Chapter I General Provisions

Article 1 In order to protect and improve the atmospheric environment, prevent and control atmospheric pollution, safeguard public health, promote the construction of ecological civilization, and promote sustainable economic and social development, These Regulations are formulated in accordance with the Environmental Protection Law of the People's Republic of China, the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution and the relevant laws and regulations of the State, and in light of the actual situation of the autonomous region. Article

2 These Regulations shall apply to the prevention and control of air pollution within the administrative region of the autonomous region. Where provisions have been made in the superior law, such provisions shall prevail. Article

3 The prevention and control of atmospheric pollution shall aim at improving the quality of the atmospheric environment and follow the principles of planning first, source control, prevention first, combination of prevention and control, government-led, public participation and responsibility for damage. Article

4 The people's governments at or above the county level shall incorporate the prevention and control of air pollution into the national economic and social development plan, transform the mode of economic development, adjust and optimize the industrial structure, energy structure, transport structure and land use structure, transform and upgrade traditional industries, vigorously develop new industries and promote the transformation of new and old kinetic energy. Article

5 The autonomous region shall develop a modern energy economy, adhere to the comprehensive utilization of coal, electricity, oil, gas, wind and light, build a safe, green, intensive, circular and efficient clean energy supply system, and protect and improve the atmospheric environment. Article

6 The people's governments at or above the county level shall increase their financial input in the prevention and control of air pollution, and give preferential policies such as tax and fee relief, financial subsidies and financial discounts to enterprises, institutions and other producers and operators that carry out technological transformation and clean energy substitution. The

seventh is to implement the total emission of key atmospheric pollutants and the control system of atmospheric environmental quality. In combination with the level of economic and social development, environmental quality and industrial structure, the people's government of the

9 The competent departments of ecological environment of the people's governments at or above the county level shall exercise unified supervision and management over the prevention and control of air pollution, while other relevant departments shall exercise supervision and management over the prevention and control of air pollution within their respective responsibilities. Article

10 The competent department of ecological environment of the people's government of the autonomous region shall establish and improve the database of environmental credit management and the mechanism of incentive and punishment for environmental trustworthiness, and incorporate it into a unified social credit system. The competent departments of ecological environment of the people's governments at or above the

county level and other departments responsible for the supervision and management of the prevention and control of atmospheric pollution shall, in accordance with the law, publicize information on the quality of the atmospheric environment, monitoring data of the atmospheric environment, sudden atmospheric environmental incidents, administrative licensing of the atmospheric environment and administrative penalties. Article

11 To carry out the medium and long-term trend prediction of air quality, improve the regional joint early warning mechanism for heavily polluted weather, timely release the forecast information of heavily polluted weather, and realize the sharing and online release of forecast information throughout the region.

The League Administrative Office and the municipal people's governments with districts uniformly issued warning information on a wide range of heavily polluted weather, and the relevant cities initiated emergency response measures according to the warning level. Emergency measures such as ordering relevant enterprises to stop production or limit production, restricting the driving of some motor vehicles, stopping earthwork and demolition of buildings at construction sites, stopping outdoor activities organized by kindergartens and schools, and organizing weather modification operations may be taken according to emergency needs. Article

12 The competent department of ecological environment of the people's government of the autonomous region shall, in accordance with the main functional zoning, the status of regional atmospheric environmental quality and the law of transmission and diffusion of atmospheric pollution, delimit the key areas for the prevention and control of atmospheric pollution in the autonomous region, and coordinate the joint prevention and control of atmospheric pollution in the key areas as a whole. Article

13 All units and individuals have the right and obligation to protect the atmospheric environment, and have the right to report and prosecute acts that pollute the atmospheric environment and acts of air pollution supervision and management departments and their staff members that fail to perform their duties according to law. Chapter

II Prevention and Control

of Industrial Pollution Article 14 Increase the adjustment of regional industrial layout, speed up the technological upgrading and transformation of enterprises, promote the discharge of industrial pollution sources up to the standard, and vigorously develop circular economy.

