On September 20, the Housing and Urban-Rural Construction Bureau of Tianshui City announced the Measures for the Management of Ready-mixed Concrete and Ready-mixed Mortar in Tianshui City (Draft for Opinions), and solicited opinions from the public.
" Article 2 These Procedures shall apply to the ready-mixed concrete and ready-mixed mortar used for housing construction and municipal infrastructure construction within the administrative area of this Municipality Production, sale, transportation, use, supervision and management. Article
3 The term "ready-mixed concrete" as mentioned in these Measures refers to the concrete mixture which is measured and mixed at the mixing station and transported to the place of use by transport vehicles within the prescribed time in accordance with a certain proportion of cement, aggregate, water, admixtures and mineral admixtures as required. The dry-mixed mortar referred to in
these Measures includes dry-mixed mortar and wet-mixed mortar. Dry-mixed mortar refers to the mixture of dried and screened aggregates, cement and various components determined according to their performance, which is mixed in a professional factory according to a certain proportion, and mixed with water or supporting liquid according to the specified proportion at the place of use. Wet-mixed mortar refers to the wet-mixed mixture consisting of cement, fine aggregate, admixture, water and various components determined according to the performance, which is measured and mixed in the mixing station according to a certain proportion, transported to the place of use by the mixing truck, stored in a special container, and used up within the specified time. Article
4 The municipal housing and urban and rural construction administrative departments shall be responsible for the unified supervision, management and guidance of the quality of ready-mixed concrete and ready-mixed mortar in the whole city, and shall organize and compile the Tianshui Prem ixed Concrete Development Plan. The county (district) housing and urban and rural construction administrative departments shall be responsible for the daily supervision and management of the quality of ready-mixed concrete and ready-mixed mortar within their respective administrative areas. Specifically, the quality supervision agencies affiliated to the housing and urban and rural construction administrative departments of cities, counties (districts) can undertake the corresponding work. The emergency management departments of cities
and counties (districts) are responsible for the supervision and management of the safety production of ready-mixed concrete and ready-mixed mortar production enterprises; the ecological environment departments are responsible for the supervision and management of the environmental protection during the production of ready-mixed concrete and ready-mixed mortar; The comprehensive law enforcement department of urban management is responsible for the supervision and management of environmental protection and environmental sanitation during the transportation and use of ready-mixed concrete and ready-mixed mortar. Departments and units of
natural resources, transportation and traffic management of public security organs shall, in accordance with their respective responsibilities, do a good job in the management of ready-mixed concrete and ready-mixed mortar. Article
5 It is advocated to adopt advanced technology, advanced equipment, advanced technology and modern management methods to produce high-performance and environment-friendly ready-mixed concrete and ready-mixed mortar. In order to reduce the use of natural sand, enterprises are encouraged to use artificial sand produced by general industrial solid wastes such as fly ash, desulfurization ash and industrial tailings in the production process. Article
6 a ready-mixed concrete production enterprise shall obtain the professional contracting qualification for ready-mixed concrete and establish a special laboratory. It is forbidden to alter, lease, lend or illegally transfer qualification certificates in other forms. Before putting into production, ready-mixed mortar production enterprises shall go to the municipal housing and urban and rural construction administrative departments for the record. Production enterprises of ready-mixed concrete and ready-mixed mortar shall organize production in accordance with laws, regulations and technical standards, and shall be responsible for the quality of ready-mixed concrete and ready-mixed mortar during production and transportation. Article
7 The establishment of ready-mixed concrete and ready-mixed mortar production stations shall conform to the requirements of relevant laws, regulations, urban planning, general land use planning, environmental protection and Tianshui Ready-mixed Concrete Development Plan. Article
8 The production enterprises of ready-mixed concrete and ready-mixed mortar shall take measures to recycle the sewage and solid waste generated in the production process; the raw material storage yard and batching bin shall be completely closed, the site shall be completely hardened, and the discharge of dust, noise and other pollutants shall conform to the pollutant discharge standards prescribed by the State. Article
9 Environmental impact assessment shall be carried out for the reconstruction, expansion, relocation and establishment of production sites of ready-mixed concrete and ready-mixed mortar production enterprises, which shall be reported to the municipal housing and urban and rural construction administrative departments for the record. Article
10 The production enterprises of ready-mixed concrete and ready-mixed mortar shall establish and improve the quality assurance system and various quality management systems for the whole process of production and transportation, and carry out production in strict accordance with the requirements of technical standards and specifications and the contract agreement, so as to ensure the quality of products. Article
