Recently, Xiamen issued the Regulations on the Management of Sea Sand Resources, which stipulates the supervisory responsibilities and matters involved in the whole process of protection, utilization and licensing of sea sand resources.
The "Regulations on Management" put forward requirements from five aspects:
First, the source "management"
clearly limits the exploitation of sea sand to 52 square kilometers of the sea area at the mouth of Xiamen Bay. Approval documents for environmental impact assessment, mining licenses, certificates of real property rights for the right to use sea areas, and permits for surface and underwater construction operations must be obtained according to law. The surplus sea sand produced by the construction of approved marine projects can only be sold to the outside world after public and paid disposal.
Second, mining "tube"
sea sand mining enterprises need to formulate sea sand mining plans and transportation plans in advance, strictly prohibit mining beyond the scope and time limit, and take the initiative to accept the inspection and supervision of municipal marine comprehensive administrative law enforcement, maritime affairs and marine police. Implement the daily registration system of sea sand mining, designate a special person to fill in the Sea Sand Mining Log, and upload the records to the comprehensive management platform of sea sand on a monthly basis.
Third, the transport "tube"
holds the "Sea Sand Permit" to transport sea sand in the sea area and land area under the jurisdiction of the city, and it is strictly forbidden to transport and transport illegally exploited sea sand. Key projects such as Xiamen New Airport Land Reclamation Project and Conditional Sea Area Ecological Restoration Project can be directly shipped to the project construction site for sand supply upon approval, and barging operations at sea are prohibited. The sea sand that needs to be transported by land is unloaded, sold and transshipped at the distribution center.
Fourthly, the use of sea sand exploited by "tube"
should be controlled and clearly defined in the transfer plan. The surplus sea sand excavated after the completion of the land reclamation project and the construction of the project on the land area can be adjusted and used only after being reported to the municipal government for study.
Fifthly, the "management"
of the system clarifies the supervisory responsibilities of the departments of resource planning, ecological environment, construction, maritime affairs, maritime police and marine comprehensive law enforcement in the whole process of mining, transportation and use of sea sand resources, and the relevant matters to be observed by the mining enterprises. The system of information publicity, bad records and key supervision shall be implemented, and violations of laws and regulations shall be included in the registration of bad records and key supervision. According to the results of "double random, one open" spot check, information sharing of platforms such as comprehensive management of sea sand and abnormal catalogue management will be implemented, and joint punishment will be implemented in accordance with the law and regulations.
