In 2008, the Circular of the General Office of the State Council on the Issuance of Provisions on the Establishment of Institutions and Staffing in the Main Responsibilities of Ministry of Housing and Urban-Rural Development (No.74 issued by the State Office of the People's Republic of China [2008]) stipulated that the members of the Party Leadership Group and the Ministry of Housing and Urban-Rural Development of Vice-Ministers
of the Ministry of Housing and Urban-Rural Development should be responsible for the main responsibilities of the Party Leadership Group. The main responsibilities of the Ministry of Housing and Urban-Rural Development are:
(1) to assume the responsibility of ensuring the housing of low-income families in cities and towns. To formulate policies related to housing security and guide their implementation. To formulate plans and policies for low-rent housing, work with relevant departments to arrange funds for low-rent housing by the central government, and supervise the implementation of local organizations. To formulate housing security development plans and annual plans and supervise their implementation.
(Two) assume the responsibility of promoting the reform of the housing system. To formulate housing policies suited to national conditions, guide housing construction and housing system reform, formulate national housing construction plans and guide their implementation, and study and put forward policy recommendations on major issues of housing and urban and rural construction.
(3) To assume the responsibility of standardizing the management order of housing and urban and rural construction. Draft laws and regulations on housing and urban and rural construction, and formulate departmental regulations. To organize the formulation and implementation of urban and rural planning according to law, to formulate policies, rules and regulations for urban and rural planning, to organize the formulation of national urban system planning in conjunction with relevant departments, to be responsible for the examination, approval and supervision of the implementation of the overall urban planning and provincial urban system planning assigned by the State Council, to participate in the examination of the outline of the overall land use planning, and to formulate scientific and technological development plans and economic policies for housing and urban and rural construction.
(4) To assume the responsibility of establishing a scientific and standardized standard system for engineering construction. To organize the formulation of national standards for the implementation stage of engineering construction, formulate and promulgate national unified quotas and industry standards for engineering construction, formulate management systems for feasibility study and evaluation methods, economic parameters, construction standards and project cost of construction projects, formulate construction standards for public service facilities (excluding communication facilities) and supervise their implementation. To guide and supervise the implementation of various engineering construction standard quotas and the valuation of engineering cost, and organize the release of engineering cost information.
(Five) assume the responsibility of regulating the order of the real estate market and supervising and managing the real estate market. To formulate and supervise the implementation of real estate market supervision policies in conjunction with or in cooperation with relevant departments, to guide the paid transfer and development and utilization of urban land use rights, and to put forward industrial development plans and industrial policies for the real estate industry. To formulate and supervise the implementation of rules and regulations on real estate development, housing ownership management, housing leasing, housing area management, real estate valuation and brokerage management, property management, housing expropriation and demolition.
(Six) supervise and manage the construction market and standardize the behavior of all parties in the market. To guide national construction activities, organize and implement supervision and law enforcement of bidding activities for housing and municipal engineering projects, formulate laws and regulations for survey and design, construction and construction supervision, supervise and guide their implementation, formulate development strategies, medium and long-term plans, reform plans, industrial policies and regulations for engineering construction, construction industry and survey and design industries, and supervise their implementation. To formulate and supervise the implementation of rules and regulations regulating the behavior of all parties in the construction market, and organize and coordinate construction enterprises to participate in international project contracting and construction labor cooperation.
(7) To study and formulate policies and plans for urban construction and guide their implementation, to guide the construction, safety and emergency management of municipal public facilities, to formulate development plans and policies for national scenic spots and to guide their implementation, to be responsible for the examination, approval, supervision and management of national scenic spots, and to organize and examine the world natural heritage. To examine and verify the declaration of world natural and cultural heritage in conjunction with the competent departments of cultural relics, and to be responsible for the protection, supervision and management of historic and cultural cities (towns and villages) in conjunction with the competent departments of cultural relics.
(8) To assume the responsibility of standardizing the construction of villages and towns and guiding the construction of villages and towns throughout the country. To formulate and guide the implementation of policies for the construction of villages and small towns, to guide the formulation of village and town planning, rural housing construction, safety and renovation of dangerous houses, to guide the improvement of the ecological environment of human settlements in small towns and villages, and to guide the construction of key towns throughout the country.
(Nine) assume the responsibility of quality and safety supervision of construction projects. To formulate and supervise the implementation of policies, rules and regulations on the quality of construction projects, construction safety production and completion acceptance and filing, organize or participate in the investigation and handling of major quality and safety accidents of projects, and formulate and guide the implementation of technical policies for the construction industry and engineering survey and design consulting industry.
(Ten) assume the responsibility of promoting building energy conservation and urban emission reduction. To formulate and supervise the implementation of policies and plans for building energy conservation in conjunction with relevant departments, organize and implement major building energy conservation projects, and promote urban emission reduction.
(11) To be responsible for the supervision and management of the housing provident fund to ensure the effective use and safety of the provident fund. To formulate and organize the implementation of housing provident fund policies and development plans in conjunction with relevant departments, formulate the deposit, use, management and supervision system of housing provident fund, supervise the management, use and safety of national housing provident fund and other housing funds, and manage the information system of housing provident fund.
(Twelve) carry out international exchanges and cooperation in housing and urban and rural construction.
(13) To undertake other tasks assigned by the State Council.
In 2013, the Notice of the Central Editorial Office on the Integration of Real Estate Registration Duties stipulated that "the Ministry of Housing and Urban-Rural Development shall be responsible for formulating and supervising the implementation of housing transaction policies, rules and regulations, guiding and supervising the management of housing property rights, coordinating with the Ministry of Land and Resources to guide housing registration, and building a personal housing information system.". It will no longer assume the responsibility of paid transfer and development and utilization of urban land use rights. In 2019, the Notice of the Central Editorial Office on Revising and Integrating the Documents of Real Estate Registration Duties revised the real estate registration duties of relevant units. Revised, "Ministry of Housing and Urban-Rural Development: responsible for formulating and supervising the implementation of housing transaction policies, rules and regulations, guiding and supervising the management of housing property rights; responsible for the construction of the national real estate market monitoring system.". It will no longer assume the responsibility of paid transfer and development and utilization of urban land use rights.
In 2016, the Central Editorial Office approved the establishment of the Urban Management Supervision Bureau by the Ministry of Housing, Urban and Rural Construction, which agreed with the Ministry of Housing and Urban-Rural Development to "establish the Urban Management Supervision Bureau, which is responsible for formulating polic ies and regulations for urban management law enforcement, guiding the work of urban management law enforcement throughout the country, carrying out the supervision of urban management law enforcement behavior, and establishing the Urban Management Supervision Bureau." To organize and investigate major cases in the field of housing construction in urban and rural areas.
In 2018, the Circular of the General Office of the State Council of the Central Office of the Communist Party of China on the Adjustment of the Establishment of Ministry of Housing and Urban-Rural Development Responsibility Institutions stipulated that "the responsibility of urban and rural planning and management of Ministry of Housing and Urban-Rural Development shall be assigned to the Ministry of Natural Resources", "the responsibility of scenic spots and natural heritage management of Ministry of Housing and Urban-Rural Development shall be assigned to the State Forestry and Grassland Administration", and "the responsibility of urban and rural planning and management of UNK3 shall be assigned to the State Forestry and Grassland Administration". "The responsibility of the Ministry of Public Security to guide the examination of fire protection design for construction projects shall be assigned to the Ministry of Housing and Urban-Rural Development".
