In order to strengthen the management of river sand mining, maintain the stability of river regime, and ensure flood control, navigation and ecological safety, according to the Water Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of the Yellow River, the Regulations of the People's Republic of China on River Management, the Regulations of Shaanxi Province on River Management, and the Measures for the Management of River Sand Mining in Shaanxi Province. The prohibition period of sand mining in the river course of our city is hereby announced as follows:
I. Prohibition period
of sand mining (I) Yellow River: from July 1 to September 30 every year and during the ice flood season (from December 15 to March 31 of the next year), the period of water and sediment regulation and the special period of water, engineering, flood and ecological environment protection of the Yellow River.
(2) Other river sections: from July 1 to September 30 every year and during special periods such as water regime, engineering regime, flood regime and ecological environment protection.
2. Prohibited mining areas
(1) Prohibited mining river sections
1. Yellow River: all river sections where sand can be mined without the approval of the Yellow River Commission.
2. Kuye River: all river sections where sand can be mined without the approval of Yulin Water Conservancy Bureau.
3. Tuwei River: all river sections where sand can be mined without the approval of Yulin Water Conservancy Bureau.
(2) The protection scope of water-related projects such as river-blocking buildings, bridges, dikes and control and guidance projects in prohibited mining
areas shall be designated as prohibited mining areas.
3. Relevant matters
(1) Implementing the strictest regulations on the prohibited mining period and the prohibited mining area, and resolutely prohibiting any unit or individual from carrying out sand mining activities in the prohibited mining period and the prohibited mining area (except for flood control and emergency rescue).
(2) Towns and streets should strictly comply with the requirements of the river and lake length system, further strengthen the management of river sand mining, strengthen routine inspection, and timely detection and reporting. The water administrative department shall be specifically responsible for the supervision, inspection and administrative law enforcement of illegal sand mining in river courses within its administrative area; the public security department shall be responsible for cracking down on illegal and criminal acts in sand mining activities according to law.
(3) Those who violate this announcement and carry out illegal sand mining during the prohibited mining period or in the prohibited mining area shall be severely investigated and punished according to law.