The League Administrative Office and the municipal people's governments with districts shall formulate plans to complete the relocation or transformation of high-energy-consuming and high-emission enterprises located in urban built-up areas, such as iron and steel, petroleum, chemical industry, non-ferrous metals, metallurgy, cement and pharmaceuticals, within a time limit. Article

15 Units that discharge pollutants shall adopt cleaner production technologies, processes and equipment that are efficient in the utilization of energy and raw materials and in the discharge of pollutants, so as to reduce the generation and discharge of atmospheric pollutants. Pollutant discharge units

are encouraged to give priority to the adoption of advanced technologies in the same industry, improve production standards and requirements, and achieve ultra-low emission standards for air pollutants. Article

16 Units discharging dust, sulfides and nitrogen oxides in the production process shall build supporting devices for dust removal, desulfurization and denitrification, or adopt other measures to control the discharge of atmospheric pollutants, such as technical transformation. Article

17 Units discharging industrial waste gases or toxic and harmful atmospheric pollutants shall, in accordance with the relevant provisions and monitoring norms of the State, monitor the discharge of atmospheric pollutants by themselves or by entrusting qualified monitoring institutions, record and preserve monitoring data, ensure the authenticity and reliability of monitoring data, and report to the State. It is also open to the public through websites or other ways that are easy for the public to know. The storage time of monitoring data shall not be less than five years. Article

18 Units that discharge pollutants into the atmosphere shall, in accordance with the provisions of the State, set up atmospheric pollutant discharge outlets and their signs. Article

19 The people's governments at or above the county level shall strictly control the construction, reconstruction and expansion of industrial construction projects that discharge malodor. Units that have built chemical industry and biological fermentation to discharge odorous pollutants shall adopt advanced technologies, processes and equipment within the time limit prescribed by the competent department of ecological environment to reduce the discharge of odorous pollutants and meet the national standards. Article

20 The guidance catalogue for the adjustment of industrial structure of the state and autonomous regions shall be strictly implemented, and producers and operators shall eliminate the production processes, equipment and products listed in the catalogue within the prescribed time limit.

The manufacturer, importer, seller or user shall stop the production, import, sale or use of the equipment and products listed in the catalogue specified in the preceding paragraph within the prescribed time limit; the adopter of the technology shall stop the adoption of the technology listed in the catalogue specified in the preceding paragraph within the prescribed time limit.

The obsolete equipment and products shall not be transferred to others for use. Article

21 The people's government of the autonomous region shall implement a double control system for the total amount and concentration limits of fluoride emissions for key pollutant discharge units that discharge air pollutants containing fluoride. Article

22 The people's governments at or above the county level shall publish the list of production enterprises that stop production, limit production and limit emissions during the period of heavily polluted weather in their respective administrative areas, and the enterprises shall implement emergency emission reduction measures to all technological links, specific production lines and responsible persons. During the warning period of

heavy pollution weather, key vehicle enterprises involved in the transportation of bulk raw materials and products, such as iron and steel, coking, non-ferrous metals, coal and ore, will be transported in different periods. Chapter

III prevention and control

of coal pollution Article 23 People's governments at all levels shall take measures to optimize the use of coal, promote the clean production and efficient utilization of coal, gradually reduce the proportion of coal in primary energy consumption, and reduce the emission of atmospheric pollutants in the process of coal production, transportation, use and conversion. Article

24 Open-pit coal mines shall harden transport roads, take dust-proof measures such as fog guns and sprinkling water for mining operations, add dust-proof covers to conveyor belts above and below pits, and take closed measures to crush coal. Article

25 People's governments at or above the county level shall adopt economic and technical measures conducive to the clean utilization of coal and energy conversion, and encourage the comprehensive utilization of coalbed methane, coal gangue, fly ash and slag resources. The people's governments at or above

the county level shall strengthen the control of spontaneous combustion of coal gangue and coal fields, and shall be responsible for the fire extinguishing of ownerless ignition points. Article

