On November 6, the Guangdong Provincial Energy Bureau issued the "Notice on the Work Program for the Special Regulation of Improper Market Intervention in the Development of New Energy and Pumped Storage Energy in the Province", which calls for the implementation of the central government's plan to speed up the construction of a unified national market and optimize the business environment. Efforts should be made to eliminate various forms of local protection and market segmentation in the field of new energy and pumped storage development, clean up various practices that hinder the unification of the market and fair competition, such as affecting production and operation costs and production and operation behavior, and carry out improper market intervention in the field of new energy and pumped storage development in the whole province in accordance with the requirements of Guoneng Zongtong Xinneng [2023] No.106. The
work plan is as follows:
I. General Requirements
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will thoroughly implement the spirit of the 20th National Congress of the Communist Party of China, strive to promote high-quality development in the fields of new energy and pumped storage, and adhere to problem-oriented and goal-oriented approaches. To rectify the problem of strong improper market intervention reflected by a number of business entities, we should focus on rectifying the compulsory requirements for the development of wind power, photovoltaic and pumped storage projects, such as industrial matching and investment landing, and on this basis, we should thoroughly find out the shortcomings and weaknesses at the level of system and mechanism. Create a standardized, efficient, fair competition and fully open market development environment.
2. Focus
on the wind power, photovoltaic and pumped storage development projects organized and implemented in our province since January 1, 2023. Check whether there is improper market intervention in the whole process of signing the development intention agreement, compiling the market-oriented allocation plan of project investment, organizing and implementing the market-oriented allocation project development process and project development and construction. Focus on rectifying the following problems:
(1) Governments at all levels or relevant competent departments , through the issuance of documents and other forms, impose mandatory requirements on supporting industries for new energy power generation and pumped storage projects. In particular, new energy industry chains such as wind turbines, towers, multi-crystalline (monocrystalline) silicon, silicon wafers, batteries and battery components include: First, in relevant documents, it is clear or disguised that the project must support industries or introduce industries; Second, although there is no explicit provision, it is verbally mandatory to require supporting industries, or to give obstacles or obvious discriminatory policies to projects and investors who have not promised supporting industries.
(2) Governments at all levels or relevant competent departments shall compulsorily require investment in new energy power generation and pumped storage projects by issuing documents and other forms . Including: First , enterprises are required to pay high deposits, investment cooperation deposits, project development and construction performance deposits, the introduction of foreign capital ; The second is to obtain or restrict the additional benefits of the project, such as the carbon emission rights generated by the project and the benefits from carbon emissions.
This special rectification mainly focuses on investigating problems, correcting deviations and making up for shortcomings, which will be carried out from the date of issuance of this plan to the end of November 30, 2023. It is jointly carried out at the provincial and municipal levels, among which the province is mainly responsible for the overall coordination of the whole province, and the prefectures and municipalities are specifically responsible for the renovation of wind power, photovoltaic and pumped storage development in their jurisdictions. Focus on the following tasks:
(1) Conduct self-examination and self-correction. According to this work plan, the competent energy departments of prefectures and municipalities should carry out self-examination and self-correction work in an all-round way, refine the specific work plan, and set up columns or other ways on the government (department) portal website to collect clues to problems and organize timely verification. During the special rectification work, our Bureau will collect clues to relevant problems through various channels and transfer them to the relevant municipalities for verification according to their powers.
(2) Implementing rectification requirements. If improper market intervention such as compulsory industrial matching and investment landing is found, rectification shall be carried out in accordance with the principle of "who proposes and who is responsible". For the policy documents that have been issued and found problems, they shall be revised and abolished according to their authority in accordance with the requirements of the Notice of the General Administration of Market Supervision and Other Departments on the Clearance of Policies and Measures that Impede the Unification of the Market and Fair Competition (No.53 issued by the State and Municipal Supervision and Competition Association). For projects that have signed development intention agreements but have not actually been implemented, all localities should stop improper market intervention in a timely manner and amend relevant agreements. For projects that have signed development intention agreements and are being implemented, all localities should consult with development enterprises and properly handle them in accordance with the law and regulations in accordance with the principle of "protecting the interests of enterprises and eliminating waste of investment". If Party members and cadres are found to have clues to violations of Party discipline and state law, they should be transferred to discipline inspection and supervision organs and public security organs in a timely manner, and actively cooperate with relevant departments in their work.
(Three) improve the long-term mechanism. Taking this special renovation as an opportunity, we should solve the problem of improper market intervention strongly reflected by a number of operators in the field of new energy and pumped storage, focus on the county level where the problem is most prominent, intensify the efforts to clean up and renovate, avoid the increase of border clearance, and on the basis of carrying out the special renovation work, improve the working mechanism and strengthen it. We should prevent the rebound of improper market intervention and strive to form a number of fundamental and long-term institutional mechanisms.
This special rectification work has a tight schedule and a heavy task. Please attach great importance to it and carry it out quickly, complete the relevant tasks on time, form a work summary report, and submit it to our Bureau before November 20.
