In order to effectively maintain the order of river and lake management and jointly safeguard national water security, recently, Puyang Water Conservancy Bureau, Municipal Intermediate People's Court, Municipal People's Procuratorate, Municipal Public Security Bureau and Municipal Judicial Bureau jointly issued a circular, deciding to organize and carry out special law enforcement actions for river and lake safety protection throughout the city.
This special law enforcement action will last for half a year, which will be divided into five stages: mobilization and deployment, investigation of illegal clues, investigation of cases, supervision and inspection, and summary and promotion, focusing mainly on the key areas and key links of river and lake safety protection, aiming at strengthening the cooperation between the municipal water conservancy departments and judicial organs, procuratorial organs, public security organs and judicial administrative organs. To crack down on water violations and crimes in the fields of encroachment on rivers and lakes, obstruction of flood safety, destruction of water projects, illegal sand mining, illegal water intake and man-made soil erosion according to law, and to enhance the joint efforts of the five departments to form a high-pressure situation of severely cracking down on water violations and crimes, and to file, investigate and expose a number of typical violations. We will comprehensively strengthen the connection between water administrative law enforcement and criminal justice, cooperate with procuratorial public interest litigation, and further promote the effectiveness of laws and regulations such as water law, flood control law, soil and water conservation law, and the Yellow River protection law.
Water conservancy departments will work with relevant departments to formulate local special law enforcement action plans, organize and coordinate the work of various departments, be specifically responsible for the comprehensive investigation of the problem clues in key task areas, investigate and deal with water violations according to law, transfer the problem clues in time and provide water conservancy professional technical support according to needs.
Judicial organs will strengthen coordination and communication with water conservancy departments, give guidance on the application of law to major difficult and complex water violations, try water-related violations in key areas according to law, accept cases in time to improve the efficiency of examination and execution, and timely release typical water cases or guiding cases.
The procuratorial organs will focus on the order of water affairs in the region, strengthen consultation and judgment with the water conservancy departments, supervise the transfer of clues to the water conservancy departments and relevant comprehensive law enforcement agencies, jointly list with the water conservancy departments, examine and prosecute the suspected criminal cases transferred by the public security organs, and actively use the procuratorial suggestions before the prosecution. To urge the relevant administrative organs to correct themselves and perform their duties correctly.
Public security organs will strengthen the provention and control of social security patrols in flood season, accept suspected water cases transferred by water conservancy departments and relevant comprehensive law enforcement agencies according to law, crack down on crimes endangering the safety of rivers and lakes according to law, and seriously investigate and punish violent resistance to the law and obstruction of law enforcement personnel from performing their duties according to law.
Judicial administrative organs and water conservancy departments will jointly carry out administrative law enforcement supervision, guide administrative law enforcement agencies exercising the power of water administrative punishment to further strengthen administrative law enforcement around key task areas, strictly investigate and deal with water violations, and promote strict, standardized, fair and civilized law enforcement.
