This year, the first criminal case involving sea sand in Dinghai, Zhejiang, opened a few days ago, which is also the most extensive chain of crackdown and the largest number of prosecutions involving sea sand in Dinghai jurisdiction in recent years.
On the spot, 11 defendant Huang Moumou and others attended the trial, the People's Procuratorate of Dinghai District appointed post prosecutors to attend the court as state prosecutors to support the public prosecution, and 11 defendant and their defenders participated in the court investigation, court debate and other trial links. After investigation, it was found that from August to September 2021, 11 defendant, such as Huang Moumou, transported the sea sand to Zhoushan sea area, knowing that the sea sand transferred and purchased was illegal, and then transported the sea sand to designated sand yards or sold to other sand yards by floating cranes. At the end of September of the same year, the illegal act was seized by the public security department. After examination, the criminal gang illegally transferred and purchased more than 45000 tons of sea sand, with a total value of more than 1.845 million yuan. "Compared with previous sea sand cases, the criminal chain of this case is more extensive, including the" scalpers "who contact the sand dredger, the downstream buyers and the two-way transport sand dredger, and the corresponding criminal responsibility of the" ship boss "is also investigated." Xia Haibin, director of the Jintang Procuratorate of the District Procuratorate, told reporters that the case involved the whole chain of "purchase, transportation, storage and sale" of sea sand illegally transported at sea.
It is understood that sea sand belongs to the national mineral resources, according to the regulations, minerals need to be approved by the state before mining. In recent years, purified sea sand has gradually become one of the alternative sand sources of river sand.Because of the high profit, many illegal elements have illegally exploited, transported and used it, showing obvious characteristics of organization and scale, resulting in the loss of national mineral resources and serious damage to the marine ecological environment.
"They know that it is illegal trading and transportation, but the main reason for these people to take risks is that the profits are very huge." Xia Haibin said that in recent years, the jurisdiction has maintained the situation of cracking down on illegal trading of sea sand, not only cracking down on criminal offences, but also carrying out administrative penalties in a two-pronged manner to ensure the maximum effect of the crackdown. Xia Haibin disclosed that the relevant departments would be advised to impose administrative penalties on those who did not need to be sentenced for minor crimes in the case. In the next step, the procuratorial organs will hold joint meetings with the public security, maritime police and courts to strengthen cooperation and cohesion, and continue to maintain the high-pressure situation of cracking down on illegal sand mining crimes at sea.