26 Vehicles transporting coal shall take sealing or other measures to prevent coal dust pollution caused by the scattering of materials, and shall travel in accordance with the prescribed routes. Coal dust pollution shall be prevented and controlled by means of sealing or spraying when loading and unloading coal. Article

27 The storage of coal, coal gangue, coal cinder, coal ash and other materials that are likely to produce coal dust shall be sealed; if it cannot be sealed, a tight enclosure not lower than height of the stack shall be set up, and effective covering measures shall be taken to prevent and control coal dust pollution. Article

28 Coal-burning units shall adopt cleaner production processes, build supporting devices for dust removal, desulfurization and denitrification, or take other measures to control the emission of atmospheric pollutants, such as technical transformation, so as to achieve the emission standards. Coal-fired power plants should achieve ultra-low emissions. Article

29 The people's governments at or above the county level may delimit and promulgate the no-combustion zones for highly polluting fuels, and gradually expand the scope of the no-combustion zones for highly polluting fuels in accordance with the requirements for improving the quality of the atmospheric environment.

In the no-combustion zone, it is forbidden to sell or burn highly polluting fuels. It is forbidden to build or expand facilities that burn highly polluting fuels; those that have been built shall be converted to natural gas, liquefied petroleum gas, electricity or other clean energy within the time limit prescribed by the people's government at or above the county level. Article

30 People's governments at all levels shall strengthen the management of civil bulk coal, implement grid management of coal sales and use, and implement source control, dynamic supervision and classified rectification. Article

31 It is forbidden to sell coal that does not meet the quality standards for civil bulk coal. People's governments

at all levels shall strengthen supervision and inspection of coal sales outlets and bulk coal transportation, ban inferior coal sales outlets according to law, and investigate and punish illegal transportation and direct delivery of bulk coal. Chapter

IV Prevention and Control

of Motor Vehicle Pollution Article 32 People's governments at or above the county level shall develop public transport, increase the share of public transport trips, strengthen the construction of urban pedestrian and bicycle transport systems, and guide the public to travel green and low-carbon. Article

33 The people's governments at or above the county level may provide financial, tax and government procurement support to the autonomous region in promoting new energy motor vehicles and speeding up the construction of infrastructure such as charging stations (piles) and gas filling stations. Article

34 Without affecting the normal traffic of motor vehicles, the competent department of ecological environment of the people's government at or above the county level may supervise and sample the emission of atmospheric pollutants from motor vehicles running on roads by means of remote sensing monitoring and other technical means, with the cooperation of the traffic administration department of the public security organ. Article

35 The atmospheric pollutants discharged by motor vehicles in use shall conform to the emission standards implemented in their localities.

In-use motor vehicles that discharge atmospheric pollutants in excess of the standards shall be repaired; those whose atmospheric pollutants discharge still fails to meet the national emission standards for in-use motor vehicles after repair or adoption of pollution control technology shall be compulsorily scrapped. Article

36 The people's government of the autonomous region shall formulate a special plan for the structural adjustment of freight transport, speed up the construction of special railway lines for key enterprises such as coal, thermal power and iron and steel, and increase the proportion of railway transport. Article

37 The people's governments at or above the county level shall comprehensively control the excessive emission of diesel trucks. If a diesel vehicle

in use is not equipped with a pollution control device or the pollution control device does not meet the requirements and fails to meet the emission standards, it shall install or replace a pollution control device that meets the requirements. Chapter

V Prevention and Control

of Dust Pollution Article 38 When signing a construction contract between a construction unit and a construction unit, the responsibility of the construction unit for the prevention and control of dust pollution shall be clearly defined, and the cost of the prevention and control of dust pollution shall be included in the project budget. Where dust pollution is caused by activities such as

housing construction, municipal infrastructure construction, building demolition and river regulation, the construction unit shall, in accordance with the regulations, file the operation time, operation site, types of dust pollutants discharged and their prevention and control measures with the local competent authorities responsible for supervision and management of dust pollution prevention and control. Continuous and airtight enclosures shall be set up around

construction sites in accordance with relevant regulations;

