He was sentenced and confiscated his illegal gains. This is a major breakthrough in the judicial practice of environmental impact assessment fraud after the implementation of the Criminal Law Amendment (11), and also a landmark achievement of the linking mechanism between environmental administrative law enforcement and criminal justice, which shows the "zero tolerance" attitude of the ecological environment departments and judicial departments towards environmental impact assessment fraud and the determination to punish severely according to law.
Environmental impact assessment is the legal guarantee to restrict the access of projects and parks, the first line of defense to keep the green mountains and rivers in the development, and the quality of environmental impact assessment documents is the lifeline of environmental impact assessment work. Liu Youbin said that in recent years, the ecological environment department has taken many measures and made sustained efforts to improve the supervision mechanism, implement intelligent duplicate checking, strengthen targeted supervision, carry out special rectification, increase penalties, promote the convergence of criminal justice, and severely punish the fraud and rough manufacturing of EIA documents.
He said that the Ministry of Ecology and Environment will continue to strengthen the high-pressure and severe punishment of EIA violations. Strengthen early warning of abnormal situations in EIA practice, guide local governments to implement targeted supervision, and transfer serious cases and suspected crimes of EIA fraud to public security departments for criminal responsibility according to law. We should implement the long-term mechanism of EIA supervision and comprehensively strengthen the quality supervision of EIA documents. We will speed up the revision of the Measures for the Supervision and Management of the Compilation of Environmental Impact Reports (Forms) for Construction Projects and supporting documents, improve the management system, and effectively build the first line of defense for source prevention.
