The circular pointed out that 31 provinces, autonomous regions, municipalities directly under the Central Government and Sinkiang Production and Construction Corps reported to the Ministry of Housing and Urban-Rural Development the investigation and punishment of illegal and irregular acts such as subcontracting of construction projects in 2022. According to statistics, local housing and urban and rural construction departments have investigated 323 775 projects, involving 249443 of construction units and 272941 of construction enterprises.
The circular made it clear that the competent departments of housing and urban and rural construction in various localities had identified 8518 projects with violations of laws and regulations in the construction market. Among them, there are 527 projects with illegal contracting behavior, accounting for 6.2%; there are 399 projects with subcontracting behavior, accounting for 4.7%; there are 568 projects with illegal subcontracting behavior, accounting for 6.7%; there are 166 projects with affiliation behavior, accounting for 1.9%; There are 6858 projects, accounting for 80.5%, which violate laws and regulations in the construction market, such as starting construction without construction permits. Local housing and urban and rural construction authorities have investigated and dealt with 3157 construction units and 6394 construction enterprises that have violated laws and regulations. Among them, there are 408 enterprises with subcontracting behavior, 597 enterprises with illegal subcontracting behavior, 112 enterprises with affiliation behavior, 84 enterprises with lending qualification behavior, and 5193 enterprises with other illegal behavior.
Local housing and urban and rural construction authorities shall impose administrative penalties or administrative measures on enterprises and personnel who violate laws and regulations, such as suspension of business for rectification, reduction of qualification level, revocation of qualification, order to stop practicing, notification of criticism, confiscation of illegal income, fines and credit punishment. Among them, 445 enterprises were ordered to suspend business for rectification, one enterprise had its qualification level lowered, one enterprise had its qualification revoked, 242 enterprises had their bidding qualifications restricted, and 2,114 enterprises were given a notice of criticism and credit punishment. 32 enterprises were ordered to stop practicing, and 1,173 enterprises were given a notice of criticism; The total amount of illegal income confiscated was 9.6343 million yuan (including 197000 yuan of personal illegal income), and the total amount of fines was 61194 0.49 million yuan (including 32.5517 million yuan of personal fines).
According to the total number of illegal and illegal projects investigated and dealt with, Sichuan, Chongqing, Jiangsu, Jiangxi and Liaoning provinces (cities) have a large number of projects investigated and dealt with, with 1365, 697, 671, 645 and 525 projects investigated and dealt with respectively. Sichuan, Jiangxi, Hubei, Guangdong and Anhui provinces have investigated and dealt with a large number of projects, including 206, 176, 174, 160 and 154, respectively. In terms of the amount of fines, Henan, Jiangxi, Liaoning, Shaanxi and Chongqing provinces (cities) have a large amount of fines, with fines of 72.9165 million yuan, 71.2792 million yuan, 64.355 million yuan, 53.686 million yuan and 46.325 million yuan respectively.
The circular also clarified the requirements for the next step. The competent departments of housing and urban and rural construction at the provincial level should carry out in-depth actions to control the safe production of housing and municipal engineering, strengthen on-site linkage management of the market, severely crack down on illegal and irregular acts in the construction market, increase penalties, and punish enterprises and individuals responsible for quality and safety accidents. Penalties such as fines, suspension of business for rectification, suspension of practice, reduction or revocation of qualifications, revocation of practice qualifications, and non-registration for life shall be imposed according to law. We should strengthen supervision and guidance over the work of municipal and county housing and urban and rural construction authorities, consolidate work responsibilities, further enhance the law enforcement level of front-line personnel, and strengthen daily supervision and inspection of enterprises and projects. Typical cases should be reported in time to avoid "heavy inspection and light punishment" and give full play to the warning and deterrent effect. We should strengthen data verification and control, and earnestly do a good job in investigating and dealing with complaints transferred by Ministry of Housing and Urban-Rural Development, and seriously deal with verified violations of laws and regulations in accordance with the law.