11 Production enterprises of ready-mixed concrete and ready-mixed mortar shall be equipped with special laboratories, professional technicians and experimental inspection instruments and equipment in accordance with relevant regulations. Production enterprises of ready-mixed concrete and ready-mixed mortar shall strengthen on-the-job training for employees, and professional and technical personnel such as mixing equipment controller, testers and quality inspectors shall take up their posts after training. Production equipment, test and inspection instruments shall be subject to regular self-inspection, maintenance and repair, and relevant departments shall be entrusted to carry out metrological verification according to relevant regulations. Article
12 Production enterprises of ready-mixed concrete and ready-mixed mortar shall not use raw materials that do not meet the quality standards, and shall, in accordance with the requirements of relevant technical standards and technical specifications, sample, store, inspect and accept the incoming raw materials, and file the inspection and acceptance data for future reference; those that fail to pass the inspection shall not be used. Article
13 Production enterprises of ready-mixed concrete and ready-mixed mortar shall design the mix proportion of ready-mixed concrete and ready-mixed mortar in strict accordance with relevant technical standards, norms and contract requirements, and shall be responsible for the mix proportion of their design. The test report of mix proportion (including production mix proportion) shall be signed and confirmed by the director of the laboratory. The production personnel shall organize the production in strict accordance with the production mix proportion provided by the laboratory. No one shall change the mix proportion without the signature and confirmation of the director of the laboratory. Production enterprises
of ready-mixed concrete and ready-mixed mortar shall formulate common mix proportion tables through systematic tests, and the mix proportion tables shall be verified regularly or revised in time according to the changes of materials. Article
14 Production enterprises of ready-mixed concrete and ready-mixed mortar shall carry out factory inspection of ready-mixed concrete and ready-mixed mortar in accordance with relevant technical standards, technical specifications and contract agreements, and only those that pass the inspection can leave the factory, and the inspection results shall be filed for reference. Article
15 The competent administrative departments of housing and urban and rural construction shall strengthen the supervision and inspection of the quality of ready-mixed concrete and ready-mixed mortar in the production process, promptly put forward rectification requirements for the illegal acts found, and urge them to make corrections within a time limit. Article
16 The production enterprises of ready-mixed concrete and ready-mixed mortar shall submit relevant statistical reports on the production and sales of ready-mixed concrete and ready-mixed mortar to the local housing and urban and rural construction administrative departments in accordance with the regul ations, and go through the formalities for the filing of sales contracts. Article
17 Where a production enterprise whose place of industrial and commercial registration is not in the city sells ready-mixed concrete and ready-mixed mortar in the city, it shall hold the qualification certificate of the production enterprise and the business license of the enterprise to the municipal housing and urban and rural construction administrative department for the record, and its products shall meet the quality requirements of the technical regulations of the industry products, and shall not be sold in the city. It has been tested and qualified by a legally qualified testing institution. Article
18 The municipal housing and urban and rural construction administrative departments shall compile the material information prices of ready-mixed concrete and ready-mixed mortar and publish them regularly to the public.
The tenderer or the bidding agency shall include the use of ready-mixed concrete and ready-mixed mortar in the tender documents. Bidders shall refer to the budget quota and include the cost of using ready-mixed concrete and ready-mixed mortar in the bidding control price (maximum bidding price limit) and bidding quotation. Article
19 Transport units of ready-mixed concrete and ready-mixed mortar shall use special vehicles for airtight transportation, and ensure that the vehicles are in good condition and clean. In the course of transportation, corresponding measures should be taken to prevent leakage, scattering, noise and other pollution. Special vehicles for transporting ready-mixed concrete and ready-mixed mortar shall pass in accordance with the areas, sections and time prescribed by the traffic administration department of the public security organ. The traffic management department of the public security organ shall provide convenience for its passage according to law. Concrete mixers and other dregs trucks that
apply for electronic pass codes must ensure that traffic violations are "cleared". Drivers of dregs trucks such as concrete mixers who have scored 12 points in a scoring cycle, failed to participate in the examination within the time limit and failed to deal with multiple traffic violations (more than five times) shall not participate in the transportation work.
Transportation departments and public security traffic management departments share GPS system data resources of concrete mixers and other dregs trucks.