Dust-reduction measures such as hardening shall be taken for the ground of construction sites and vehicular roads;

(3) Dust suppression measures such as watering shall be taken during the construction of earthworks that are prone to dust;

(4) If construction waste and engineering dregs fail to be cleared and transported within 48 hours, temporary stacking yards shall be set up in the construction site and dust-proof measures such as covering shall be taken;

(5) Transport vehicles shall not be driven out of the construction site until the mud is removed and washed clean;

(6) If concrete is needed, ready-mixed concrete shall be used or closed mixing shall be carried out, and corresponding dust control measures shall be taken, and on-site open-air mixing shall be prohibited;

(7) Closure measures shall be taken for powdery material yards stacked in construction sites, and dust-prone materials such as other engineering materials, sand and gravel, and earthwork shall be covered with dust-proof nets or dust-proof cloth. Article

40 In addition to the provisions of Article 39 of these Regulations, road and pipeline construction shall also comply with the following dust-proof provisions:

(1) Construction machinery shall take measures such as sprinkling water when excavating, loading, stacking, cutting and crushing the road surface;

(2) Measures such as tamping, sprinkling and covering shall be taken for the backfilled trenches;

(3) When a pneumatic drill is used to dig the ground or to clean the construction site, water shall be sprinkled on the ground. Article

41 Road cleaning operations shall comply with the following dust-proof provisions:

(1) Main urban roads, squares, parking lots and other public places shall be cleaned by mechanized cleaning and other low-dust operation methods;

(2) If the road is cleaned manually, it shall conform to the operation specifications of city appearance and environmental sanitation;

(3) If the road surface is damaged, dust-proof measures shall be taken to repair it in time;

(4) The sludge from the sewer pipe shall be cleared and transported on the same day, and shall not be piled up on the road. Article

42 The construction and maintenance of street trees in cities and towns shall comply with the following dust-proof provisions:

(1) When planting street trees, if the dug tree holes cannot be planted in time, dust-proof measures such as covering the tree holes and planting soil shall be taken;

(2) After the planting of street trees, the remaining soil and other materials shall be cleared and transported on the same day; if the clearing and transportation cannot be completed, they shall be covered;

(3) The bare soil under the street trees shall be afforested or paved with permeable materials;

(4) During the warning period of dust pollution weather such as gale and haze, operations such as land leveling, soil replacement and original soil screening shall be stopped. Chapter

VI Prevention and Control

of Heating Pollution Article 43 People's governments at or above the county level shall make overall plans for urban construction, give priority to the development of centralized heating based on cogeneration of heat and power, and promote the use of clean energy sources such as wind, solar, biomass, natural gas and geothermal energy to replace decentralized coal-fired heating. Article

44 People's governments at or above the county level shall promote the transformation of urban villages and shanty towns, incorporate the decentralized coal-fired boiler heating areas that should be eliminated into the coverage of the central heating network, and gradually increase the proportion of central heating. Article

45 In the area covered by the gas pipeline network and the central heating pipeline network, it is not allowed to build, rebuild or expand the central heating facilities that burn coal, heavy oil or residual oil in a decentralized manner; the built central heating facilities that fail to meet the discharge standards shall be dismantled within the prescribed time limit. Article

46 In areas not covered by the central heating network, the use of new and clean energy for heating shall be promoted, or high-efficiency, energy-saving and environment-friendly boilers shall be used, and the original boilers shall be upgraded and transformed. Article

47 People's governments at all levels shall take measures to promote clean heating in urban-rural fringe areas and rural pastoral areas, combine cooking, breeding and greenhouse energy use with clean heating in rural pastoral areas, and make full use of biomass, biogas, solar energy, canned natural gas, electricity and other clean energy sources for heating. We will increase financial subsidies for projects such as coal-to-gas, coal-to-electricity and biomass energy substitution, gradually reduce the use of coal and reduce air pollutant emissions. Article

48 People's governments at all levels shall establish and improve clean coal production and distribution systems and marketing networks, promote and use high-quality coal, clean briquette and energy-saving and environment-friendly stoves, and ensure supply. Chapter

