On October 7, the Ministry of Ecology and Environment issued a notice on the management of industrial noise emission permits. The objective of the work is to gradually incorporate enterprises, institutions and other operators that discharge industrial noise (hereinafter referred to as pollutant discharge units) into the management of pollutant discharge permits according to law, to promote pollutant discharge units to apply for pollutant discharge permits or fill in pollutant discharge registration forms, and to incorporate all industrial noise into the management of pollutant discharge permits according to law during the 14th Five-Year Plan period.

Notice
on Carrying out the Management of Industrial Noise Emission Permits The departments (bureaus) of ecological environment of all provinces, autonomous regions, and municipalities directly under the Central Government, Bureau of Ecology and Environment of the Sinkiang Production and Construction Corps:
In order to implement the Law of the People's Republic of China on the Prevention and Control of Noise Pollution and the Regulations on the Administration of Pollutant Discharge Permits, and implement the administration of pollutant discharge permits for industrial noise in accordance with the law, the relevant matters are hereby notified as follows.
1. General requirements
(1) Work objectives
shall gradually incorporate enterprises, institutions and other operators discharging industrial noise (hereinafter referred to as pollutant discharge units) into the management of pollutant discharge permits according to law, and promote pollutant discharge units to apply for pollutant discharge permits or fill in pollutant discharge registration forms. During the "14th Five-Year Plan" period, all industrial noise will be included in the management of pollutant discharge permits according to law.
(2) The scope
of implementation belongs to the industrial sector (B, C, D) in accordance with the Classification of National Economic Industries (GB/T 4754). According to the Catalogue of Classified Management of Pollutant Discharge Permits for Fixed Pollution Sources (2019 Edition) (hereinafter referred to as the Catalogue), it belongs to the 3rd to 99th categories of pollutant discharge units that should be included in the management of pollutant discharge permits. The competent department of ecological environment at the provincial level may, in accordance with the provisions of Article 8 of the Catalogue, put forward suggestions on the management of industrial noise pollutant discharge permits for the pollutant discharge units that
fall outside the categories 3 to 99 of the Catalogue or that are not stipulated in the Catalogue but really need to be included in the management of pollutant discharge permits, and submit them to the Ministry for determination.
(3) The requirements of the Technical Specification for Application and Issuance of Pollutant Discharge Permits for Industrial Noise (HJ 1301-2023) (hereinafter referred to as the Technical Specification for Industrial Noise) shall apply to the application and issuance of pollutant discharge permits for standard
pollutant discharge units.
(4)
For pollutant discharge units applying for pollutant discharge permits for the first time after the issuance of this Circular, they shall apply for and obtain pollutant discharge permits in accordance with the technical specifications for the application and issuance of pollutant discharge permits for relevant industries and the Technical Specifications for Industrial Noise, and record the management matters of industrial noise pollutant discharge permits in the pollutant discharge permits.
For pollutant discharge units that have applied for and obtained pollutant discharge permits before the issuance of this circular, they shall complete the work related to the incorporation of industrial noise into the management of pollutant discharge permits by 2025, and may, when the validity period of the pollutant discharge permits expires or when they need to re-apply for or change the pollutant discharge permits for other reasons, comply with the Technical Specification for Industrial Noise. Increase the management of industrial noise emission permits through re-application. The management items of industrial noise pollutant discharge permit can be added to the pollutant discharge permit in the form of loose-leaf, and the official seal of the pollutant discharge permit examination and approval department shall be affixed to the loose-leaf.
For the pollutant discharge units included in the pollutant discharge registration, if the pollutant discharge registration is carried out for the first time after the issuance of this Notice, the relevant contents of industrial noise management in the pollutant discharge registration form shall be completed; if the pollutant discharge registration has been carried out before the issuance of this Notice, the relevant contents of industrial noise management shall be added when the pollutant discharge registration form is extended or changed.
(5) When a
pollutant discharge unit re-applies for a pollutant discharge permit, it may submit an application form for an industrial noise pollutant discharge permit through the national pollutant discharge permit management information platform or letters. The examination and approval department of pollutant discharge permits shall issue pollutant discharge permits to qualified pollutant discharge units according to law. Noise-producing units and their numbers, major noise-producing facilities and their quantities, major noise pollution prevention and control facilities and their quantities, categories of acoustic environmental functional areas outside the plant boundary, production periods, emission limits for industrial noise permits, self-monitoring requirements, environmental management account records, compilation of pollutant discharge permit implementation reports, and information disclosure shall be recorded in the pollutant discharge permit.
2. Main tasks
(1) To guide pollutant discharge units to do a good job in applying for and filling in
pollutant discharge permits, the examination and approval departments should strengthen their guidance to pollutant discharge units, and urge pollutant discharge units to apply for pollutant discharge permits in strict accordance with the Technical Specification for Industrial Noise. Fill in the application form for industrial noise emission permit, emphasizing that the pollutant discharge unit shall be responsible for the completeness, authenticity, accuracy and compliance of the contents of the application form.
(2) To strengthen the examination and
approval of pollutant discharge permits, the pollutant discharge permit examination and approval department shall establish a joint examination and approval mechanism, and the noise management personnel shall participate in the examination and approval of the application form for industrial noise pollutant discharge permits, focusing on the examination and approval of whether the emission limits, self-monitoring and environmental management account record requirements conform to the Technical Specification for Industrial Noise. If necessary, on-site verification may be carried out jointly with law enforcement administrative departments.
(3) To organize and carry out the work
of pollutant discharge registration, the examination and approval department of pollutant discharge permit shall organize the pollutant discharge units to carry out the work of pollutant discharge registration, and urge the pollutant discharge units to continue and change the pollutant discharge registration, in accordance with the format of the pollutant discharge registration form (industrial noise part) (see annex for details). Fill in the pollutant discharge registration form truthfully on the national pollutant discharge permit management information platform, including the name and number of industrial noise pollution prevention and control facilities, emission standards, etc.
(4) To strengthen the post-certification supervision
, the ecological environment departments at all levels should strengthen the post-certification supervision of pollutant discharge permits, strengthen the quality management of pollutant discharge permits, and urge pollutant discharge units to discharge pollutants with certificates and according to certificates. Strengthen the law enforcement and supervision of pollutant discharge permits, and punish the pollutant discharge units that discharge industrial noise without obtaining pollutant discharge permits according to law, or fail to carry out industrial noise pollution prevention and control, noise emission, account records, submission of execution reports and information disclosure in accordance with the requirements of pollutant discharge permits.
3. Organizational guarantee
(1) To organize and implement
the provincial ecological environment departments to coordinate and organize the incorporation of industrial noise into the management of pollutant discharge permits within their respective administrative areas, and to strengthen the guidance for the issuance of pollutant discharge permits.
(2) Carry out publicity and training
, encourage various forms of publicity and training through mainstream media and new media, organize technical specialist and business backbone to increase the interpretation and publicity of industrial noise into the management policy of pollutant discharge permits. Improve the awareness and professional level of relevant personnel such as pollutant discharge permit examination and approval personnel, ecological environment law enforcement personnel and technical institutions on the management of industrial noise pollutant discharge permits, and enhance the ability of pollutant discharge units to apply for compliance and discharge according to permits.
(3) To strengthen assistance and guidance
