Recently, the Ministry of Emergency Management issued the Guiding Opinions of the Ministry of Emergency Management on Further Strengthening the Work of Safety Production Reporting to regulate the work of reporting and encourage the public to participate in reporting the hidden dangers of major accidents and illegal acts of safety production. With the promulgation of the Guiding Opinions, the Ministry of Emergency Management selected and published five typical cases of safety production reporting from the cases seriously investigated and dealt with in various places.
Case 1: In June 2023, Shanghai Municipal Emergency Management Bureau received a report from the public through the safety production reporting program of the Ministry of Emergency Management, reflecting that an enterprise in Jinshan District forged the "National Safety Production Examination" WeChat public number of the Ministry of Emergency Management, and manufactured and sold counterfeit special operation certificates. According to the relevant procedures, the Shanghai Emergency Management Bureau and the Jinshan Emergency Management Bureau checked the contents of the report, comprehensively judged the suspected criminal acts in the case, and actively coordinated the intervention of the public security organs. Successfully cracked down on a criminal gang that made and sold "fake certificates, fake websites, fake customer service", drained, scored and cashed "one-stop" cross-provincial special operation certificates, destroyed seven counterfeit nests distributed in Shanghai, Guangdong, Guangxi, Shandong, Jiangsu, Hunan and other provinces and cities, captured more than 20 criminal suspect, and closed down counterfeit public numbers and websites. More than 500 fake certificates, bank cards, telephone cards and other items involved in the case were seized at the scene, and more than 6000 sets of fake certificates have been preliminarily verified, involving more than 10 million yuan. At present, the case is under further trial by the public security organs. In October 2023, the
Shanghai Emergency Management Bureau awarded the informant RMB 5000 in accordance with Article 7 of the Measures for Rewarding Safety Production Reporting of the Shanghai Emergency Management Bureau.
Case 2: In August 2023, the Emergency Management Department of Hebei Province received a report submitted by the public through the small program of the Safety Production Report WeChat of the Emergency Management Department, reflecting that a furniture factory in Zhengding County, Shijiazhuang City, had no relevant fire safety equipment and safe passages, and the dry dust removal system did not adopt measures such as explosion venting, inerting and explosion suppression, which had potential safety hazards. According to the relevant procedures, Zhengding County Emergency Management Bureau checked the contents of the report. After investigation, the enterprise has the illegal behavior that the dry dust removal system does not adopt the measures of explosion venting, inerting and explosion suppression. According to the third paragraph of Article 11 of the Criteria for Determining the Hidden Dangers of Major Accidents in Industrial and Trade Enterprises, Zhengding County Emergency Management Bureau ordered the enterprise to suspend production and rectify within a time limit in accordance with the third paragraph of the first paragraph of Article 65 of the Safety Production Law of the People's Republic of China. The enterprise has now cancelled its business license, disconnected the main switch and cleaned up the equipment, raw materials and finished products. If
the informant discovers and reports the hidden danger of production safety accidents of production and business units, the Emergency Management Department of Hebei Province will award the informant RMB 3000 in September 2023 in accordance with the provisions of Item 1 of Part VI of the Reward Standard for Safety Production Reporting (2022 Edition) in the Measures for Safety Production Reporting and Rewards of Hebei Province (Trial Implementation).
Case 3: In July 2023, the Emergency Management Department of Hunan Province received a telephone report from the public that an aquaculture base in Chong Town, Liuyang City, Changsha City, illegally stored fireworks and firecrackers. According to the relevant procedures, the Changsha Emergency Management Bureau and the Liuyang Municipal People's Government immediately organized verification. After investigation, a total of 33,000 pieces of fireworks and firecrackers were illegally stored in the warehouse of the aquaculture base. A fireworks trading company involved in the case stored fireworks and firecrackers outside the storage (retail) place specified in the license. Two fireworks and firecrackers manufacturing companies were suspected of selling fireworks and firecrackers to units or individuals who had not obtained a retail license. In violation of the provisions of Article 23, paragraph 1, and Article 22, paragraph 2, of the Measures for the Implementation of the Business License for Fireworks and Firecrackers, the Changsha Emergency Management Bureau imposed a fine of RMB 30000 on the fireworks trading company in accordance with the provisions of Article 32, paragraph 4, and paragraph 10 of the Measures for the Implementation of the Business License for Fireworks and Firecrackers. The Liuyang Emergency Management Bureau imposed a fine of 30,000 yuan on each of the other two firecracker and fireworks manufacturing companies. Relevant illegal persons involved in the case have been given administrative detention by the public security organs according to law, and have been placed on file for investigation on suspicion of dangerous operations. In September 2023, the Emergency Management Department of
Hunan Province, in accordance with the provisions of Article 8, paragraph 2, of the Measures for the Implementation of Rewarding Reporting in the Field of Safety Production in Hunan Province, awarded the informant a reward of RMB 14000.
Case 4: In March 2023, the Emergency Management Bureau of Jiangyin City, Jiangsu Province received a report from the public through the small program of the Safety Production Report WeChat of the Emergency Management Department, reflecting that some welders of a machinery company in Jiangyin City were working without certificates. According to the relevant procedures, Jiangyin Emergency Management Bureau checked the contents of the report. After investigation, the company's four welding and thermal cutting workers did not hold a special operation certificate to work, law enforcement officers ordered the immediate cessation of related operations, and the enterprise's illegal activities were investigated. In violation of the provisions of Article 30, paragraph 1, of the Safety Production Law of the People's Republic of China, Jiangyin Emergency Management Bureau imposed a fine of 78000 yuan on the enterprise in accordance with the provisions of Article 97, paragraph 7, of the Safety Production Law of the People's Republic of China. In accordance with the provisions of Article 11, paragraph 2, of the Measures for the Implementation of Rewards for Reporting Illegal Acts and Hidden Accidents in the Field of Safety Production in Jiangyin City (Trial Implementation), the Emergency Management Bureau
of Jiangyin City awarded the informant RMB 12000 yuan in May 2023.
Case 5: In February 2023, the Emergency Management Department of Heilongjiang Province received a report from the public through the small program of the Safety Production Report WeChat of the Emergency Management Department, reflecting that a gas station in Daowai District of Harbin City had buried seven gasoline storage tanks. According to the relevant procedures, the Emergency Management Bureau of Daowai District shall check the contents of the report. After investigation, the gas station did not report to the relevant departments for examination and approval in accordance with the regulations, and buried seven underground storage tanks privately. In violation of Paragraph 2, Article 33 of the Production Safety Law of the People's Republic of China, the Emergency Management Bureau of Daowai District imposed a total fine of RMB 130,000 on the unit and its legal person in accordance with Paragraph 2, Article 98 of the Production Safety Law of the People's Republic of China. In accordance with the provisions of Article 14, paragraph 1, of the Measures for Rewarding Reporting in the Field of Safety Production in Heilongjiang Province, the Emergency Management Department of
Heilongjiang Province awarded the informant RMB 20000 in May 2023. The Ministry of
Emergency Management will further intensify its efforts to urge and guide all localities to strictly implement the Guiding Opinions, enhance the enthusiasm of social participation in reporting work, and give full play to the role of social supervision in production safety.
