Today is the second anniversary of the implementation of the first river basin law in China, the Yangtze River Protection Law of the People's Republic of China. Under the legal escort and the joint action of many departments, the once rampant illegal sand mining industry in the Yangtze River Estuary has gradually disappeared in the whole chain of "mining, transportation and marketing".
The Yangtze River is the mother river of the Chinese nation. The Shanghai section of the Yangtze River is about 181 kilometers long, and the widest part is about 90 kilometers from north to south, including shipping, raw water supply, flood control, pipeline and ecological protection facilities, which play a huge role in the safe operation of Shanghai.
However, driven by economic interests, the mouth of the Yangtze River has become a "gold rush" for some people. In the "cat and mouse game" with law enforcement officers, the illegally refitted "three noes" flat-bottomed boats extend thick pipelines to the bottom of the river, dig indiscriminately and illegally, which seriously endangers the ecological environment, shipping safety and flood safety.
Compared with land law enforcement, water law enforcement is more difficult. In order to evade the law enforcement officers, some illegal sand miners even arranged for small boats to keep watch. Once they found the law enforcement vessels, they immediately tipped off the sand miners and then dispersed. Some illegal sand miners who did not have time to disperse even picked up knives that were originally used to cut cables in an attempt to scare off the law enforcement officers in seemingly unintentional actions.
However, law enforcement officers did not flinch. The law enforcement team of the Municipal Water Bureau introduced that in the middle and late March of 2021, shortly after the implementation of the Yangtze River Protection Law of the People's Republic of China, a joint action group was formed with the public security department to crack down on the illegal sand mining in the Yangtze River Estuary in a chain-like way of "mining, transporting and marketing". In November, the Law Enforcement Team of Shanghai Water Affairs Bureau, the Shanghai Branch of the Yangtze River Shipping Public Security Bureau, the Shanghai Railway Transport Procuratorate and the Shanghai Railway Transport Court signed the Memorandum of Work, established a normalized joint logistics linkage mechanism, and continuously strengthened practical cooperation in joint law enforcement, information notification, emergency response and case consultation.
Taking advantage of the momentum, the law enforcement team of Shanghai Water Bureau has established a joint action mechanism with more brotherly units, a mechanism for linking up the execution of illegal sand mining activities in the Yangtze River and a mechanism for notifying and transferring case clues, which has cracked down on more illegal sand mining parties in more joint actions and effectively curbed the momentum of illegal sand mining in the Yangtze River waters of Shanghai. Since 2021, the law enforcement team has investigated and dealt with 27 cases of illegal sand mining, including 16 criminal cases, made a fine decision of 5.9485 million yuan, completed the confiscation and auction of 14 sand-related vessels, 5 sets of sand mining machines and 9071 tons of river sand, executed a total of 5.231 million yuan for the auction of illegal goods, and completed the dismantling of 7 illegal sand mining vessels.
In accordance with the provisions of laws and regulations such as the Law of the People's Republic of China on the Protection of the Yangtze River, as well as the cooperative mechanism for the disposal of articles involved in the case established with several units of the Public Prosecution Law, the law enforcement team of the Municipal Water Affairs Bureau has also confiscated and dismantled the facilities and equipment involved in the case, such as "three nothingness" ships, in accordance with the law, so as to thoroughly eliminate the basis of "spring breeze blowing again" for illegal sand mining. Water Bureau said that it would continue to deepen law enforcement cooperation, crack down on illegal sand mining and write a new chapter in the protection of the Yangtze River.
