety requirements and workers operate in violation of regulations. His behavior violated the provisions of Article 47 of the Construction Law of the People's Republic of China [10] and Paragraph 2 of Article 41 of the Production Safety Law of the People's Republic of China, and he should bear the main management responsibility for the accident. It is suggested that the Emergency Management Bureau of Bao'an District of Shenzhen should deal with it according to law.

2. China Railway Construction Engineering South China Company failed to coordinate the safety production work of Kuntai Company in a unified manner, failed to urge Kuntai Company to rectify the safety problems existing on the site, and failed to take technical and management measures to timely detect and eliminate the hidden dangers of production safety accidents on the operation site. His behavior violated the provisions of Article 49, paragraph 2, and Article 41, paragraph 2, of the Safety Production Law of the People's Republic of China, and should be responsible for the accident. It is suggested that the Emergency Management Bureau of Baoan District of Shenzhen should deal with it according to law.

(5) It is suggested that Huaxi Company, the internal processing personnel of the enterprise, is not in place to perform its supervisory duties, and no safety problems concerning the maintenance of the steel wire rope of the hopper involved are found during daily inspection. It is suggested that Huaxi Company should deal with the relevant personnel internally according to the internal regulations, and report the results to the Emergency Management Bureau of Bao'an District of Shenzhen within one month after the approval of the investigation report.