Promote the establishment of synchronous management of face information of drivers of ready-mixed concrete and ready-mixed mortar transport vehicles, whole-process vehicle positioning and video surveillance, driver identity monitoring, bad driving behavior monitoring, illegal transport monitoring, cluster intercom, track playback and real-time monitoring of traffic violations such as speeding. Upload the "city-wide dregs vehicle satellite positioning system monitoring platform" to eliminate and reduce hidden dangers of road traffic safety, while strictly doing a good job in the prevention and control of air pollution of such vehicles. Article
20 The use of ready-mixed mortar shall be promoted at the construction sites of housing construction and municipal infrastructure projects under construction in this Municipality. Within the scope of urban planning, mixing concrete and mortar at the construction site is prohibited for newly built, rebuilt and expanded construction projects, and mixing concrete and mortar at the construction site is gradually prohibited in other areas. The specific scope and time limit shall be determined by the people's governments of the counties and districts where they are located.
In case of any of the following circumstances, the construction unit may mix concrete and mortar on site:
(1) Due to the special needs of the construction project, the production enterprises of ready-mixed concrete and ready-mixed mortar in this city are unable to produce;
(2) Due to road reasons, special vehicles for transporting ready-mixed concrete and ready-mixed mortar cannot enter the construction site;
(3) The total amount used is not more than 150 cubic meters or the one-time amount used is less than 20 cubic meters;
(4) Others really need to be mixed at the construction site. Article
21 Design units shall, in accordance with relevant regulations and relevant technical standards, indicate the performance indicators of ready-mixed concrete and ready-mixed mortar used in the design documents of construction drawings. The examination institution of
construction drawing design documents shall examine the use of ready-mixed concrete and ready-mixed mortar in the construction drawing design documents according to law, and shall not issue a certificate of qualification for the examination of construction drawing design documents in violation of laws, regulations, mandatory standards and technical specifications. Article
22 Construction units and other relevant units are prohibited from purchasing ready-mixed concrete from enterprises that do not have the professional contracting qualification for ready-mixed concrete. The construction unit shall ensure that the roads on the construction site are smooth and smooth, and provide necessary conditions such as lighting and water sources for the use of ready-mixed concrete and ready-mixed mortar. Article
23 When ready-mixed concrete and ready-mixed mortar enter the construction site, delivery inspection must be carried out. The delivery inspection shall be jointly carried out by the supervision unit, the construction unit and the production enterprise organized by the construction unit. Those who fail to pass the inspection shall not be delivered for use. Article
24 Supervisory units shall supervise the use of ready-mixed concrete and ready-mixed mortar by construction units, and shall supervise the whole process of concrete pouring in key parts involving structural safety in accordance with the requirements of the specifications, and make a good record of the on-site supervision. If it is found that the concrete and mortar are mixed on site in violation of the provisions or the unqualified ready-mixed concrete and ready-mixed mortar are used, it shall be stopped; if the stop fails, it shall be reported to the construction unit and the project quality supervision organization in a timely manner. Article
25 If an engineering quality inspection institution finds that the quality of ready-mixed concrete and ready-mixed mortar does not meet the relevant standards in its work (including the witness sampling inspection of concrete and mortar specimens at the construction site and the concrete entity inspection), it shall promptly feedback to the entrusting unit and report to the engineering quality supervision institution at the same time. Article
26 The competent administrative departments of housing and urban and rural construction shall strengthen the supervision and inspection of the quality of ready-mixed concrete and ready-mixed mortar during their use, and shall order the construction units to stop construction and urge them to make corrections within a time limit if they find that the construction units use unqualified ready-mixed concrete and ready-mixed mortar or fail to carry out construction in accordance with the standards and norms. Article
27 Administrative penalties shall be imposed on violations of the provisions of these Measures in accordance with the Regulations on the Quality Management of Construction Projects and the Regulations on the Quality Management of Construction Projects and Safety in Production of Construction Projects in Gansu Province. Article
28 Any staff member responsible for supervision and management of the production, sale, transportation and use of ready-mixed concrete and ready-mixed mortar who commits any of the following acts shall be given administrative sanctions according to law; If a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) failing to perform supervisory and administrative duties in accordance with the law or failing to investigate and deal with illegal acts discovered, resulting in serious consequences;
(2) accepting property or other benefits from others by taking advantage of his position;
(3) Abuse of power, practice favoritism and commit irregularities;
(4) Other acts in violation of laws and regulations. Article
29 These Measures shall not apply to the construction activities of rescue and disaster relief, temporary housing construction and low-rise residential buildings built by farmers themselves. Article
30 These Measures shall come into force as of the date of promulgation and shall be valid for 5 years. The Tianshui Ready-mixed Concrete Management Measures (Tianzhengfa [2018] 144) issued by the Tianshui Municipal People's Government on December 5, 2018 shall be abolished at the same time.
