Recently, Henan Province made public the third round of central ecological environment protection supervision and rectification plan. The fifteenth item in the list of rectification tasks attached to the rectification plan for Henan Province to implement the third round of central ecological environment protection supervision report is to add new steel and cement production capacity in violation of regulations. Wherein the cement part is , Xinxiang Huanshan Environmental Protection Technology Company built 5500 tons of cement per day.
The main time nodes of the new 5500 tons/day cement clinker production line project are as follows:
-On December 3 , 2021, the expert group set up a verification team. Xinxiang Zhenxin Cement Co., Ltd. has a 2500t/d new dry process general cement clinker production line, and Henan Century Xinfeng Cement Co., Ltd. has a 3000t/d new dry process general cement clinker production line. The actual situation of the project of relocating from the city and merging the construction of a 5500 t/d new dry process general cement clinker production line was verified and confirmed on the spot. The first conclusion is that the 2500t/d general cement clinker production line of Xinxiang Zhenxin Cement Co., Ltd. and the 3000t/d general cement clinker production line of Henan Century Xinfeng Cement Co., Ltd. are legal and complete; Secondly, the two production lines to be relocated and merged belong to the same actual controlling shareholder of Comrade Wang Ruilin and are located in the same administrative region of Xinxiang City. The two production lines are relocated and merged to form a 5500t/d new dry process general cement clinker production line project. In line with the latest revision of the Ministry of Industry and Information Technology issued the "Cement Glass Industry Capacity Replacement Implementation Measures" (Ministry of Industry and Information Technology original [2021] No.80) and its related "Implementation Measures" policy interpretation of the spirit of the fourth policy provisions " can not formulate capacity replacement plan", do not carry out capacity replacement. 2022, Xinxiang Municipal Bureau of Industry and Information Technology issued a public announcement on the production capacity of the new dry process cement clinker production line of Henan Huanshan Environmental Protection Technology Co., Ltd. with a daily output of 5500 tons and a co-disposal of 100000 tons of fly ash from garbage power generation.
-On April 24 , 2022, according to the request of Xinxiang Bureau of Industry and Information Technology and the confirmation of the specific policy of the Ministry of Industry and Information Technology on the replacement of the construction capacity of the project, the Henan Provincial Department of Industry and Information Technology, In accordance with the relevant provisions of the Detailed Rules for the Implementation of Capacity Replacement in the Cement and Glass Industry of Henan Province (Trial) (YGXC [2021] No.144), the relevant capacity of the co-processing project of the technical transformation and consolidation of the cement clinker production line will be publicized.

2023, the Second Central Eco-environmental Protection Supervision Group carried out the third round of Central Eco-environmental Protection Supervision in Henan Province. When the inspectors entered Huanshan Environmental Protection Technology Co., Ltd., the actual output of the company reached more than 8000 tons per day, exceeding the design capacity by 45%. -On February 27 ,

2024, Henan Provincial Office of Industry and Information Technology announced the "List of Cement Clinker Production Lines in Henan Province in 2023". The list still shows the 2500t/d new dry process cement production line of Xinxiang Zhenxin Cement Co., Ltd. and the 3000t/d new dry process cement production line of Henan Century Xinfeng Cement Co., Ltd. In the remarks column, it is uniformly marked as the project of technical transformation and construction of a new dry process general cement clinker production line with a daily output of 5500 tons to co-dispose of fly ash from garbage power generation. -On July 8 ,
2024, the Henan Provincial Office of Industry and Information Technology, based on the feedback from the third round of central supervision of ecological environment protection, implemented the rectification plan of Henan Province. The announcement on the cancellation of the announcement on the capacity of Henan Huanshan Environmental Protection Technology Co., Ltd. to merge and construct a general cement clinker production line with a daily output of 5500 tons was issued. On October 10 ,
2024, Henan Province made public the third round of central ecological environment protection supervision and rectification plan. New cement production capacity in violation of regulations shall be rectified according to law. Time limit for rectification: before the end of December 2025. Rectification measures: Xinxiang City: Abolish the capacity replacement documents issued by Huixian City and Weihui City in violation of regulations. Check the actual production capacity of the new 5500 tons/day cement clinker production line of Huanshan Environmental Protection Technology Company in Xinxiang City, and complete the rectification of the over-capacity problem in accordance with the law and regulations by the end of December 2025. Strengthen daily supervision and eliminate overcapacity production. Provincial Department of Industry and Information Technology: First, supervise and guide Xinxiang City to rectify the new cement clinker production capacity in violation of regulations according to law. The second is to conduct a full coverage investigation on the replacement of cement clinker production capacity, find problems and deal with them in time and in accordance with the law. Thirdly, we should strictly standardize the audit and control system of capacity replacement in cement industry, organize special training, strengthen the supervision of capacity replacement projects before and after the event, and prevent enterprises from adding new capacity without authorization.
