3. After the auction of the subject is completed, the buyer shall pay all the price and the commission of 5% of the transaction price within 2 working days. The auction price of the buyer is the net price, excluding any other related expenses.
4. After successful bidding, the buyer shall go to the Municipal Administrative Examination and Approval Bureau to apply for the electronic "River Sand Mining Permit", and implement the electronic mining and transportation management system during the construction and transportation period in accordance with the requirements of the Provincial River Bureau. All sand mining activities shall be carried out in accordance with the relevant provisions of the entrusting party, otherwise it shall be deemed as a breach of contract, and the entrusting party shall have the right to cancel its mining rights, and all its expenses shall not be refunded.
5. After the auction is completed, the buyer shall be responsible for all taxes and fees, and the consignor and the auction company shall not bear any related expenses.
6. After successful bidding, the consignor shall directly transfer the auction target to the buyer within 3 days, and the auction company shall not be responsible for the transfer.
7. The entrusting party shall hand over to the buyer according to the status quo of the bid section, and the buyer shall coordinate the handover with the sand mining owner of the original bid section, for which the entrusting party and the auction company shall not be responsible for coordination.
8. The Buyer must conduct mining in strict accordance with the planned GPS coordinates and the scope, depth, time limit and quantity of the operation area, and shall not expand the scope and depth of sand mining without authorization, and shall not cross the border or change the mining location, otherwise the entrusting party has the right to terminate the operation.
9. The Buyer shall be liable for the losses caused by ground crushing and road damage during sand mining.
10. The buyer shall bear all kinds of accidents such as personal injury and death in the process of sand mining, and the entrusting party and the auction company shall not be responsible for any economic and legal responsibilities.
11. All disputes between the buyer and the local people in the process of sand mining shall be settled by the buyer himself, and the client and the auction company shall not bear any mediation responsibility.
12. If the procurement is stopped due to the need of the project or all the expenses incurred by the buyer and the local people, the buyer shall solve the problem by itself, and the entrusting party shall not be liable for compensation, and the bidding expenses shall not be refunded.
13. During the operation of the Buyer in the bid section, the video surveillance service fees installed on the sand mining site shall be borne by the Buyer.
14. After the auction is completed, the buyer shall pay 10% of the auction price to the client as the quality deposit. After the end of the mining period, the full amount can be returned only after the acceptance by the river management station.
15. During the operation period, the safety of water conservancy and hydrological facilities such as river banks, dikes, sluices, culverts and power stations shall not be affected, and the safety of river-crossing highways, railways and pipelines shall not be endangered.
16. A public sign shall be set up at the entrance of the sand yard or at an obvious location, indicating the name of the sand yard, the name of the owner, the mining location, the mining volume, the mining method, the mining time, the GPS coordinate point, the supervision unit, etc. Safety warning signs should be set up in dangerous areas of river sand quarries, indicating danger, prohibition of swimming (wild bathing, fishing) and other signs, clarifying responsibilities and ensuring safety.
17. According to the annual mining plan of river sand mining approved by the entrusting party, the operation shall be carried out evenly in layers and parts. It is forbidden to dig deep pits or dig holes in kilns. The mined sand, stone and earth materials shall be transported as they are mined, and the discarded materials after mining shall be stacked in an orderly manner according to the contract or the location required by the river management authority. It is forbidden to wash sand in the river.
18. The riverbed after mining shall be leveled in time according to the requirements of the entrusting party, and shall be kept smooth without pits and lumps, so as not to affect the safety of flood discharge.
19. The bottom slope and longitudinal slope of the excavated section shall not change the gradient of the river course, and shall not affect the safety of flood discharge and the drainage or diversion of the culvert gate and pumping station through the dike.
20. All environmental protection work in the excavation operation area must be carried out simultaneously with the mining operation and achieve the established results.
21. Vehicles entering the river shall be driven according to the designated entry and exit routes, and it is forbidden to drive at will.
22. Sand and gravel mining and transportation shall not damage dikes, revetments and other water-related engineering facilities, and shall not damage survey marks, observation facilities, communication facilities, communication lines, lighting and alarm devices, boundary signs, mileage piles, publicity boards and other facilities and dike protection forests and grasses.
23. The Buyer must accept the inspection, supervision, management and guidance of the entrusting party, and implement the provisions of the river management authority.
24. According to the requirements of the entrusting party, submit the production situation on time (including output, output value, sales volume, etc.).
25. It is forbidden to forge, alter, buy, sell, mortgage, lease, lend or illegally transfer the River Sand Mining License by other means.