VII Prevention and Control

of Straw Burning Pollution Article 49 Organizations and individuals engaged in agricultural production and operation shall properly dispose of crop straw and prohibit open-air burning of crop straw. Article

50 People's governments at all levels and their relevant departments shall encourage and support the adoption of advanced and applicable technologies for the comprehensive utilization of straw as fertilizer, feed, energy, industrial raw materials and edible fungi, and increase financial subsidies for the integration of straw returning and collection of agricultural machinery. Article

51 The people's governments at the banner and county levels shall organize the establishment of a service system for the collection, storage, transportation and comprehensive utilization of straw, and adopt financial subsidies and other measures to support collective economic organizations, farmers'specialized cooperative economic organizations and enterprises in rural and pastoral areas to carry out the collection, storage, transportation and comprehensive utilization of straw. Article

52 People's governments at all levels and their relevant departments shall strengthen the publicity and education on the prohibition of open-air burning of crop straw. Radio, television, newspapers and periodicals, the Internet and other media shall play the role of public opinion guidance and supervision, and organize and carry out public welfare publicity activities on the prohibition of open-air burning of crop straw. Article

53 The people's governments at the county level shall organize departments of ecological environment, agriculture and township people's governments to inspect the work of prohibiting open-air burning of crop straw and strengthen supervision and management during spring ploughing and autumn harvest. Article

54 The Gacha Villagers'Committee shall establish a supervisory responsibility system, incorporate the prohibition of open-air burning of crop straw into the village rules and regulations, implement grid management of Gacha Village, and promptly detect, report and dispose of illegal acts of straw burning. Chapter

VIII Prevention and Control

of Sand and Dust Pollution Article 55 People's governments at all levels shall promote the ecological protection and restoration of mountains, rivers, forests, fields, lakes and grasses, strengthen the planting of trees and grass, increase the area of green space and water areas, prevent and control land desertification, and protect and improve the quality of the atmospheric environment. Article

56 People's governments at all levels shall implement the system of forbidding grazing, resting grazing and balancing grassland and livestock, accelerate the delimitation and protection of basic grasslands, intensify efforts to return grazing to grassland, and implement the policy of subsidizing and rewarding grassland ecological protection. Grasslands that have become degraded or desertified shall be brought under control within a time limit. Article

57 The principle of joint participation of the government, enterprises and individuals shall be adhered to in the control of desertified land, and the desert control methods of government policy support, enterprise industrialization investment, market-oriented participation of farmers and herdsmen, and sustainable technological innovation shall be promoted. Article

58 The people's government at all levels shall carry out classified protection, comprehensive treatment and rational utilization of the desertified land according to the geographical location, land type, vegetation status, climate and water resources status, degree of land desertification and other natural conditions and their ecological and economic functions. Article

59 The control of desertified land shall adhere to the combination of biological measures and engineering measures, and take measures such as returning farmland to forests, returning grazing to grasslands, closing sand to facilitate afforestation and grassland, building shelter forests, comprehensive control of small watersheds and rational allocation of ecological water according to local conditions, so as to restore and increase vegetation. Article

60 People's governments at all levels shall, on the basis of effective control of desertified land, vigorously develop characteristic industries in sandy areas, adjust the industrial structure of sandy areas, develop biomass energy such as solar energy, wind energy and biogas, and reduce the dependence of life in sandy areas on vegetation resources. Chapter

IX Prevention and Control

of Other Pollution Article 61 Implementation of Green Mine Construction. Newly established mines shall implement the green mine construction standards, and existing production mines shall meet the green mine construction standards within a time limit.