After sorting out the contents of the rectification of new cement production capacity in violation of regulations, there are several problems that are not well understood.
1. In the preliminary work of the 5500 tons/day environmental protection project around the mountain, The project is in line with the latest revision of the Implementation Measures for Capacity Replacement in the Cement and Glass Industry issued by the Ministry of Industry and Information Technology (the original [2021] No.80 Document of the Ministry of Industry and Information Technology) and the spirit of Article 4 of the relevant Policy Interpretation of the Implementation Measures, which stipulates that "no capacity replacement plan may be formulated" and no capacity replacement is required.
In the announcement of Xinxiang City, there are more detailed explanations, according to the relevant policies and regulations of the "Measures for the Implementation of Capacity Replacement in Cement and Glass Industry" (Ministry of Industry and Information Technology No.2021). The Department of Raw Materials Industry of the Ministry of Industry and Information Technology and the Provincial Department of Industry and Information Technology respectively replied to confirm that "the 2500t/d new dry process general cement clinker production line of Xinxiang Zhenxin Cement Co., Ltd. and the 3000t/d new dry process general cement clinker production line of Henan Century Xinfeng Cement Co., Ltd. If the relocation conditions stipulated in the Measures are met, the capacity replacement plan may not be formulated in accordance with the provisions of the Measures, but the relocation situation of the project shall be publicized and announced, and the supervision shall be accepted on its own initiative.
Each superior competent department has a reply of "no capacity replacement plan", as long as it is publicized. To weaken the reduction substitution into equivalent substitution, we have to ask whether the applicable provisions of the relevant replacement policies are rigorous, so that they are out of shape in the implementation? From November to December 2023, when the inspectors were stationed, it was found that the actual output had reached more than 8000 tons per day, and the project should have been put into operation as early as the third quarter or before. But why is it that until April 2024, in the "List of Cement Clinker Production Lines in Henan Province in 2023", there is no environmental protection around Huocha Village, which is still two projects of Mengfen Village and Jishui Town in Mengzhuang Town before the relocation and merger of the city. In the remarks, it is also said that the technical transformation will be merged to build a new dry process general cement clinker production line with a daily output of 5500 tons to co-dispose of waste power generation fly ash project? I have to ask if the new project was shut down before it was ignited and put into production?
3. In July 2024, the Provincial Office of Industry and Information Technology cancelled the announcement on the capacity of Henan Huanshan Environmental Protection Technology Co., Ltd. to merge and construct a general cement clinker production line with a daily output of 5500 tons, that is, the project capacity replacement document was abolished, and the original capacity replacement was not counted. Where is the capacity replacement that should be replaced? Before the implementation of the new alternative capacity replacement scheme, should the production line stop production according to the "Measures for the Implementation of Capacity Replacement in Cement and Glass Industry (2021 Edition)" which stipulates that "no ignition and production shall be carried out before the rectification is in place"? But what measures should be taken before the rectification is in place? In August 2018, the Ministry of Industry and Information Technology and the National Development and Reform Commission jointly issued the Notice on Serious Capacity Replacement and Strict Prohibition of New Capacity in Cement Flat Glass Industry, which pointed out that areas with serious problems such as lax auditing and inadequate supervision and implementation would be notified to the whole country as negative examples. Individuals who have committed dereliction of duty or dereliction of duty in the work of checking and supervising the implementation of the capacity replacement scheme will be submitted to the relevant departments for investigation of relevant responsibilities in accordance with the law and discipline.
In the provincial "Rectification Plan", the "three do not let go" (do not let go if the problem is not solved, do not let go if the responsibility is not fulfilled, and do not let go if the masses are not satisfied). Where is the responsibility of the relevant personnel in the rectification measures? The rectification plan should be linked up to ensure that it can be implemented, inspected, assessed and accountable.
