A sand yard took the opportunity to commit crimes against the wind, secretly carried out production at night, and discharged untreated wastewater into the external environment. It was captured by the law enforcement officers of Jinwan Branch of the Municipal Bureau of Ecology and Environment.
The next day, law enforcement officers seized sand washing equipment, forklifts, hook machines and other facilities, and further investigated and dealt with their environmental violations. At 20:00 on February 8,
2023, the law enforcement officers of Jinwan Branch of the Municipal Bureau of Ecology and Environment conducted a night patrol in Zizhuwan District, Sanzao Town. In the lights, the "sharp-eyed" law enforcement officers found that a small lamp was slowly "fluttering", accompanied by a faint sound of the machine. Alert law enforcement officers immediately went into the area for investigation. It was found that in a sand yard, the sand washing equipment was running, and the "fluttering" lamp was the forklift that kept transporting sand and gravel. Seeing this, several law enforcement officers immediately tacitly divided their forces into two groups and acted separately. One team confirmed the direction of the ditch, filmed the video evidence of the fixed sand yard draining into the sea, and the other team controlled the person in charge of the scene and the driver of the excavator. The illegal act of the sand site was caught on the spot, with irrefutable evidence. The law enforcement officers who carried out law enforcement inspection
on the sand yard
involved immediately asked the enterprise to stop the illegal activities and carried out investigation and evidence collection on the spot overnight. After detailed investigation, it was found that no relevant water pollutant treatment facilities were built in the sand washing yard, and the sand washing wastewater was discharged into the surrounding sea area through artificially excavated non-seepage-proof ditches and discharged into the external environment.
As a result
, the enterprise violated the provisions of Article 42, paragraph 4, of the Environmental Protection Law of the People's Republic of China and Article 39 of the Law of the People's Republic of China on the Prevention and Control of Water Pollution by using seepage pits to evade supervision. On February 9, 2023, in accordance with the provisions of Article 25 of the Environmental Protection Law of the People's Republic of China and Article 4, Paragraph 1, Item 4 and Paragraph 2 of the Measures for the Implementation of Sealing and Seizure by the Competent Department of Environmental Protection, the Department of Ecological Environment sealed up a set of sand washing equipment of the enterprise on the spot, and seized a forklift and a hook machine of the enterprise. At the same time, the environmental violations of the enterprise will be further investigated. Article 39 of
the Law of the People's Republic of China on the Prevention and Control of Water Pollution: It is forbidden to use seepage wells, seepage pits, fissures, karst caves, privately set up underground pipes, tamper with or forge monitoring data. Or discharge water pollutants by means of evading supervision such as abnormal operation of water pollution prevention and control facilities. Article 25 of
the Environmental Protection Law of the People's Republic of China: Where enterprises, institutions and other producers and business operators discharge pollutants in violation of the provisions of laws and regulations and cause or may cause serious pollution, the competent environmental protection departments of the people's governments at or above the county level and other departments responsible for environmental protection supervision and management shall, Facilities and equipment that cause the discharge of pollutants may be sealed up or detained. Environmental Protection Authorities:
In any of the following circumstances, the competent environmental protection authorities shall implement the sealing up and seizure according to law: (4) Through underground pipes, seepage wells, seepage pits, perfusion or tampering with or forging monitoring data. Or discharging pollutants in violation of laws and regulations by means of evading supervision such as abnormal operation of prevention and control facilities. The competent environmental protection authority may seal up or detain the person in any of the circumstances specified in Items (1), (2), (3) and (6) of the
preceding paragraph; the competent environmental protection authority shall seal up or detain the person in any of the circumstances specified in Items (4) and (5) of the preceding paragraph that has caused serious pollution.
