The number of participants in the case reached 29, with a total sales amount of more than 1 million yuan.
Judicial investigation found that from October 2019 to February 2021, Zhang Mou and Pang Mou and Yang Mou crossed the gang, many illegal mining, illegal profits of more than 1 million yuan. Ye Chunhua, chief judge of
the Luoma Lake Basin Environmental Resources Court, said: "The parties involved have formed a gang of illegal mining, including sand mining, providing locations, keeping watch, and coordinating relations, including the transportation and sale of sand to form a coordinated model.". The area includes more than 10 places in many townships in Xinyi, with more than 20 times of participation, which has caused great damage to the ecological environment.
Because of the serious damage to the ecological environment, the case not only brought criminal proceedings, but also the relevant departments brought civil public interest litigation against the parties, requiring them to restore the damaged ecological environment resources. Yang Mou-mou was called "Guerrilla Yang" by the local people, and his mining sites formed large and small "chicken nest ponds" with a depth of about 5 meters, which buried certain potential safety hazards to the surrounding viaducts and other facilities. Ye Chunhua, president of
the Luoma Lake Basin Environmental Resources Court, said: "Because he uses excavators to mine placer mines, he not only destroys the country's mineral resources, but also endangers the ecological environment, including public safety, as well as certain security risks."
Mineral resources are non-renewable resources, and their reserves are limited. In this case, 6 of the 29 people, knowing that the placer mine was stolen, still bought it, and were also punished by law. Ye Chunhua, president of
the Luoma Lake Basin Environmental Resources Court, said: "The amount they purchased is not up to the standard of criminal responsibility. As the defendant of the incidental civil action, they filed a lawsuit. Some parties may say that you only buy several thousand yuan or tens of thousands of yuan of sand and gravel, but he has to file a joint and several liability for the hundreds of thousands of yuan of ecological restoration costs." He needs to take the corresponding responsibility.
In addition, this case also involves the staff of relevant departments who turn a blind eye to illegal mining through the convenience of their positions, or even collect benefit fees. They will be punished by law, and this case will also be sentenced at a later date. Ye Chunhua, chief judge of
the Luoma Lake Basin Environmental Resources Court, said: "If the value of mineral products in the prohibited mining area reaches more than 50,000 yuan, it will reach a standard of criminal responsibility investigation. If it reaches more than 250,000 yuan, the law stipulates more than three years'imprisonment." It is the duty of every citizen to
protect the natural resources and ecological integrity. We must not destroy the ecological environment for the sake of profit. We also hope that the relevant departments will actively supervise and not be careless.
