Recently, the revised Regulations on Waterway Management in Chongqing (hereinafter referred to as the Regulations) were adopted by the fourth meeting of the Standing Committee of the Sixth People's Congress of Chongqing and came into effect on January 1, 2024. The person in charge of the Regulations of the Legal Work Committee of the Standing Committee of the Chongqing Municipal People's Congress interpreted the Regulations. The
revised Regulations focus on system construction, deepening reform, division of responsibilities, strengthening coordination and linkage, and supervision and management.
In order to ensure the effective operation of navigation buildings, the Regulations stipulate that the operation units of navigation buildings shall prepare operation plans in accordance with relevant regulations and technical standards to ensure the timely and orderly passage of ships. The operating units of navigation structures shall shorten the time for ships to pass through the lock, improve the efficiency of use, and the waiting time for ships shall not exceed three hours.
"Chongqing and the surrounding provinces and cities have a common desire to build a shipping center in the upper reaches of the Yangtze River by relying on the golden waterway of the Yangtze River." The person in charge said that to this end, a new chapter on "regional cooperation" was added to the Regulations, which clarified the mechanism of communication, coordination and joint dispatch of regional coordinated development of waterways, as well as regional cooperation mechanisms such as coordinated planning of waterways, overall planning of waterway construction timing, coordination of waterway maintenance standards, and strengthening of waterway law enforcement cooperation.
"In the actual work of waterway management in our city, a better department coordination mechanism, urban (county) coordination mechanism and government-enterprise communication mechanism have been formed." The person in charge said that the Regulations have been fully absorbed and sorted out, and the systems of information sharing, emergency coordination, planning cohesion and operation guarantee have been solidified from the legislative level. For example, Article 6 stipulates that departments of transportation, economic information, planning of natural resources, water conservancy, meteorology, hub operation units and navigation building operation units shall share relevant information such as waterway, hydrology, reservoir operation and meteorology.
The Regulations also specify the requirements for the construction of digital waterways, stipulating that the competent traffic authorities, in conjunction with data and other departments, should comprehensively promote the digitalization and intellectualization of waterways, dynamically collect waterway information such as navigation marks and water levels, collect and monitor waterway operation data, and establish waterway elements in accordance with the navigation conditions and the needs of shipping development. Improve the level of waterway service and management.
At the same time, the Regulation stipulates that the sand mining unit or individual shall promptly level and repair the sand mining site involving the waterway and the protection scope of the waterway; the dredged sand produced by the construction and maintenance of the waterway shall be comprehensively utilized and uniformly disposed of by the people's governments of the districts and counties (autonomous counties), except for the self-use of the project.
