On November 19, the website of the Yili Prefecture Government of Xinjiang published five typical illegal cases involving the failure of the principal responsible persons and safety production managers to perform their duties in 2025, such as "double penalties in one case", high-risk operations without approval or certification, failure to provide employees with standard labor protection articles, construction without approval, and hidden dangers of major accidents.
Two of the illegal cases involved the building materials industry. The details are as follows:
1. Administrative penalty case
of special operators (working at heights) of a commercial concrete limited liability company in Tekes County who failed to obtain a high-altitude operation certificate [illegal act] On April 2, 2025, the law enforcement officers of the Emergency Management Bureau of Tekes County carried out law enforcement inspection on a commercial concrete limited liability company in Tekes County, Xinjiang. It was found that two on-site high-altitude operators (special operators) of the company had not obtained the high-altitude operation certificate without special safety training and were on duty. According to the second item of Article 3 of the Criteria for Determining the Hidden Dangers of Major Accidents in Industrial and Trade Enterprises, they were judged as the hidden dangers of major accidents.
[Penalties] The above actions of the company violate the provisions of Article 30 of the Safety Production Law of the People's Republic of China. According to Item 7 of Article 97 of the Production Safety Law of the People's Republic of China and the provisions of Article 16.5.1 of the Administrative Penalty Discretion Standard of the Emergency Management System of Xinjiang Uygur Autonomous Region, the company shall be fined 20000 yuan (twenty thousand yuan only) according to law .
2. On May 14,
2025, the law enforcement officers of Zhaosu County Emergency Management Bureau carried out law enforcement inspection on a new building materials development company in Zhaosu County. It was found that the company's outsourcing engineers, Li Mou and Hu Mou, did not wear seat belts and safety helmets to carry out high-altitude welding operations at the top of the factory building about 6 meters from the ground. After further verification, Li did not have a certificate of high-altitude operation; Zhou, a safety production manager, did not carry out safety management on site, stopped and corrected the "three violations" in time, and did not strictly perform his statutory duties.
[Penalties] The above acts of the company violate the provisions of Article 30, paragraph 1, of the Safety Production Law of the People's Republic of China. In accordance with Item 7 of Article 97 of the Production Safety Law of the People's Republic of China and the provisions of Item 26-A of Part II of the Administrative Penalty Discretion Benchmark for Emergency Management, it shall be ordered to make corrections within a time limit and imposed an administrative penalty of RMB 10000 yuan (ten thousand yuan only); In violation of the provisions of Article 25, paragraph 1, paragraph 6, of the Safety Production Law of the People's Republic of China, Zhou Mou, a safety production manager, was ordered to make corrections within a time limit in accordance with Article 96 of the Safety Production Law of the People's Republic of China and the provisions of Part II, paragraph 2-a, of the Administrative Penalty Discretion Benchmark for Emergency Management. An administrative penalty of RMB 10000 yuan (ten thousand yuan only) shall be imposed.