For open-pit mines that have been mined, measures such as slope restoration, soil improvement and plant planting should be taken in time to carry out ecological greening according to the actual situation of the mines. The

sixty-second is to strengthen the control of ammonia emissions from agricultural sources, gradually reduce the use of chemical fertilizers and pesticides, and increase the use of organic fertilizers. Strengthen the harmless treatment and comprehensive utilization of livestock and poultry manure. Article

63 It is forbidden to burn in the open air asphalt, asphalt felt, rubber, plastics, leather, garbage and other materials that may produce toxic or harmful smoke or dust or malodorous gases; if it is really necessary to burn them, special incinerators shall be used. Article

64 Operators of catering services that discharge lampblack shall install lampblack purification facilities and maintain normal use, or take other lampblack purification measures to make lampblack discharge up to the standard and prevent pollution to the normal living environment of nearby residents.

It is forbidden to build, rebuild or expand catering service projects that produce lampblack, odor and exhaust gas in residential buildings, commercial and residential complex buildings without special flues and commercial floors adjacent to residential floors. Article

65 No unit or individual may barbecue food in the open air in areas prohibited by the local people's government or provide sites for barbecue food in the open air.

The sixty-sixth prohibits the production, sale and discharge of fireworks and firecrackers that do not meet the quality standards. No unit or individual may set off fireworks and firecrackers in the time and area prohibited by the local people's government. The

sixty-seventh article encourages and advocates civilized, green and ecological sacrifices. Chapter

10 Legal Liability

Article 68 Whoever, in violation of the provisions of these Regulations, fails to set up air pollutant discharge outlet signs in accordance with the provisions shall be ordered to make corrections by the competent department of ecological environment of the people's government at or above the county level, and shall be fined not less than 5000 yuan but not more than 10000 yuan. Article

69 Where, in violation of the provisions of these Regulations, an established unit discharging malodorous pollutants, such as chemical industry and biological fermentation, fails to meet the national standards within the prescribed time limit, the competent department of ecological environment of the people's government at or above the county level shall order it to make corrections and impose a fine of not less than 10,000 yuan but not more than 100,000 yuan; if it refuses to make corrections, it shall be ordered to suspend business for rectification or close down.Article

70 Whoever, in violation of the provisions of these Regulations, discharges air pollutants from fluorides exceeding the control targets of total discharge and discharge concentration limits shall be ordered by the competent department of ecological environment of the people's government at or above the county level to make corrections or restrict production or stop production for rectification, and shall be fined not less than 100000 yuan but not more than 1 million yuan; If the circumstances are serious, it shall be reported to the people's government with the power of approval for approval and ordered to suspend business for rectification or closure. Article

71 If, in violation of the provisions of these Regulations, an enterprise refuses to implement emergency measures for heavily polluted weather, such as production suspension, production restriction, emission restriction and time-sharing transportation, the supervisory and administrative department designated by the people's government at or above the county level shall impose a fine of not less than 10000 yuan but not more than 100000 yuan. Article

72 Where, in violation of the provisions of these Regulations, no corresponding dust-proof measures are taken in the construction of construction projects, roads and pipelines, and the construction and maintenance of street trees in cities and towns, the competent housing and urban-rural construction departments or other competent departments of the people's governments at the county level shall order them to make corrections within a time limit and impose a fine of 10000 yuan; if the circumstances are serious, a fine of 50000 yuan shall be imposed; If the circumstances are serious, a fine of 100,000 yuan shall be imposed; if no correction is made within the time limit, the work shall be ordered to be stopped for rectification. Article

73 If the people's governments at all levels, the competent departments of ecological environment of the people's governments at or above the county level and other departments responsible for the supervision and management of atmospheric environmental protection and their staff abuse their powers, neglect their duties, engage in malpractices for personal gain or practice fraud, they shall be punished according to law; if a crime is constituted, they shall be investigated for criminal responsibility according to law. Chapter

11 Supplementary Provisions

Article 74 These Regulations shall come into force on March 1, 2019.

The League Administrative Office and the municipal people's governments with districts shall formulate plans to complete the relocation or transformation of high-energy-consuming and high-emission enterprises located in urban built-up areas, such as iron and steel, petroleum, chemical industry, non-ferrous metals, metallurgy, cement and pharmaceuticals, within a time limit. These Regulations shall come into force on March 1, 2019.
