On September 4, the Ministry of Housing and Urban-Rural Development issued an administrative penalty announcement No.2023. According to the

announcement, a concrete mixer sliding accident occurred at the project site of Xingsha Machine Tool Construction Machinery Manufacturing Headquarters Base of Hunan Xingsha Machine Tool Equipment Co., Ltd., resulting in three deaths and a direct economic loss of about 4.558 million yuan.

Hunan Xingsha Machine Tool Equipment Co., Ltd., as the general construction contractor, has not effectively formulated the traffic organization plan for transport vehicles at the project site, and has not set up obvious safety warning signs for vehicle traffic at the construction section of the project site; In accordance with the agreement signed with Ningxiang Shuangtan Concrete Co., Ltd., a special person is not clearly arranged to be responsible for the unified dispatch and command of concrete vehicles entering and leaving the project site; Failure to strengthen the inspection of the roads in the construction site according to the traffic conditions of the vehicles in the construction site, and failure to timely inspect and maintain the displacement, lifting and warping of the manhole covers of the roads in the construction site caused by the rolling of the vehicles, resulting in difficulties in the passage and meeting of the vehicles; The risk assessment and identification of cross-operation with mutual influence between two or more units in the same operation area is not in place, the safety production management agreement has not been signed, the respective safety production management responsibilities and safety measures to be taken have not been clearly defined, the special personnel have not been designated for inspection and coordination, and the implementation of safety measures at the construction site is not effective; In the case that the project has not obtained the construction permit for the construction project, it is illegal to organize the construction of the project in advance.

According to the Changsha Municipal People's Government's "Approval of the Investigation Report on the" 12.2 "Major Vehicle Injury Accident in Ningxiang High-tech Zone", the accident was a major accident of production safety responsibility. the Ministry issued the Notice of Administrative Penalty Opinions on Ministry of Housing and Urban-Rural Development (Jian Du Fa Gao Zi [2023] No.60), which was signed by your unit on June 30, 2023, and submitted a written statement and defense. After study, the Ministry decided not to accept the defense opinion.

In accordance with the first paragraph of Article 71 of the Construction Law of the People's Republic of China, the Ministry has decided to give your unit an administrative penalty of 60 days of suspension of business for rectification. The suspension of business for rectification will be implemented from September 4, 2023. During the period of suspension of business for rectification, no new project shall be undertaken nationwide with the first-class qualification of general contracting for construction projects.

If you are not satisfied with this decision, your unit may apply to our Ministry for administrative reconsideration within 60 days from the date of receipt of this decision or bring an administrative lawsuit to the people's court within 6 months.
