According to Vietnamese media reports, the US Ministry of Commerce decided to partially revoke anti-dumping and countervailing duty orders against Chinese solar cell products. The Trade Relief Department of the Ministry of
Industry and Trade announced that on June 22, 2023, the Ministry of Commerce (DOC) of the United States issued a decision to revoke some orders imposing anti-dumping and countervailing duties on imports of solar panel products from China since 2012.
Therefore, the products excluded from this tax order are small-sized stand-alone solar panels (with or without an external glass enclosure) with the following characteristics:
total output power of ≤ 200 watts per panel; maximum surface area of 16000 cm2 per panel; No built-in inverter; attached with a handle or packed for transport; equipped with one or more mounting brackets for easy installation or angle adjustment; equipped or packed with a power cord of not less than 3 meters in length connected to an 8 mm diameter power connector.
The decision is the result of a review of changing circumstances at the request of Chinese solar cell manufacturers and exporters.
According to the decision, the U.S. Ministry of Commerce (DOC) will direct the U.S. Customs and Border Protection (CBP) not to impose anti-dumping/countervailing duties on newly imported goods. United States from December 1, 2021 (anti-dumping duties) and January 1, 2021 (countervailing duties).
According to the Trade Relief Administration, the U.S. Ministry of Commerce is currently conducting anti-dumping/countervailing duty evasion investigations on solar cell products imported from Malaysia, Cambodia, Thailand and Vietnam, and reports that the tax orders being implemented are expected to issue final conclusions on August 17, 2023.
As a result, Vietnam's Ministry of Trade Relief said that Vietnamese companies would not be subject to anti-dumping duties if they exported solar panels and small independent solar energy to the United States in the future, as the US Ministry of Commerce (DOC) revoked some of the original tax orders against China.
